DISCUSSION:
L e g i s l a t i o n t o impose new d i s c l o s u r e requirements on
l o b b y i s t s , S. 1060 (TAB A ) , passed t h e Senate on J u l y 25. S h o r t l y
t h e r e a f t e r , t h e Speaker o f the House i n d i c a t e d t h a t t h e l e g i s l a t i o n
would n o t r e c e i v e prompt a t t e n t i o n i n t h e House.
Despite t h e
Speaker's words, a House subcommittee h e l d a h e a r i n g on t h e b i l l on
September 7. The House v e r s i o n o f S. 1060 i s p r e s e n t l y b e i n g h e l d
"at t h e desk", and thus c o u l d move t o t h e f l o o r a t any time w i t h
the consent o f t h e l e a d e r s h i p .
On August 4, i n response t o t h e Speaker's d i s c o u r a g i n g words
and b e f o r e announcement o f t h e September 7 h e a r i n g , t h e P r e s i d e n t
"requested
t h a t t h e A t t o r n e y General work w i t h t h e v a r i o u s
e x e c u t i v e branch g e n e r a l counsels t o prepare an e x e c u t i v e o r d e r
t h a t would implement t h e lobby d i s c l o s u r e r e q u i r e m e n t s o f S. 1060
f o r t h e e x e c u t i v e branch, t o t h e f u l l e x t e n t o f t h e P r e s i d e n t ' s
legal authority."

To p r o v i d e f o r the d i s c l o s u r e o f l o b b y i n g a c t i v i t i e s t o i n f l u e n c e the
Government, and f o r o t h e r purposes.
Be i t enacted by the Senate and House o f Representatives

SECTION 1. SHORT TITLE.
T h i s Act may be c i t e d as the "Lobbying D i s c l o s u r e Act o f 1995".
SEC.
2. FINDINGS.
The
Congress f i n d s t h a t - -
(1) r e s p o n s i b l e r e p r e s e n t a t i v e Government r e q u i r e s p u b l i c awareness
o f the e f f o r t s of p a i d l o b b y i s t s t o i n f l u e n c e the p u b l i c decisionmaking
process i n both the l e g i s l a t i v e and e x e c u t i v e branches of the Federal
Government;
(2) e x i s t i n g l o b b y i n g d i s c l o s u r e s t a t u t e s have been i n e f f e c t i v e
because o f unclear s t a t u t o r y language, w^ak-^dmiziistra^ive and
enforcfiment p r o v i s i o n s , and an absence of c l e a r guidance as" t o who i s
r e q u i r e d t o r e g i s t e r and what they are r e q u i r e d t o d i s c l o s e ; and
-
(3) the e f f e c t i v e p u b l i c d i s c l o s u r e o f the i d e n t i t y and e x t e n t o f the
e f f o r t s o f p a i d l o b b y i s t s t o i n f l u e n c e Federal o f f i c i a l s i n the conduct
o f Government a c t i o n s w i l l i n c r e a s e p u b l i c confidence i n the i n t e g r i t y o f
Government.
SEC.
3. DEFINITIONS.
�As used i n t h i s A c t :
(1) Agency.--The term "agency" has t h e meaning g i v e n t h a t term i n
s e c t i o n 551(1) o f t i t l e 5, U n i t e d S t a t e s Code.
(2) C l i e n t . - - T h e term " c l i e n t " means any person o r e n t i t y t h a t
employs o r r e t a i n s another person f o r f i n a n c i a l o r o t h e r compensation t o
conduct l o b b y i n g a c t i v i t i e s on b e h a l f o f t h a t person o r e n t i t y . A person
o r e n t i t y whose employees a c t as l o b b y i s t s on i t s own b e h a l f i s b o t h a
c l i e n t and an employer o f such employees. I n t h e case o f a c o a l i t i o n o r
a s s o c i a t i o n t h a t employs o r r e t a i n s o t h e r persons t o conduct l o b b y i n g
a c t i v i t i e s , t h e c l i e n t i s the c o a l i t i o n o r a s s o c i a t i o n and n o t i t s
i n d i v i d u a l members.
(3) Covered e x e c u t i v e branch o f f i c i a l . - - T h e term "covered
branch o f f i c i a l " means--
executive
(A) t h e P r e s i d e n t ;
(B) t h e Vice P r e s i d e n t ;
(C) any o f f i c e r o r employee, o r any o t h e r i n d i v i d u a l f u n c t i o n i n g
i n t h e c a p a c i t y o f such an o f f i c e r o r employee, i n t h e E x e c u t i v e
O f f i c e o f the President;
(D) any o f f i c e r o r employee s e r v i n g i n a p o s i t i o n i n l e v e l I , I I ,
I I I , IV, o r V o f t h e E x e c u t i v e Schedule, as d e s i g n a t e d by s t a t u t e o r
Executive order;
(E) any member o f t h e u n i f o r m e d s e r v i c e s whose pay grade i s a t or
above 0-7 under s e c t i o n 201 o f t i t l e 37, U n i t e d S t a t e s Code; and
(F) any o f f i c e r o r employee s e r v i n g i n a p o s i t i o n o f a
c o n f i d e n t i a l , policy-determining, policy-making, o r policy-advocating
c h a r a c t e r d e s c r i b e d i n s e c t i o n 7511(b)(2) of t i t l e 5, U n i t e d S t a t e s
Code.
(4) Covered l e g i s l a t i v e branch o f f i c i a l . - - T h e term
l e g i s l a t i v e branch o f f i c i a l " means--
"covered
(A) a Member o f Congress;
(B) an e l e c t e d o f f i c e r o f e i t h e r House of Congress;
(C) any employee o f , o r any o t h e r i n d i v i d u a l f u n c t i o n i n g i n t h e
c a p a c i t y o f an employee o f - ( i ) a Member o f Congress;
( i i ) a committee o f e i t h e r House of Congress;
( i i i ) the l e a d e r s h i p s t a f f o f t h e House o f R e p r e s e n t a t i v e s or
t h e l e a d e r s h i p s t a f f o f t h e Senate;
�( i v ) a j o i n t committee o f Congress; and
(v) a w o r k i n g group o r caucus o r g a n i z e d t o p r o v i d e
l e g i s l a t i v e s e r v i c e s o r o t h e r a s s i s t a n c e t o Members o f Congress;
and
(D) any o t h e r l e g i s l a t i v e branch employee s e r v i n g i n a p o s i t i o n
d e s c r i b e d under s e c t i o n 109(13) o f the E t h i c s i n Government A c t o f
1978 (5 U.S.C. App.).
(5) Employee.--The t e r m "employee" means any i n d i v i d u a l who i s an
o f f i c e r , employee, p a r t n e r , d i r e c t o r , o r p r o p r i e t o r o f a person o r
e n t i t y , b u t does n o t i n c l u d e - (A) independent c o n t r a c t o r s ; o r
(B) v o l u n t e e r s who r e c e i v e no f i n a n c i a l o r o t h e r compensation
from t h e person o r e n t i t y f o r t h e i r s e r v i c e s .
(6) Foreign e n t i t y . - - T h e term " f o r e i g n e n t i t y " means a f o r e i g n
p r i n c i p a l (as d e f i n e d i n s e c t i o n 1(b) o f t h e F o r e i g n Agents R e g i s t r a t i o n
Act o f 1938 (22 U.S.C. 6 1 1 ( b ) ) .
(7) Lobbying a c t i v i t i e s . - - T h e term " l o b b y i n g a c t i v i t i e s " means
l o b b y i n g c o n t a c t s and e f f o r t s i n support o f such c o n t a c t s , i n c l u d i n g
p r e p a r a t i o n and p l a n n i n g a c t i v i t i e s , research and o t h e r background work

�PRESIDENTIAL ACTION ON LOBBY REFORM
For years, Congress has failed to enact legislation reqidrmg full disclosure by lobbyists
The Senate passed the legislation last week by 98-0, but House leaders have indicated
they do not intend to schedule a vote. Today, the President is taking breakthrough
action to implement political reform, announcing that he would require, lobby
disclosure to the extent of his powers.
Summary
Executive branch officials will be prohibited from meeting with professional
lobbyists, unless those lobbyists register and fully disclose their identity, their client, the
funds expended, and the legislation or polity they are seeking to effect In short,
professional lobbyists who wish to contact the executive branch must fully and publicly
disclose their activities. The standards for who is a lobbyist, what triggers registration
requirement, and what would be disclosed would track the standards embodied in the
lobby disclosure legislation that passed the Senate on July 25. This new standard will be
embodied in an executive order, to be issued in fhe near future.
Standards
The executive order would prohibit executive branch employees from receiving
contacts from professional lobbyists who do not register and disclose their activities on a
semiannual basis. Disclosure would include:
- the lobbyist's name
• the client
- a good faith estimate of the funds expended on lobbying the executive branch
and Congress (note: current law only requires disclosure of congressional
lobbying)
• the specific issues they are seeking to influence
(The registration would only be triggered for entities who spent more than
$20,000 a year on lobbying activities.)
Enforcement
Today, the President requested that the Attorney General work with the various
executive branch general counsels to prepare an executive order that would implement
the lobby disclosure requirements of S.1060 for the executive branch, to the full extent of;
the President's legal authority. The proposed executive order would direct executive
branch employees to take steps to assure themselves that professional lobbyists have
made the necessary disclosures before the employees have contact with them. The
Attorney General is to assess the feasibility and legality of additional enforcement
mechanisms that the executive order might employ, including an executive branch-wide

Where e x e c u t i v e branch o f f i c i a l s i n t h e p o l i c y - m a k i n g area do
not have access t o t h e f u l l range o f i n f o r m a t i o n r e g a r d i n g
those who a r e seeking t o i n f l u e n c e t h e i r judgments, such
o f f i c i a l s a r e n o t f u l l y a b l e t o assess t h e arguments and
advocacy t h a t a r e made t o them and so a r e d e p r i v e d o f t h e

Sec. 6. Executive Agent. (a) Within 30 days of the date of
t h i s order, the O f f i c e of Management and Budget s h a l l
designate an agency t o act as the Executive Agent f o r the
purposes of t h i s order.
(b)(1) Within 120 days o f such designation, the Executive
Agent s h a l l
(A) develop and promulgate r e g u l a t i o n s f o r the
a d m i n i s t r a t i o n of t h i s order;
(B)
and
provide guidance on the p r o v i s i o n s of t h i s order;
(C) adopt appropriate procedures t o review disclosures
and semiannual reports^ described i n sections 3 and 4 of
t h i s order.

<p>Michael Waldman was Assistant to the President and Director of Speechwriting from 1995-1999. His responsibilities were writing and editing nearly 2,000 speeches, which included four State of the Union speeches and two Inaugural Addresses. From 1993 -1995 he served as Special Assistant to the President for Policy Coordination.</p>
<p>The collection generally consists of copies of speeches and speech drafts, talking points, memoranda, background material, correspondence, reports, handwritten notes, articles, clippings, and presidential schedules. A large volume of this collection was for the State of the Union speeches. Many of the speech drafts are heavily annotated with additions or deletions. There are a lot of articles and clippings in this collection.</p>
