Draft Specifications
Purpose
o
To provide states with the flexibility to remove barriers in federal regulatory and statutory
requirements to achieve the intended outcomes for those individuals served by federal
training programs.
o
To promote state-wide and local integration of these programs.
o
To encourage state-level pooling of resources provided to administer the wide array of
training programs.
Submission of State Requests for Waivers
o
Governor may submit to the ETR Council [or whatever we call the inter-agency group] a
request for a waiver of 1 or more requirements of the provisions of laws referred to in Title
I, Section B of the Job Training Consolidation and Reform Act of 1994.

o
Governor may submit to the ETR Council a request for a waiver of 1 or more requirements
of the provisions of laws referred to Title I, Section B as part of the application for the
leading-edge/one-stop implementation grants or as an amendment to the application.
o
Waiver requests may be approved even if a state does not receive an implementation grant.
o
The State waiver request must contain the following information:
�Specific requirement(s) that will be waived.
Specific positive outcomes expected from the waiver and why those outcomes intended
by the affected statute cannot be achieved through complying with the requirement^
Similar requirements of state law that the state agrees to waive.

Process that will be used to monitor the implementation of the waiver,
How the waiver request promotes integration and coordination of training programs.
What savings of federal resources for administration will be gained from the pooling of
such funds how will it be used to provide additional services for individuals.
Other information as the ETR may require.
o
The State must provide an opportunity for affected state agencies, local communities, and
other interested parties to comment on the waiver request and submit the comments to the
ETR as part of the request.
ETR Approval of Waiver Requests
o
The ETR group shall approve or disapprove any request based on the information the state is
required to submit within 60 days of submission.
o
The ETR's decision shall state the reasons for the decision, including a response to
comments on the proposal.
o
In the case of an approved request, the state shall disseminate the decision to interested
parties including students, parents, educators, training providers, advocacy and civil rights
organizations, labor and business organizations, and the public.
Term
Each approved waiver shall be for a period not to exceed 3 years. The ETR may extend the
waiver for an additional two years if they determine that it has been effective in enabling the
state to improve outcomes for those individuals served by the federal training programs.
Limits on Waiver Requests
o
The ETR may not waive any provision or regulation relating to—
Basic purposes or goals of such provision \
Maintenance of effort
Comparability of services
Allocation of funds
Eligibility of an individual for participation in a program under such provision
Public health or safety, labor standards, civil rights, occupational safety and health, or
environmental protection.
Prohibitions or restrictions relating to the construction of buildings or facilities.

�Termination of Waivers
o
The federal government shall periodically review the performance of the state and shall
terminate the waiver if it is determined that a continuation of the waiver is not justified or if
the state fails to waive similar requirements of state law.

<p>Michael Waldman was Assistant to the President and Director of Speechwriting from 1995-1999. His responsibilities were writing and editing nearly 2,000 speeches, which included four State of the Union speeches and two Inaugural Addresses. From 1993 -1995 he served as Special Assistant to the President for Policy Coordination.</p>
<p>The collection generally consists of copies of speeches and speech drafts, talking points, memoranda, background material, correspondence, reports, handwritten notes, articles, clippings, and presidential schedules. A large volume of this collection was for the State of the Union speeches. Many of the speech drafts are heavily annotated with additions or deletions. There are a lot of articles and clippings in this collection.</p>
