Mr. LEWIS o f Georgia. Mr. Chairman, I want t o thank my f r i e n d and c o l l e a g u e
f o r y i e l d i n g me the t i m e .
Let me say t o the gentleman t h a t when I was growing up i n t h e s o u t h d u r i n g
the 1940s and the 1950s, t h e g r e a t m a j o r i t y o f the people i n t h a t r e g i o n
b e l i e v e d t h a t b l a c k people s h o u l d n o t be a b l e t o e n t e r p l a c e s o f p u b l i c
accommodation, and t h e y f e l t t h a t b l a c k people s h o u l d n o t be a b l e t o
r e g i s t e r t o v o t e , and many people f e l t t h a t was r i g h t b u t t h a t was wrong. I
t h i n k as p o l i t i c i a n s , as e l e c t e d o f f i c i a l s , we s h o u l d n o t o n l y f o l l o w b u t
we must l e a d , l e a d our d i s t r i c t s , n o t p u t our f i n g e r s i n t o t h e wind t o see
which way the a i r i s b l o w i n g b u t be l e a d e r s .
Mr. Chairman, t h i s i s a mean b i l l . I t i s c r u e l . T h i s b i l l seeks t o d i v i d e
our n a t i o n , t u r n Americans a g a i n s t Americans, sew t h e seeds o f f e a r , h a t r e d
and i n t o l e r a n c e . Let us remember the Preamble o f t h e D e c l a r a t i o n o f
Independence: We h o l d these t r u t h s s e l f - e v i d e n t t h a t a l l people are endowed
by t h e i r c r e a t o r w i t h c e r t a i n i n a l i e n a b l e r i g h t s . Among these are l i f e ,
l i b e r t y and the p u r s u i t o f happiness.
T h i s b i l l i s a s l a p i n t h e face o f the D e c l a r a t i o n o f Independence. I t
denies gay men and women the r i g h t t o l i b e r t y and t h e p u r s u i t o f happiness.
Marriage i s a b a s i c human r i g h t . You cannot t e l l people t h e y cannot f a l l i n
l o v e . Dr. M a r t i n L u t h e r King, J r . used t o say when people t a l k e d about
i n t e r r a c i a l marriage and I quote, "Races do not f a l l i n l o v e and g e t
m a r r i e d . I n d i v i d u a l s f a l l i n l o v e and get m a r r i e d . "
Why do you not want your f e l l o w men and women, your f e l l o w Americans t o be
happy? Why do you a t t a c k them? Why do you want t o d e s t r o y t h e l o v e t h e y

h o l d i n t h e i r h e a r t s ? Why do you want t o c r u s h t h e i r hopes, t h e i r dreams,
t h e i r longings, t h e i r aspirations?
We are t a l k i n g about human b e i n g s , people l i k e you, people who want t o g e t
m a r r i e d , buy a house, and spend t h e i r l i v e s w i t h t h e one t h e y l o v e . They
have done no wrong.
I w i l l not t u r n my back on a n o t h e r American. I w i l l not oppress my f e l l o w
human b e i n g . I have f o u g h t t o o h a r d and t o o l o n g a g a i n s t d i s c r i m i n a t i o n
based on race and c o l o r n o t t o s t a n d up a g a i n s t d i s c r i m i n a t i o n based on
sexual o r i e n t a t i o n .
Mr. Chairman, I have knowN r a c i s m . I have known b i g o t r y . T h i s b i l l s t i n k s
of t h e same f e a r , h a t r e d and i n t o l e r a n c e . I t s h o u l d n o t be c a l l e d t h e
Defense o f M a r r i a g e A c t . I t s h o u l d be c a l l e d t h e defense o f m e a n - s p i r i t e d
bigots act.
I urge my c o l l e a g u e s t o oppose t h i s b i l l , t o have t h e courage t o do what i s
r i g h t . T h i s b i l l appeals t o our w o r s t f e a r s and emotions. I t encourages
h a t r e d o f our f e l l o w Americans f o r p o l i t i c a l advantage. Every word, e v e r y
purpose, every message i s wrong. I t i s not t h e r i g h t t h i n g t o do, t o d i v i d e
Americans.
We are moving toward t h e 21st c e n t u r y . Let us come t o g e t h e r and c r e a t e one
n a t i o n , one people, one f a m i l y , one house, t h e American house, t h e American
f a m i l y , the American n a t i o n .

The Human R i g h t s campaign has endorsed R e p r e s e n t a t i v e Peter
T o r k i l d s e n (R-MA), who opposes gay marriage, over h i s c h a l l e n g e r , John
T i e r n e y , a Democrat who s u p p o r t s t h e r i g h t o f gay and l e s b i a n people t o
marry. The endorsement went f o r w a r d d e s p i t e Mr. T o r k i l d s e n ' s t e n - y e a r
r e c o r d o f f l i p - f l o p p i n g on gay and l e s b i a n i s s u e s .
John T i e r n e y has
gone on r e c o r d w i t h f u l l s u p p o r t f o r gay and l e s b i a n e q u a l i t y i n housing,
employment, t h e m i l i t a r y , and m a r r i a g e .
Mr. T i e r n e y has a s t r o n g chance t o w i n t h e race, g i v i n g HRC good
reason t o pay more a t t e n t i o n t o him, say a c t i v i s t s .
The Boston Globe
r e p o r t e d on J u l y 16, 1996 t h a t Mr. T i e r n e y has r a i s e d more money t h a n
R e p r e s e n t a t i v e T o r k i l d s e n i n t h e January t o June p e r i o d .
I n a d d i t i o n , Mr.
T i e r n e y came t h e c l o s e s t o f any Democrat i n t h e c o u n t r y t o u n s e a t i n g a
Republican i n 1994, t h e year o f t h e G i n g r i c h r e v o l u t i o n , when no
incumbent Republican l o s t a r a c e . Mr. T o r k i l d s e n won t h a t y e a r w i t h a
2% margin, and i s n o t f a v o r e d t o w i n t h i s year i n a d i s t r i c t t h a t h i s t o r i c a l l y
f a v o r s Democrats. Both t h e Republican and Democratic C o n g r e s s i o n a l
Campaign Committees have t a r g e t e d t h e race h e a v i l y .
HRC has acknowledged t h a t i t made no a t t e m p t t o i n f o r m t h e d i s t r i c t , i t s
members, o r Mr. T i e r n e y about when and how t h e endorsement f o r t h i s
race was t o be made.
Now, gay and l e s b i a n a c t i v i s t s charge t h a t HRC avoided c o n t a c t i n g Mr.
T i e r n e y ' s campaign w h i l e i t scrambled t o f i n d a R e p u b l i c a n - any
Republican i n t h i s y e a r ' s e x t r e m i s t Congress - who c o u l d r a t e h i g h e r
than 50% on i t s s c o r e c a r d .
A c t i v i s t s have c a l l e d upon HRC t o withdraw t h e i r endorsement, c i t i n g t h e
DOMA v o t e as an o p p o r t u n i t y t o change i t s p o s i t i o n .

from a core c o n s t i t u e n c y . "When the p r e s i d e n t s a i d he'd s i g n
the b i l l , t h e r e was no reason f o r the Republicans t o push f o r i t

c o l l a b o r a t i n g w i t h him.

e-mail d i s c u s s i o n l i s t s , i n c l u d i n g QueerLaw, QueerPlanet, and a Same-Gender
Marriage L i s t . His new l i s t w i l l be c a l l e d Q u e e r P o l i t i c s . I ' l l send you
i n s t r u c t i o n s on how t o s i g n up as soon as i t i s s e t up and ready t o go.

The advantage i s t h a t you get fewer messages i n your box (because each
message i s a c o m p i l a t i o n o f s e v e r a l messages). The disadvantage i s t h a t
t h e r e i s a time d e l a y (between s e v e r a l hours and a day, depending on volume
of a c t i v i t y ) i n r e c e i v i n g messages.
We need v o l u n t e e r s who w i l l agree t o serve as moderators f o r Queer
P o l i t i c s . We need a t l e a s t 7 so each can be assigned one day of the week.
Five have a l r e a d y v o l u n t e e r e d --we need two more. A l l messages sent t o
the unmoderated l i s t d u r i n g t h a t day would be sent t o the moderator, who
would screen them and send the a p p r o p r i a t e ones t o the moderated l i s t . My
guess i s t h a t each v o l u n t e e r w i l l need t o spend about an hour per week
screening and a p p r o v i n g messages f o r d i s t r i b u t i o n .

of Americans? I f t h i s i s n ' t an example of unnecessary i n t e r f e r e n c e , I ' d
be hard put t o f i n d a b e t t e r example. I n r e c o l l e c t i n g my h i s t o r y , i s
t h e r e s t i l l such a t h i n g as a "pocket v e t o " by which a P r e s i d e n t s i m p l y
does not s i g n a p i e c e o f l e g i s l a t i o n ? Perhaps i f t h a t were employed, you
would have the o p p o r t u n i t y t o quash an oppressive measure such as t h i s ,
w i t h o u t c r i t i c i s m from t h e o p p o s i t i o n f o r s u p p o r t i n g an unpopular i s s u e .
You would a l s o have f u r t h e r o p p o r t u n i t y t o b l a s t the o p p o s i t i o n f o r
t r y i n g t o d i v i d e Americans and i n h i b i t s o c i a l p r o g r e s s ; n o t t o mention
b e t r a y i n g t h e i r own p o l i c y about governmental i n t e r f e r e n c e . T h i s c o u l d
a l s o be viewed as unwise tampering w i t h the C o n s t i t u t i o n ; i n regards t o
not o n l y the F u l l F a i t h and C r e d i t Clause, but i n the wisdom o f t h e
Federal Government i n v i t i n g t h e i n d i v i d u a l s t a t e s t o negate each o t h e r ' s
o f f i c a l a c t s . I r e a l i z e t h a t i n the c u r r e n t p o l i t i c a l c l i m a t e , we're not
e x a c t l y the most p o p u l a r cause t o s u p p o r t ; but I would p l e a d w i t h you,
s i r , not t o j o i n i n t h e a t t a c k on so many people who have s u p p o r t e d you,
by s i g n i n g t h i s b i l l !
I myself f i n d i t h a r d t o understand why o t h e r people are so
determined t o i n t e r f e r e w i t h my l i f e .
I have no d e s i r e t o d i c t a t e t o
o t h e r people where t h e y can l i v e , where they can work, who t h e y want t o
a s s o c i a t e w i t h , and t o whom t h e y wish t o b i n d themselves i n a l o v i n g
p a r t n e r s h i p . I have, so f a r , been r e l a t i v e l y f o r t u n a t e as f a r as
e n c o u n t e r i n g a n t i - g a y d i s c r i m i n a t i o n i s concerned. I haven't been
p h y s i c a l l y a s a u l t e d , and I was spared v e r b a l harrassment when I was v e r y
young, which might have p r o p e l l e d me i n t o b e i n g one o f t h e many teenage
s u i c i d e s which, from t h a t cause, are so p r e v a l e n t today.
My major
encounters w i t h p r e j u d i c e have c o n s i s t e d of b e i n g v e r b a l l y h a r r a s s e d a t
two j o b s here i n St. Augustine; r e s u l t i n g i n my b e i n g f i r e d from one, and
having t o q u i t the o t h e r . I was a l s o e v i c t e d from my apartment when my
l a n d l a d y found out t h a t my p a r t n e r had moved i n w i t h me, almost t h r e e
years ago.
I wonder how t h e R e l i g i o u s R i g h t would r e a c t i f , by some l e g i s l a t i v e
a c t i o n , they were p r o h i b i t e d from s h a r i n g l i v i n g accomodations, g i v e n no
p r o t e c t i o n from b e i n g f i r e d from j o b s which had n o t h i n g t o do w i t h t h e i r
p e r s o n a l l i v e s , and even p h y s i c a l l y a s s a u l t e d or even k i l l e d !
I don't
want t o l i m i t anyone e l s e ' s l i f e , why should mine be t r e a t e d so?
I was r a i s e d i n t h e Nazarene Church, so I'm no s t r a n g e r t o a
r e l i g i o u s u p b r i n g i n g ; however, as I l e a r n e d more and more o f what
o r g a n i z e d r e l i g i o n was t r y i n g t o do t o me and mine, I q u i t e
understandably had l e s s and l e s s t o do w i t h i t . My c u r r e n t p o s i t i o n i s a
s o r t of l i v e and l e t l i v e a t t i t u d e , and I r e s p e c t t h e d e s i r e of t h e
r e l i g i o u s community t o l i v e t h e i r l i v e s as they wish.
I only wish they
had the same r e s p e c t f o r me.
As a compromise p o s i t i o n , I would f e e l
c o m f o r t a b l e w i t h a more s e c u l a r acknowledgement of my r e l a t i o n s h i p , which
would g r a n t me e q u a l i t y i n a l e g a l sense. My l i f e would c e r t a i n l y be
l e s s anxious i f I were a b l e t o share i n my p a r t n e r ' s h e a l t h i n s u r a n c e ,
and when we bought t h a t house I spoke o f , t h e r e would be no need t o
i n s u r e ownership w i t h a l o t o f l e g a l b o t h e r t h a t h e t e r o s e x u a l couples are
not saddled w i t h .
I won't l e n g t h e n my l e t t e r w i t h t h e s u b j e c t o f t h e t a x
advantages, except w i t h t h e o b s e r v a t i o n t h a t w i t h a l l the hue and c r y t h e
R i g h t has made about our campaigning f o r " s p e c i a l r i g h t s " ; who e x a c t l y
has the s p e c i a l r i g h t s here?
I now want t o approach the q u e s t i o n o f why some people f e e l t h a t I'm
l e s s d e s e r v i n g of t h e r i g h t s and p r i v i l e g e s t h a t t h e y e n j o y .
I don't
f e e l t h a t I'm l e s s moral t h a n t h e next person, gay or h e t e r o s e x u a l .

regs. Agreed t h a t by n e x t meeting (a) HHS would have convened a
regs meeting w i t h them, (b) INS would have convened an
i n f o r m a t i o n a l meeting and (c) a p r o p o s a l on a w o r k i n g group on t h e
performance f u n d would be developed by HHS and t h e groups. As you
may know, t h e weekly meetings w i l l be a t 1:00 on Wednesday.

�Thank you for contacting me regarding same-sex marriage.
I know this is a difficult issue for many Americans and that
reasonable people have strongly held beliefs on either side of the issue.
And while I signed the bill sent to me by the congress
because it was consistent with my previously stated views on the
subject, I strongly believe that raising this issue last year, especially
in the context of the election, was divisive and unnecessary.
It is yet another attempt to divert the American people from the urgent need to
confront our challenges together. The rich fabric of American society
is woven from the threads of our shared experience, and it is of the
utmost importance that our nation work to expand this common ground.
Throughout my public life, I have strongly opposed
discrimination against any group of people, including gay and
lesbian Americans, and I have supported legislation to outlaw
discrimination against gays and lesbians in the workplace. I have
also sought to heighten public awareness of the discrimination and
promote inclusion in order to send a message of equality and
acceptance.
My Administration has taken more steps than any other on behalf
of gay and lesbian Americans. For the first time in history, we

President Clinton signed the Defense of Marriage Act (DOMA) into law on September 21, 1996. The Act declared that no state shall be required to recognize a same-gender marriage performed in another state. DOMA also defined marriage as only between a man and a woman for purposes of Federal law. This collection consists of files and email accounts from the White House staff related to The Defense of Marriage Act. The collection also contains records related to Hawaii Supreme Court’s Baehrs vs. Lewin, and California’s Proposition 22. The collection consists of clippings, emails, letters, memoranda, notes, press releases, and talking points concerning DOMA, same sex marriage, and domestic partnerships.
