Scope and Content
The materials in FOIA 2010-0381-F are a selective body of documents responsive to the topic of
the FOIA. Researchers should consult the archivist about related materials.
FOIA request 2010-0381 contains news articles concerning the Supreme Court ruling on Barnett
Banks.
Barnett Bank was founded in 1877 and eventually became the largest commerial bank in Florida.
The bank was sold to NationsBank in 1997. NationsBank and BankAmerica Corp merged in
1998 to form Bank of America. In October of 1993, Barnett Banks, an affliated national bank,
which has branches in small Florida towns, bought a Florida licensed insurance agency. The
Florida State Insurance Commissioner, referencing the 1974 Florida State Statute which
prohibits banks from selling certain types of insurance, ordered Barnett to stop selling insurance.
Barnett filed action for declaratory and injunctive relief in federal court claiming the 1916

�Federal Statute pre-empted the Florida State Statute. The District Court ruled for the defendant,
the Florida State Insurance Commissioner, by upholding that the Federal Statute did not fall
within the McCarran Ferguson Act’s exception because it did not specifically relate to the
business of insurance and that the State Statue was a law enacted for the purpose of regulating
insurance. The Eleventh Circuit Court of Appeals upheld the District Court’s ruling.
In March of 1996, the Supreme Court overturned the ruling of the District Court and sided with
the plaintiff, Barnett Banks. The Supreme Court reasoned that the Federal Statute which gives
banks broad privileges to sell insurance is governed by federal rules and regulations and the State
does not have to right to pre-empt the Federal Statute.
Clinton Presidential Records relating to Barnett Banks consist of Automated Records
Management System (ARMS) emails.
Automated Records Management System (ARMS) records responsive to this FOIA originate in
the following agencies: Office of Policy Development (OPD), and Default e-mails belonging to
no specific agency. These e-mails consist of articles forwarded between staff members.
System of Arrangement
Records that are responsive to this FOIA request were found in these collection areas — Clinton
Presidential Records: Automated Records Management System [Email].
The Automated Records Management System (ARMS) is a database that contains email records
of the Executive office of the President. This system maintained unclassified Presidential
Records email. The ARMS dataset is comprised of 6 sub-series of email records called
“Buckets.” The buckets include NPR, OPD, POTUS, WHO, CEA, and Default. ARMS emails
are arranged chronologically by creation date.
