Upcoming Presidential Actions and Initiatives
/
A number of agencies have now responded to Christine
Varney's request for a list of possible upcoming executive
actions. Most of what's been received is thin gruel and of no
particular interest in term~ of generating a set of presidential
actions with some dynamism and punch for the next 60 days. There
are, however, some worthwhile proposed actions or initiatives
that the President could move on in the coming days or weeks.
Some have already been the subject of active discussion and are
in the on-deck circle waiting to go. This memo sets forth the
proposed actions that, in our opinion, the President should
undertake:
Staff Reductions and Administrative Savings
o
soon.
Cut the White House staff by 25%.
Everyone agrees we need to do it.
This will be ready
o
Require federal managers to achieve 3% across-the-board
administrative savings.
o
Order a cut of 100,000 federal government positions
through attrition.
�Perks
o
Eliminate the use of certain perks for government
officials including portal-to-portal car service and the use of
civilian aircraft. This is good, strong symbolism and we should
cut through the bureaucratic underbrush and move forward on it
ASAP.
Labor
There are three executive actions which Bob Reich recommends
accomplishing promptly. These actions make sense on the merits
and would be warmly received by labor.
o
Revoke the Bush Executive Order requiring federal
contractors to post a notice that workers are not required to
join unions.
o
Revoke the Bush Executive Order prohibiting the use of
project agreements on federal construction projects.
o
Lift the lifetime ban on PATCO workers -- repealing ~ ~
President Reagan's directive and permitting strikers to apply for ,r
reemployment with the FAA. Without condoning the PATCO strike,
~
the President could take the humane position that a 12-year
banishment is more than enough.
~
We should consider revoking the two Bush Executive Orders now,
but delaying the PATCO memorandum until after the economic speech
where our broader economic and reinventing government themes will
be laid out.
Quest for Excellence Conference
The President and Vice President have been invited to
address the "Quest for Excellence V" conference put on by the
Commerce Department's National Institute for Standards and
Technology. The conference begins February 15, nearly
dovetailing with the President's announcement of his economic
plan. NIST is one of the leading players in the effort to
improve U.S. performance in civilian technology. This is a major
conference on quality to be attended by around 1000 industry
executives. It could provide a perfect forum for the President
to demonstrate his commitment to, and showcase his ideas about,
boosting civilian hi-technology, if we can follow through with
some executive action-- Presidential memoranda or E.O.'s on
redirecting R&D spending, procurement reforms etc. -- all things
the President promised in the campaign, but not proposed by
Commerce.

council on Aging Appointments
HHS reports that, as a result of recent legislation, all 15
members of the Federal Council on Aging, which reports to the
President, the Secretary of HHS and Congress on the special needs
of older Americans, will be turned out. New members, with
staggered terms, need to be appointed by April 1. The President
will make 5 appointments, as will the Speaker of the House and
the Majority Leader of the Senate. The President could use these
appointments to reconfirm his connection with and feeling for
older Americans.
Upcoming Legislative Actions
In addition to family leave and motor voter, other "fast track"
legislation on the Departments' lists include:
NIH Reauthorization
HHS expects rapid congressional action on s. 1, the NIH
reauthorization bill, which reauthorizes NIH research programs,
enhances women's health initiatives and strengthens AIDs
research. It also codifies the Presidential Memorandum lifting
the ban on fetal tissue research.
Family Planning Reauthorization
HHS believes that the Title X reauthorization bill may move
quickly in both houses. The bill provides federal funding for
family planning clinics for low-income patients and will codify
the Presidential Memorandum lifting the "gag" rule.
Conclusion
It is pretty clear that in the short run, generating good
ideas is going to be a top down operation. Rahm Emanuel and
Bruce Reed have been developing a broader list of domestic policy
ideas which could be done in the next several weeks. We should
also schedule a policy brainstorming session in areas beyond the
budget and government reform areas to generate some ideas for
strong action.

Executive Orders Concerning Federal Contracting
and Posting of Workplace Notices
The attached executive orders fulfill promises that
you made during the campaign in response to concerns expressed
to you by representatives of organized labor.
These concerns
stemmed from eleventh hour political actions taken by the Bush
Administration prior to the election in 1992 to appease antiunion interests.
The first of the proposed executive orders would
I! undo a Bush Administration directive that unfairly excludes
I~: contractors who rely on labor arranged through "project
agreements" from bidding on federal construction contracts.
These project agreements have long been recognized as valid
and appropriate under federal labor law, and these agreements
promote adherence to proper labor standards, safe working
conditions, and more predictable costs for completing projects
in a timely manner.
The second proposed order rescinds a policy that
requires federal contractors to place notices informing
workers that they are npt required to join or support a union.
This is a blatantly on~-sided, anti-union directive since it
omits any requirement that contractors notify workers of any
of their other rights protected by the National Labor
Relations Act, such as the right to organize and bargain
collectively.
Both these orders address problems that need to be
resolved immediately.

Proposed Executive Order Entitled "Revocation of
Certain Executive Orders Concerning Federal
Contracting"
SUMMARY: This forwards for your consideration a proposed
Executive order drafted at the request of the Secretary of·
Labor. The proposed order would revoke two Executive Orders
that interfere with the collective bargaining process on
certain federal contracts.
BACKGROUND: Executive Order No. 12818 (October 23, 1992)
prohibits contractors that have entered into project agreements
with unions from bidding on federal construction contracts.
Project agreements are a special form of collective bargaining
agreement common to the construction industry. Such agreements
establish labor standards for work prior to the hiring of
workers and selection of a contractor for a project. Under
such an agreement, the union refers workers to staff the
employer's project subject to the conditions of the project
agreement. A project agreement allows contractors to know
their costs before bidding, assures a stable supply of skilled
workers, and assures workers of safe working conditions. The
proposed order would revoke Executive Order No. 12818, thus
allowing such project agreements for federal construction
contracts.
Executive Order No .. 12800 (April 13, 1992) requires all
unionized government contractors to post a notice in the
workplace informing employees of their right under the National
Labor Relations Act not to join or support a union. It
authorizes the Secretary· of- Labor to promulgate enforcement-- ------- regulations and to pursue debarment proceedings against federal
contractors who violate the order. However, the matter of such
a notice concerns the regulatory implementation of the Supreme
Court's decision in Beck v. Communications Workers of America.
Such implementation is typically a subject for the National
Labor Relations Board (NLRB). The proposed order would revoke
Executive Order No. 12800, terminating the requirement for
posting of the notice, and leaving the matter to the NLRB.
RECOMMENDATION:
Executive order.

By the authority vested in me as President by the
Constitution and the laws of the United States of America, and
in order to eliminate Executive orders that do not serve the

believe that these steps, by reducing unnecessary federal government intrusion into work-place
relations, ullimately will promote the shared goals of American workers and management and
strengthen the ability of this country 1 s businesses anci inliustry to compete in the world
economy.
Revocation Of Executive Order No. 12818
First, I am revoking Executive Order No. 12818. Th1s Order, issue.d oo October 23,
1yc.)2 by President Bush, prohibits contractors that have entered into project agreements with
unions from bidding on federal construction contracts. American ta.xpayen; iilld the federal
government are not well~served by this restriction. Such agreements establish labor
st:an®rds for work early i 11 lh~ process. They reduce 1nstances of cost overruns by
permitting contract bidders to make more reliable cost estimates before bidding. ThP.y
increase completion of projects in a timely manner by assuring a stable supply of skilled
workers. And they promote AAfE': working conditions. By revoking Executive Order
No.12818 today, such project agreements will again be allowed in federal construction
cont:racts.
Revocation Of Executive Order No. 12800
Second, I am revoking Ex:ecuti:ve Order No 12800, issued on April 13. 1992. This
Order required unionized federal contra~;tors to vu:sl d notice in t:he workplace that workers
are not required to join or support a union and threatened sanctions against contractors who
uiu not comply. The effect of this Order was distinctly antiunion as it did not require
contractors to notify workers of any of their other riehts protected by the National Labor
Relations Act, such as the right to organize and bargain collectively. By revoking this
Order, T today end the government's role in promoting thi~ uue-~ided version of workplace
rights.

This will allow us to review the statement for legal
implications. Likewise, we should receive a final copy of any
public statement subsequently revised before issuance. As an
example, today we received an inquiry whether the President's
Task Force on National Health Care Reform is subject to FOIA, but
we had no copy of the statement or any other document defining
the Task Force to analyze in issuing an opinion. Secondly, we
understand the President may issue a statement concerning the
applicability of the Family Leave Act to White House staff. This
should be reviewed in advance for legal implications.

STATUS AND PREPARATIONS
FOR THE OUTCOME
OF THE RODNEY KING TRIAL
BACKGROUND:
As the jury debates the fate of the four Los Angeles police
officers accused of beating Rodney King, Federal, State and local
governments are preparing for the potential of civil unrest in
various parts of the country. Officials are wary that the verdict
might spark riots in various cities, especially in the Los Angeles
area and other parts of California. The first trial las~ April
resulted in civil unrest and demonstrations in places such as Los
Angeles County, San Francisco, Las Vegas, Atlanta, Chicago, and
Washington, DC. The degree of destruction varied from considerable
in Los Angeles to minimal in Washington, DC, where only mi!1or
demonstrations obstructed traffic.
A Presidential disaster
declaration was issued for the State of California.
FEMA Region IX reported that a verdict may occur as soon as
tomorrow, April 14.
Due to various legal concerns over due
process, the judge presiding over the trial may not hold the
verdict for four hours in order to give local, State and Federal
law enforcement authorities.
There is speculation that civil
unrest following this verdict may be minor, with major civil unrest
occurring at the conclusion of an unrelated trial resulting from
last year's civil disturbance, scheduled for late July.
READINESS ACTIVITIES:

The following activities have occurred in preparation for potential
Emergency Support Team activities:

A roster was developed and all of the potential EST
information and planning personnel and agency liaisons have
been put on alert.

In response to a request by the Department of Justice (DOJ) ,
FEMA has identified two liaisons to operate from the DOJ
Co~and Center once the verdict has been announced.
*
The Federal Response Division is contacting all FEMA Regions
to discuss their readiness activities and their sense for
where problems might arise.

Four
teams have been identified for immediate deployment to Washington,
DC, Baltimore Wilmi:1gton, Delaware, and Northern Virgin:a to
support State and local identifying needs.
The Region plans to
stage a team in Washington, DC, prior to the verdict, possibly as
soon as tomorrow morning. David Hall will fax information as soon
as possible.

Region IV will use the same contingency plan as in any other
situation to prepare for civil unrest.
Region VI is monitoring situation but expects no civil unrest in
its States.
Region VII will fax

Region IX reported that Nick Nikas and Lou Canton were dispatched
to Los Angeles o,n April 13 to meet with officials at the Los
·Angeles FBI office. After discussing contingency plar..ning with the
FBI and if time permits, Nikas and Canton will meet with officials
at the Los Angeles City and County EOCs, the L.A. Sheriff and fire
services dispatch centers. They may return to the Regional office
as early as tomorrow. The Region is in conscant contact with the
States of · California, Nevada and Arizona and is closely
coordinating with the State of California Office of Emergency
Services law enforcement personnel. Mark Duggan (FEMA Region IX)
reported that:
(1) the State of California feels that mutual aid
agreements should enable the State to handle any civil unrest and
(2) the City of Los Vegas is a bit uneasy due to a very low
percentage of law enforcement/emergency management personnel to
population.

CONTINGENCY ROSTER
FOR EMERGENC1 SUPPORT TEAM
FOR POTENTIAL CIVIL UNREST
April 13, 1993
In an attempt to prepare for possible activ:.ty following the
reading of the Rodney King trial verdict, FEMA has developed a
contingency roster for a possible activatior.. of the Emergency
Support Team.
Due to the uncertain timing of the verdict, the
following personnel are to be placed on alert until an activation
notice is issued.
The first shift will commence at 0630 and
conclude at 1830, when the second shift will report for duty.
Situation reports will be due by 0600 and 1800 every day and wil~
be reviewed by the Chief of the Federal Response Division prior to
distribution.

An account of the resource
Jonathan Prince served in various capacities during the two terms of the Administration. He was one of President Clinton’s speechwriters, Deputy Assistant Secretary of State, and directed the public relations effort related to the fallout from the bombing of refugees by NATO forces during the war in Kosovo. This collection consists his speechwriting files which contain speech drafts, handwritten notes, memoranda, correspondence, publications, and schedules. Prince wrote most of President Clinton’s radio addresses from 1993-1997. He also specialized in dealing with domestic issues such as crime, gun control, unemployment, urban development, and welfare.
