This Jobs With Justice study is a pretty big slam:
First, it's an organized effort by ACORN, AFSCME, and the United
Steelworkers and they did not have the courtsey to give us any heads up
on.
(I was the one who alerted Karen T. and DOL.)
Second, the thesis of both publications is to argue against the
President's statement from August that "We now know that welfare reform
works." That quote is the first line of one publication, and is
paraphrased in the second.
I'll bring you copies.
Here's a quick summary:
welfare Reform as We Know It: First Hand Accounts from the Front Lines has
one page case studies from New York, Milwaukee, Boston, Kentucky and
elsewhere, mainly slamming workfare for being unfair, unsafe, and
anti-labor. The introduction states that "Despite protective rhetoric and
directives from the Department of Labor and other federal agencies, abuses
still occur" and concludes: "We know enough to conclude that welfare
reform is not working."
welfare Reform: The Jobs Aren't There argues that there are twice as many
welfare recipients seeking work as there are low wage jobs.
CEA is now
examining this more closely, but they say the study greatly understates
the number of low-skilled jobs (estimating only 430,000 were created in al
1 of 1997 and 273,000 in 1998). It also radically overstates the number
of welfare recipients entering the workforce, saying 1.2 million adults
will need jobs in 1998.
(The study does not say how that number was
reached, but it equals one-third of the adult caseload -- a very large
number to expect to enter the workforce next year (and remember, many
welfare recipients are already in the workforce, combining work with
welfare) .

I don't think we need to do anything in the budget for next year.
It has
full funding for COPS as agreed to in the BBA (1.4+ billion). What we
need to do is some combination of the following:
(1) get DOJ to back-off its "settle for 70,000" attitude and look for
creative new ways to keep demand up (i.e., new targeted programs, waivers
of the 75,000 cap for big cities, etc.);
(2) get DOJ to back off its position that it can't use its statutory
waiver authority w/out the appropriators signing off;
(3) have OMB accept that COPS funding won't necessarily drop off in FY
2000 -- and get them to realize that keeping demand/interest up, through
some flexibility, is as important as keeping the 100,000 count;
(4) have WH and OMB leg. affairs make this a bigger priority with the Hill
leadership types (will never win the DOJ/approps. relationship battle); and
(5) get the President talking COPS again and doing cop events (I'll take
handing out COPS funds and talking about crime rates going down any day
before another directive.
Plus, I'm sure there's more we can be doing that hasn't immediately
occurred to me. I'll keep thinking about it.

Also, I called to ask about the Bowles/McCaffrey meeting on the SW
border. Are you, Elena or both going? What's the strategy? Nothing has
happened since the meeting between the Generals about a month ago.

Duke gives benefits to grad students' same-sex partners

Duke University will begin offering health insurance and other benefits
to gay and lesbian partners of graduate students Jan. 15, President Nan
Keohane announced Tuesday.
The new policy comes nearly three years after the campus extended
benefits to same-sex partners of faculty and staff.
--It's long overdue, " said Ian Lekus, a fifth-year graduate student in
history and member of Queer Grads. --But we are very pleased to see Duke
University recognize the equality of same-sex relationships to those of
legally married heterosexual partners and live up to its own
nondiscrimination policy. ' ,
Keohane's announcement, in the form of a letter to the executive
committee of the Task Force on Lesbian, Gay and Bisexual Matters, came
after she spoke with campus trustees behind closed doors about the matter
this weekend.
Keohane could not be reached for further comment Wednesday.

The availability of health insurance may be bit more problematic,
university officials warned. Duke must negotiate a new contract with a
company that provides same-sex spousal equivalent coverage.
Graduate and professional students interested in signing up their
same-sex partners will need to meet the same criteria required of Duke
employees. Applicants must sign an affidavit stating they are in a
long-term relationship in which both partners share personal and financial
responsibility.
Duke undergraduates will not be eligible for same-sex benefits because
the university does not recognize their financial independence from
parents or guardians.
Heterosexual live-in couples do not qualify under the policy and must
marry to receive full campus benefits. Same-sex marriages are not
recognized in North Carolina.
--I'm just relieved that the issue is being put to bed, " said James
Harkins, a fifth-year graduate student in music who began working on the
policy change in 1993. --It has been frustrating that this inequity has
been around for such a long time. ' ,
The push for same-sex benefits began shortly after Duke adopted a 1988
equal opportunity policy that denied discrimination on the basis of
--sexual orientation or preference. ' ,
After nearly,five years of campus debate over the moral and financial
ramifications of changing the policy, Keohane ,arrived on campus and
quickly gained support for extending benefits to the same-sex partners of
professors and non-faculty staff.
University personnel estimated in January 1995 that bet~een 2 percent
and 3 percent of university personnel might take advantage of the new
policy. About 40 of Duke's more than 20,000 employees have signed up their
same-sex partners for university benefits to date.
Gay and lesbian graduate students thought they would be included in
short order.
--I don't think anybody expected it would take this long,"
said.
Harkins
After more than two years of quiet, behind-the-scenes negotiating,
graduate students stepped up their campaign last spring. Through letters
to the campus newspaper, petitions and a surprise May demonstration at a
groundbreaking ceremony for Duke's new recreation center, the students
made their cause public.
--It was not so much to embarrass the university as to focus the
attention of the administration on the fact. I think we felt the issue
fell off the table after the benefits were extended to faculty and
staff, " Lekus said. --We feel it is that attention that led the
administration to make its decision."
Getting access to the libraries, campus gyms and housing will be nice
for same-sex partners, Lekus said. But the real issue was health
insurance.

"It's very difficult to afford if you don't have access to a corporate
plan or your partner's plan, " he said. "Health insurance is really a
matter of life and death. ' ,
John Howard, the director of Duke's Center for Lesbian, Gay and
Bisexual Life, praised the decision.
"I'm delighted. And I'm proud of Nan Keohane, " Howard said. "She's
demonstrated leadership and courage on this issue. We couldn't be more
pleased.' ,
Graduate students, faculty, administrators, alumni and trustees who
pushed the issue forward deserve credit, Howard said.
"There's still a
little work to be done, " he said. "But there will certainly be some
celebrating. ' ,

Bill and Mike,
This is an update on our work regarding Title VI and Title IX in the
area of test use.
Please forward this information to Elena and Tanya
(I don't have their internet addresses.)
Background:
You will recall that we met on several occassions with the Leadership
Conference in the context of national testing issues. As part of our'
discussion, we committed to moving OCR's draft testing guidance to
final (following collaboration with DoJ, among others), and solicited
comments from the Leadership Conference regarding the draft.
Update:
We had targeted mid-December for a release of the guidance in final.
We are, however, still talking with DoJ regarding some outstanding
points related to the guidance (nothing that calls into question the
legal standards we're using). This target date will move to the
early
part of '98. As a result, we've asked a subgroup of the Leadership
Conference to meet soon regarding the guidance (substantively, as
well
as regarding the form of the release) .
Our very strong recommendation will be to maintain the final issuance
of the guidance in a form that is not regulatory.
For a host of
strategic reasons, we are hopeful that there will be concurrence on

this point among Leadership Conference members.
In addition to the guidance, itself, we are preparing a pamphlet of
questions and answers to assist educators and parents in this area,
as
well as a more comprehensive information strategy to accompany the
issuance of the guidance in final.

In the meantime, we'd appreciate any
ideas or suggestions you may have regarding our work in this area.

Thanks for the heads up, though I'm afraid we well aware of DOJ's wanting
to max out on about 70,000 cops. We're not off track for lOO,OOO yet, but
it does become increasingly difficult with Congress starting to earmark
unobligated funds, DOJ not wanting to cross their appropriators, OMB more
concerned with "lOO,OOO cops on paper" than "lOO,OOO cops in practice",
and minimum attention from the White House. My guess is that the White
House -- DPC, Intergovernmental, Leg. Affairs, OMB -- will have to ,step-in
before the next budget cycle and do a bit of our own problem solving.
It does trouble me, however, that the Acting Associate AG seems so willing
to concede the President's 100,000 goal ... though I wouldn't say it
surprises me ...

It looks less and less likely that we'll be 'ready for a welfare radio

By tomorrow, HHS will have case load data for only 43 of the 50 states
the APWA meeting in San Francisco is apparently slowing them down.

inconclusive (except for the Shireman/Kagan agreement to save $250 million
from Pell) After the meeting, Barbara Chow and Bob Shireman proposed that

How much cocaine has the Coast Guard seized?
A.
During FY97, the Coast Guard, in conjunction with other U.S. law enforcement agencies,
seized its highest-ever total of cocaine -- 103,617 pounds. Last year's assisted seizures
are triple the FY96 total of 28,585 pounds. Moreover, they are substantially higher than
their previous record set in FY91 of90,335 pounds. The increase in Coast Guard
seizures is largely the result of the success of Frontier Shield, which were kicked off last
year.
Q.
What is an assisted seizure?
A.
It is a seizure during which Coast Guard assets participated in the operation. Many of
our federal law enforcement agencies -- Customs, the Coast Guard, the Drug Enforcement
Agency (DEA) -- work together on drug seizure operations.
Q.
How do you know seizures are not up because the drug problem is growing?
A.
Because the other indicators of drug abuse are down. Overall drug use, what Americans
spend on drugs, indicators of crack and methamphetamine usage are all down. Youth
drug use seems to have stabilized. If the problem were growing these indicators would
also be up.
Q.
How do these numbers relate to overaU seizure data?
A.
Full 1997 Federal-Wide Drug Seizure System (FDSS) data is not yet available.
Assuming reported seizure levels remain unchanged during the FDSS "scrub," seizure
levels are on track to meet or best prior year levels. For example, the Coast Guard and
the Customs Services alone combined current data provides a total of 119.6 metric tons
of cocaine seized. In 1996, all the federal agencies combined, including DEA and the
Border Patrol, seized a total 115.3 metric tons of cocaine.

What can you tell us about reports that the DEA released the driver of a
tractor-trailer rig loaded with over a ton of cocaine this past weekend in Texas?

an additional $73 million over its original FY 99 budget request dedicated to
counter-drug efforts. [Although this is only a $25 million increase over last year's enacted
level, it represents a $73 million real increase due to non-recurring capital costs that
dropped out this year's budget.]

The funding will go toward a host of Defense's counter-drug efforts, including:
•
Enhancing source country interdiction efforts, primarily in Peru, by providing
ground-based and airborne radar detection capabilities, as well as training and
conducting riverine interdiction programs;
•
Implementing the commitments the United States made at the Barbados Summit
to assist the Caribbean nations with maritime interdiction efforts; and,
•
Working with Mexico to assist them in establishing their own interdiction
capabilities;

As provided by statute, the White House Office of National Drug Control Policy
(ONDCP) reviewed the budget proposal of the Department of Defense to determine if the
monies provided in the request adequately met the goals of the President's National Drug
Control Strategy. ONDCP determined that the request failed to achieve the President's
goals and began to work with the Department of Defense to rectifY this situation.
Secretary Cohen provided the leadership necessary to ensure that the Department of
Defense's budget would meet the President's goals and objectives.

As provided by statute, the White House Office of National Drug Control Policy
(ONDCP) reviewed the budget proposal ofthe Department of Defense to deterniine if the
monies provided in the request adequately met the goals of the President's National Drug
Control Strategy. ONDCP detennined that the request failed to achieve the President's
goals and began to work with the Department of Defense to rectify this situation.
Secretary Cohen provided the leadership necessary to ensure that the Department of
Defense's budget would meet the President's goals and objectives.
$195 Million Anti-Drug Youth Media Campaign

A.
The campaign is a nationwide paid media campaign to use the full force of the media --

from television to the Internet to Sports marketing -- to educate kids and parents about the
dangers of drugs.

What is the status ofthe campaign?
A.
Congress has appropriated the money for the media campaign and the President has
signed the appropriations bill into law. ONDCP submitted to the members of the
relevant committees a plan for implementing the campaign, as required under the
legislation, and Congress has approved the plan. Phase I of the campaign will begin next
month, with ads running in 12 pilot cities to evaluate the campaign. The 12 pilot cities
are: Atlanta, Baltimore, Boise, Denver, Hartford, Houston, Milwaukee, Portland
(OR), San Diego, Sioux City, Tucson, and Washington, D.C.
Once the evaluation phase is completed, the campaign will go nationwide. Every
American child willieam about the dangers of drugs when they tune in to prime-time
television, listen to the radio, and surf the Internet.
Q.
Will the ad campaign really have any effect on youth drug use?
A.
We believe it will. While television ads have been found to be among the most efficient
and effective means of reducing drug use, anti-drug public service messages and news
coverage of drug issues have dropped markedly since 1989. The media campaign will
involve the use of both paid and public service advertisements to get the message to kids
and their parents about the dangers of drugs.
The amount of funding for the media campaign is based on an estimate from the
Partnership for a Drug-Free America and ad agencies for the level of ad exposure
necessary to change attitudes and increase risk perception. Youth drug use has increased
because risk perceptions have diminished. In 1990, 86.3 percent of kids, ages 12 to 17,
said cocaine use was a high-risk behavior, and 40.4 percent said marijuana use was risky.
By 1994, high-risk perception rates fell to 81.4 percent for cocaine and to 32.6 percent
for marijuana. During the same time, 1992-1996, overall drug-use rates among youth
increased. By increasing risk perceptions, coupled with positive messages of
opportunity, the campaign will help steer kids away from drugs.
High-Intensity Drug Trafficking Areas

What was today's announcement regarding the creation of a Central Florida
HIDTA?
A.
Today, the Administration -- and Florida Members of Congress in a separate press
conference-- announced the formation of the Central Florida HIDTA. The Director will
soon fulfill the statutory requirements to officially designate the Central Florida HIDTA.
However, the President recently signed funding for this HlDTA-- $1 million in new
money-- into law and an Executive Committee has been formed to help.

Data provided by Central Florida authorities indicates that the 1-4 Corridor, from Tampa
to Orlando, is a critical juncture for drug trafficking. The data also shows that organized
drug trafficking has increased in the area with over 75 such groups operating in Tampa
alone. The 1-4 Corridor has the highest rate of heroin deaths per capita in Florida,
Orlando ranks fifth in the nation for cocaine related deaths. During 1996 alone, the
Orlando area experienced 30 heroin overdose deaths, many ofthem by young people.

The "RIDTA" program provides federal assistance to better coordinate and enhance
counter-drug law enforcement -- from the local to the federal level -- in those critical

How does a HIDT A get designated, or created?

RIDTA's are designated by the Director ofONDCP, in consultation with the Attorney
General, heads of the national drug program agencies, and the appropriate Governors.
The criteria for designating a RIDTA are:

importation or distribution;
the extent to which State and local law enforcement agencies have committed resources
to respond to the drug threat;

Shielding America's Frontiers (rom the Drug Threat
Record Coast Guard Interdictions: In FY 1997, the Coast Guard- the nation's lead agency
for maritime drug interdiction -- seized or assisted in the seizure of more cocaine than ever
before.
•
The Coast Guard, in conjunction with other U.S. law enforcement agencies, seized
103,617 pounds of cocaine -- more than triple the previous year's total. Moreover,
the Coast Guard increased their arrests of drug traffickers by a stunning 1000%.
Increased Department of Defense Funding for Drug Control: Despite reports that the
Department of Defense planned to cut funding for its drug control budget, the Department
is proposing to increase its FY 99 drug budget request by $73 million.
•
The Department will use increased funding to: enhance source country interdiction
efforts, primarily in Peru; carry out our international commitments to assist the
Caribbean nations with maritime interdiction efforts; and work with Mexico to
assist them in establishing their own interdiction capabilities.
Reducing Drug-Related Crime and Violence
Expanding High Intensity Drug Trafficking Areas (HIDTAs): Recent crime data show that
drug-related crime is in decline. To further build our efforts to combat drug-related crime
and counter drug trafficking, Drug Director Barry McCaffrey and members of Congress
announced the formation of the Central Florida High Intensity Drug Trafficking Area.
•
The HIDT A program provides federal assistance to better coordinate and enhance
counter-drug law enforcement, from the local to the federal level, in critical areas
where drug production, manufacturing, importation, or distribution flourish. This
newest HIDTA will bring the total number of designated areas to 23- 18 of which
have been created under the Clinton Administration.
Educating Our Youth to Reject Drugs
The $195 Million National Anti-Drug Youth Media Campaign: The number one priority in
the President's 1997 National Drug Control Strategy is to motivate our kids to reject the
use of illegal drugs. Recently, the President signed into law funding to launch the

Here's a quick update on some of our issues, sorry it runs a little long.
I think we will have some good things happen.
DOJ debt collection bill: we got an informal estimate of saving $270
million from DOJ, David Huan at OMB is looking to see if they can confirm
that kind of saving. He says obviously now would be good time to move it
if we can. There will be legal/political vetting issues even if we get a
good est~mate for the bill-- the law moves the presumptions on debt
collection in the government's favor.
Pagers for battered woman: DOJ says the cell phone industry is agreeable,
they've offered phones for each shelter (1,400) so women could leave the
facility and still have access to the police. We need ot look for other
places that make sense to have phones. DOJ is meeting with courts people
to see about making phones available to women getting restraining
orders.
We're hoping to have this for the SOTU.
Religious Freedom in the Workplace-- we've had several meetings with DOJ,
DOL, SBA, EEOC, Commerce, OPL, and counsel (Bill Marshall). The group
felt the original bill was teribly drafted and unworkable. A working
group led by DOJ has finished their version of the bill.
That bill is
now waiting for sign off by David Ogden etc. We'll then need to do more
vetting. Each agency has already been talking to the groups to see where
they stood on the Coats/Kerry bill, but we will need to do this in a
thorough way and we'll get back to you with a plan this week when we hope
to get the draft bill.
Lifetime supervision for child sex offenders:
In June, DOJ said they
would have a study done in six months.
Rahm likes this issue and he
brought the issue up today at the crime meeting, DOJ is looking for
hooks. Nick Guess said the idea would be to condition prison funds,
think this will be hard to find a manageable option but we will find
something more narrow than a wholesale plan.

Single Food Agency-- We've talked to OMB and I'm sending Elena their
memo. The proposal will experience bureaucratic attacks-- the agencies
haven't been told about the project according to Wendy Taylor at OMB. It
seems like a good substantive idea, it will be a politically good one only
if we don't cut the budget. Wendy says OMB doesn't think this involves a
savings, in fact there are slightly higher admin. costs.

what to do. He agrees that it fits nicely with many of the President's

Sexual orientation exec order: Dawn Chirwa is looking at this in relation
to the military (DOD had no problems) otherwise it is ready to go.

I talked to Carl Whillock. Here are his answers:
1. Crop revenue coverage: Currently, crop revenue coverage is only
available for very limited types of crops such corn, wheat, etc. USDA is
currently discussing internally expanding this to all types of
revenue-producing crops, including cattle, tomatoes, etc. The discussions
at USDA have focused on this expansion being implemented primarily through
private insurance coverage. One scenario would have the farmer
responsible for the first 10% of loss, the private insurance company
covering the next 65%, and perhaps the Federal government subsidizing the
last 25% of the farmer's loss.
Carl believes that this crop insurance would not be very expensive to the
individual farmer as long as the risk pool was very large and spread over
different types of farmers.
Carl thought that this type of private
insurance arrangement with partial government subsidies might even.be less
expensive than the current price support and loan programs, because of the
private insurers' substantial participation. Carl also didn't think that
this type of scenario would require legislation, but might require an ap
propriation for the subsidy portion.
Even though USDA is doing research on this, they do not have a deadline or
even a time frame to try to implement this. This seems like a good idea
to pursue. Should we follow up with ~his by setting up some meetings with
USDA and OMB, etc?
2. Export Enhancement: Carl agrees with Bruce that this program is being
used as extensively as possible already.
Under this program, the
Secretary of Agriculture has substantial discretion to subsidize the
advertising and sales of exports of U.S. food.
This subsidy primarily
goes to food processing companies, and critics argue that we are simply
supporting companies such as Tysons, etc. However, these programs
indirectly benefit farmers because their products are exported in greater
quantities. Also, U.S. food is able to be exported at a lower cost
because U.S. food processing companies spend less on advertising and
marketing because of the federal subsidy.
Further, the Secretary can
direct the subsidies toward whatever crop needs the assistance in a
particular year.
For instance, this year greater portions of federal
funds have been directed toward ,the dairy industry.
We can look into expanding the program if 'you want,

I talked with Kent Conrad this weekend. He pointed out that farmers in his
state are suffering from serious crop losses due to disease.
(Nothing
brand new or exotic but much more widespread --perhaps up to 30% some
crops.) When ND had $1 B + in flood damages, FEMA came and and were
"terrific" but when people suffer equally devastating ($1B) crop damages,
there is no similar response available. I asked about crop insurance.
There is "crop revenue coverage" but he felt it could/should be
strengthened / expanded .Since the "Freedom to Farm" bill does open
farmers more to market forces, is there an argument for increasing or
expanding insurance?
His second recommendation is for "ag'g'ressive export enhancement" --my
own sense is that we are pretty aggressive at this and it would be hard to
demonstrate more but what do I know ...

Bruce -- just a quick FYI -- I just spoke with Deputy Associate Attorney
General John Dwyer, who oversees the COPS program; he asked me to pass on
a message from the A.G. to Ron and the VP (since we are doing an
announcement of some new cops this week) that we may never reach 100,000
cops. He says interest in the cops at the local level has been waning
steadily, and Congress hasn't been that coperative in finding ways to make
them more attractive. Therefore, according to Dwyer, we may simply max
out at about 70,000 and declare victory.
Ron and I thought you should be aware of this, since you may not agree
with this approach ...

Shielding America's Frontiers from the Drug Threat
Record Coast Guard Interdictions: In FY 1997, the Coast Guard-- the nation's lead agency
for maritime drug interdiction - seized or. assisted in the seizure of the highest amount of
cocaine in its history.

The Coast Guard, in conjunction with other U.S. law enforcement agencies, seized
103,617 pounds of cocaine -- more than triple the previous year's total. Moreover,
the Coast Guard increased their arrests of drug traffickers by a stunning 1000%.
Increased Department of Defense Funding for Drug Control: Despite reports that the
Department of Defense planned to cut funding for its drug control budget, the Department
is proposing to increase its FY 99 drug budget request by $73 million.
•
The Department will use increased funding to: enhance source country interdiction
efforts, primarily in Peru; carry out our international commitments to assist the
Caribbean nations with maritime interdiction efforts; and work with Mexico to
assist them in establishing their own interdiction capabilities.
Reducing Drug-Related Crime and Violence
Expanding High Intensity Drug Trafficking Areas (HIDTAs): Recent crime data show that
drug-related crime is in decline. To further build our efforts to combat drug-related crime
and counter drug trafficking, Drug Director Barry McCaffrey and members of Congress
announced the formation of the Central Florida High Intensity Drug Trafficking Area.
•
The HIDT A program provides federal assistance to better coordinate and enhance
counter-drug law enforcement, from the local to the federal level, in critical areas
where drug production, manufacturing, importation, or distribution flourish. This
newest HIDT A will bring the total number of designated areas to 23-- 18 of which
have been created under the Clinton Administration.
Educating Our Youth to Reject Drugs
The $195 Million National Anti-Drug Youth Media Campaign: The number one priority in
the President's 1997 National Drug Control Strategy is to motivate our kids to reject the
use of illegal drugs. Recently, the President signed into law funding to launch the
campaign.
•
The $195 million National Anti-Drug Youth Media Campaign will use the full force
of the media --from prime time television to the Internet to sports marketing --to
educate kids and parents about the dangers of drugs. The campaign will begin
next month with ads in 12 pilot cities across the nation and eventually move
nationwide.

It turns out that Ken Apfel has decided to change the content of the
children's SSI report -- he wants to review ALL the children that have
been denied, not just the groups. targeted earlier (mental retardation,
low-performing states). We can talk about this if you like.
It will be
somewhat harder to argue in the media that SSA did a good job if we are
re-reviewing everything. Also, the Republicans will not like it, although
our response is that we are not changing the standard, which they view as
the most important thing.
OMB is wondering if this is necessary, and so
we are meeting with SSA tomorrow on it.
I am not inclined to'second guess
this decision -- it's their report, this decision is widely known within
SSA, and I certainly wouldn't want to be in the position of arguing from
here for fewer reviews.
So I'll have to rewrite the memo.
The report won't be released until late
next week or even the week of Christmas.

Options for INS Reform
We have done a very brief summary of the major INS reform proposals and provided an
outline of the broad options which integrates aspects of the different proposals (as well as other
informal suggestions that were made during our meetings) as a thinkpiece for you.
PROPOSAL SUMMARIES
Commission on Immigration Reform. The Commission on Immigration Reform (CIR)
proposes significant structural reform to immigration operations. In its final report, the eIR
proposed to eliminate the INS and restructure the immigration system into four fuain operations:
•
Immigration Enforcement: All immigration enforcement (e.g., Border Patrol, inspectors,
investigators) at both the border and the interior would be moved into a newly created
Bureau of Immigration Enforcement and the Department of Justice.
•
Immigration Services: The Department of State would assume responsibility for
adjudication of all immigration-related applications, including immigrant, limited
duration admissions (e.g., tourist, student visas), asylum/refugees and naturalizations.
All immigration functions would fall under the jurisdiction of a new Undersecretary for
Citizenship, Immigration and Refugee Admissions.
•
Worksite Enforcement: All responsibility for enforcement of immigration-related
standards for employers would be housed at the Department of Labor. This would
include enforcing employer sanctions against employers who fail to verify 1-9 forms for
work authorization and monitoring compliance with employer attestations to sponsor
skill-based immigrants.
•
Immigration Review: An independent body within the Executive Branch would be
created to hear appeals of immigration-related administrative decisions, including
removal (e.g., deportation) hearings. Decisions by the appellate body would be binding
over the Executive Branch. Only the federal courts and Congress would have the
authority to reverse.

Reyes Bill
•
The Reyes proposed legislation, "The Border Security Enforcement Act of 1997," would
make a significant structural change to INS by putting its entire enforcement component
into a newlyccreated agency within the Department of Justice. The Director of the new
Office of Enforcement and Border Affairs would report directly to the Attorney General.
All enforcement, including Border Patrol, detention, deportations, inspections,
intelligence, and investigations, would be moved to the new agency. INS would
continue all remaining non-enforcement functions.
INS' Reorganization Proposal. The INS proposal would reorganize their existing structure
and contains various management reforms.
•
Separation of Enforcement and Services: The INS plan ~s focused on reengineering their
delivery of services and moving toward a customer-service orientation. To this end, the
INS plan would create a clearer delineation between enforcement and service functions
by physically separating the functions at the district office level. Services staff and
enforcement staff would trained separately. This would also mean that individuals
seeking services from INS would never come into physical contact with enforcement
officers when entering district offices.
•
Infrastructure Improvements: The INS plan focuses on making significant enhancements
to technology, including the centralization and automation of INS records, in order to
improve both delivery of services and law enforcement needs.
•
Management Reforms: The INS plan would overhaul career development systems, and
address longstanding pay issues to improve standards of professionalism within the
Service.
OMB Proposal. The OMB proposal, similar to the INS proposal, retains current INS functions
within the Service.
•
Separation of Enforcement and Services: The OMB proposal would reorganize INS and
create two Executive Associate Commissioners (EACs):one for enforcement and one for
services and benefits. The EACs would report directly to the Deputy Commissioner.
The Enforcement EAC would be responsible for all of INS' enforcement agents -- which
OMB recommends merging into one uniform service and a white collar investigate
service (CIR proposal). The EAC for Services would be responsible for regional service
centers, foreign operations for refugees/asylees and all existing district office operations.
•
INS Headquarters Reorganization: Headquarters would be focused on policy, strategic
planning and management, budget, and compliance with policy and procedures.

OPTIONS OUTLINE
As the outline below reveals, there are many ways that the various proposals could be combined .
. We have used three very broad categories as a guide to thinking about the issues: reforms within
INS; reforms that involve changes within· the Department of Justice structure; and reforms that
impact other agencies.
I.
Reform that would keep all functions within INS.
A.
Separate enforcement from services -- from field up to Headquarters.

Create two Deputy Commissioners, with two separate lines of authority
and chains of command: one with responsibility for enforcement and the
other for services.

Could organize the enforcement side more like a police
department: start as a border patrol agent (beat cop), move up to an
investigator (detective) and further potential to move up in the
chain of command to Headquarters.

Would address the concern that the border patrol agents are
too isolated from the rest of enforcement, which creates the
perception of lack of accountability.
Could create a more substantial career path for agents,
in lower turnover and greater professionalism.

district offices, providing for greater accountability that many say
is lacking under the current system.
c.
Would allow for the creation of a more regional model for location
of all enforcement resources (i.e., Southwest Border emphasis) and
a more community-based model for services.

for enforcement. Resulting stovepipe structure for ali enforcement and
service functions could be same as above but would merge at the Deputy
Commissioner's office.
Separate enforcement from services at district office level only.

functions integrated at the regional office level and above.

This option is favored by INS.
In addition, under either model, could better integrate the Border Patrol in the chain of command
within enforcement, to address the issue of increasing alienation of the Border Patrol from the
rest of INS. Also, could move law enforcement within INS up to the level (training, pay, etc.) of
other law enforcement agencies with the DOJ. In addition, under either model could re-cast
.inspections as an enforcement function.

Reform that would keep all functions within the DOJ, but move some out of INS.

Move enforcement from INS to Main Justice

create another law enforcement sub-agency. Other Justice law
enforcement agencies (e.g., FBI, DEA) may also resist.
Create a high-level person at the Department of Justice to handle immigration
(e.g., an Assistant Attorney General for Immigration).

who would head an office in charge of virtually all immigration services-visas, adjustment of status, naturalization, labor certification, etc.

instead of just checking Interpol and possible foreign policy

State for the limited purpose of international checks.
Labor Department
1.
Empower Labor to sanction employers for 1-9 violations, rather than
simply referring to INS, where there is little follow through.

labor violations.
Concern that fear of deportation could chill the reporting of poor
labor standards, which adversely affects all workers.
Move labor certification out of the Labor Department to INS (or State, if
they are handling naturalization and visas).

certification, which then forces employers to hire workers with

Kennedy just called for the federal government helping to hire half the
techers that will need to be hired in the next decade--100,000 teachers
per year, by providing loan forgiveness for those who agree to teach for 5
years. I didn't hear him mention the cost, but he said it should be paid
for with "the same tax changes the R's propose to use for vouchers".
He also called for a new G.I. Bill of "rights that would guarantee every
academically qualified student with $3,000 per year--balanced between Pell
grants and HOPE tax credits--for 4 years.
He estimated the cost at $10 Billion per year, and proposed to pay for it

FYI, I just spoke with Danica who called to let me know that Kennedy
is doing a speech at the press club tomorrow on a wide range of
topics, but there will two education platforms in it:
(1) On higher education, he is going to advocate adding to what we
have done on Pell, HOPE and Lifelong Learning to, in effect, insure
that all students (presumably up to an income limit, but Danica did
not know what it would be) should receive government support
totalling
$3,000 to pursue their postsecondary educations.
(2) On teachers, he is going to advocate using loan forgiveness to
add
100,000 teachers around the nation -- this is designed to mirror what
happened with cops on the street. They do NOT see this as an
alternative to our Title V in any way.

Southwest Border Drug Initiative
Background:
For several months, General McCaffrey has been arguing for a comprehensive effort to
stem the flow of drugs coming across the Southwest Border. Based on his site visits to
many of the 39 points of entry (POEs) along the Southwest Border, McCaffrey has argued
for improved management and increased resources to support the "rule of law" along the
border. In brief, McCaffrey's recommendations include: (1) improved accountability by
establishing a "Border Czar" and appointing an "in-charge" federal official at each POE;
(2) improving infrastructure along the Southwest Border; (3) expanding cooperation with
Mexico; and (4) improving law enforcement and intelligence coordination. After
outlining these recommendations to the Chief of Staff this week, General McCaffery
announced to the press that the Administration would be releasing a 5-year Southwest
Border strategy as part of the State ofthe Union.
Q:
Mr. President, this past week General McCaffrey announced that you would be
announcing a new strategy for the Southwest Border in your State of the Union
Address. Is this true and, if so, can you tell us a little bit about this proposed
strategy?
A:
This summer, General McCaffrey and other officials spent a considerable amount oftime
on a fact-finding tour of the Southwest Border. He has since briefed me and key
Members of Congress on his findings. In short, he points out that our Southwest Border
is one of the largest and most active borders in the world, and that its getting even busier.
Tens of millions of cars and trucks cross every year, as so do hundreds of millions of
people -- and billions of dollars in two-way trade. And this increased traffic makes our
drug control efforts more important than ever.
This Administration has already dramatically increased the federal presence at the border.
We have doubled the number of Border Patrol agents from 3,000 to 6,000 and added
other law enforcement resources. But even more needs to be done..
General McCaffrey has already initiated an exhaustive review of our intelligence
architecture. Working with the Departments of Justice and the Treasury, he is looking
for ways to improve and better coordinate our intelligence efforts. But we need to look
at other ways to support the rule of the law at the border -- increased accountability,
better law enforcement coordination and improved technological capabilities. These are
all issues we are considering in the budget process and in the development of our
National Drug Control Strategy, and I expect we will come forward with
recommendations and improvements throughout the year.

meeting next Wednesday with Dr. Hitt. Mind you, I am still working on

Next week, you will be meeting with me and Dr. Scott Hitt, Chairman of the
PresidentD,s Advisory Council on HIV/AIDS.
Dr. Hitt is a prominent
physician from Los Angeles with significant experience in the clinical
management of HIV and AIDS, as well as local, state and national politics.
This past Sunday, the Council released its Progress Report on the
Administration's response to the epidemic (copy attached). While
significant accomplishments with respect to funding and policy issues are
recognized, the report is quite critical of the President and the
Secretary of HHS. The Council's principal concerns are:
a perceived de-prioritization of AIDS;
inaction on needle exchange; and
mixed signals on Medicaid expansion.
Some background on these issues and our current policy positions:
Prioritization of AIDS
This concern relates primarily to the funding of discretionary AIDS
programs.
It became a particularly hot issue when the balanced budget
agreement was completed and no AIDS programs were listed under the
"protected" classification. Advocates interpreted this as a
de-prioritization of AIDS, which had in previous years enjoyed
classification as a budget priority.
This perception was exacerbated by requests in the President's FY98 budget
(see attached table) that the community considered inadequate,
particularly for the AIDS Drug Assistance Program for which the
Administration sought no increase. Substantial increases were ultimately
obtained, with Administration support, but the Republican appropriators
championed these increases.
(In reality, for each year since the
Republicans took over Congress, they have increased AIDS funding over the
President's request.)

As has been the case in previous years, HHS has asked for only minimal
increases in its AIDS programs for FY99.
In its first passback, OMB
sought only level funding.
While this is a time-honored exercise, several
community members have gotten wind of the passback numbers and are quite
upset that the Administration isn't pushing for adequate ~ncreases.
Josh Gotbaum and I have been working on a Presidential Initiative that
would offer an additional $115 million for the AIDS Drug Assistance
Program, other parts of the Ryan White CARE Act, and the COCO,s HIV
prevention programs (representing a 6% increase overall)
Needle Exchange
This issue has become central to the AIDS community and, rightly or
wrongly, it has become symbolic of the Administration's leadership on
AIDS. Given that as many as 50% of new HIV infections are directly or
indirectly related to injection drug use, those on the front lines-are
increasingly interested in having the flexibility to employ all strategies
they deem appropriate.
congress, with strong support from the Administration, maintained the
current authority of the Secretary of HHS to remove the restriction on the
use of Federal funding for needle exchange programs.
[Footnote: To act,
the Secretary must determine that needle exchange programs (a) decrease
HIV infection among participants and (b) do not increase the use of
illegal drugs.
Her report to Congress this past spring was determinative
on the first test and less clear on the second.]
As a compromise,
however, Congress imposed a six month moratorium on the exercise of this
authority.
Many in the community believe that this left the door open for
the Secretary to make her determination prior to the expiration of the
moratorium and prepare to allow states, at their discretion, to use
Federal funds a's -soon as the moratorium expires.
The PresidentD, s
Advisory Council is -recommending in a letter to the President (copy
attached) that he instruct the Secretary to act prior to the return of
congress on January 27, 1998.
Medicaid Expansion
This past April, the Vice President announced a request that HCFA study
the possibility of a demonstration program that would expand Medicaid
coverage to people with HIV. This was in response to recently released
guidelines from the NIH that recommend treatment earlier in the course of
illness. Unfortunatel¥" we are in a "catch 22." Currently, many
impoverished people have no access to treatment until they progress to
full-blown AIDS, at which point they qualify for Medicaid--which pays for
the treatment that may have forestalled the onset of AIDS.
(Some have
likened this to searching for the seat belt after the car has crashed.)
The AIDS Drug AIDS Drug Assistance Program (part of ~he Ryan White CARE
Act) helps, but because this is a limited discretionary program, there are
many states that have cut off new applications, limited their covered
formularies, or simply capped available benefits far below the annual cost
of these treatments (+/- $15K/yr).
HCFA has completed its preliminary analysis, and has determined that
expanding Medicaid would not be budget neutral.
Last week, a spokesman
for HHS told the press that the Medicaid expansion initiative was not
feasible without making clear that we were still committed to working on a
solution (my statement is attached).
This press leak was very untimely,
appearing in the Washington Post the first day of the CouncilD,s meeting
here in Washington.
Subsequent press coverage was quite intense, and was
then fueled by the release of the CouncilD,s report.
While I believe that

we were able to sustain a tenable position with the public, it does place
considerable pressure on us to maintain discussions on a long-term
solution to the health care needs of people with HIV/AIDS and on a
short-term response in the FY99 budget.
This is a very important issue to the AIDS advocacy community. They are
perhaps appropriately concerned that continued reliance on discretionary
programs like Ryan White for primary health care and treatments is a short
term solution that leaves them vulnerable! and they are seeking more long
term, systematic entitlement reform. While we will need to respond in
FY99 with additional funds for care and treatment, that will not address
their long term goal of modernizing Medicaid/Medicare coverage.
The CouncilO,s report expressed concern over "mixed signals" from the
Administration. They had drafted language far harsher but we are able to
calm them down by arranging for a call from the HCFA Administrator, who
clarified that the press article was not accurate and that HCFA would
continue to work with the community to find a solution.
Likely Requests from Dr. Hitt
I believe that Dr. Hitt will ask for several things from you:
a commitment to get the President to the next Council meeting in March;
a commitment to pass the CouncilO,s report to the President; and
a commitment to respond to their recommendations, particularly those
relating to needle exchange and Medicaid expansion.
My recommendation is that you respond as follows:

US to unveil five-year plan to end drug trade along Mexican border
MIAMI, Florida, Dec 11 (AFP) - The US government will unveil a detailed
plan next month to drastically curb drug-trafficking along its border
with Mexico within the next five years, officials said Thursday.
The initiative will be officially announced on January 27, during
President Bill Clinton's State of the Union speech to Congress.
Still, White House officials were willing to share a few early details
about the plan.
"We're going to try and stop drug smuggling into the United States
across the Mexican-US border in the next five years, substantially stop
it, while still allowing our second biggest trading partner to continue
economic cooperation," said US drug "czar", retired general Barry
McCaffrey.
Each year, millions of people cross the US border with Mexico, which
stretches some 3,000 kilometers (l,860 miles.)
But the US southern border also has become one of the country's main
points of entry for illegal drugs, McCaffrey said, pointing out that it
is "the biggest open border in the world."
"There's nothing like it anywhere on the face of the Earth," McCaffrey
observed.
McCaffrey said details about the anti-drug program would be made public
next month, but said one idea under consideration is to employ new
X-ray technology that,can peer into the interior of metal, and even
concrete receptacles, which might conceal illicit drugs.
"We said, 'let's use them on trucks, let's use them on rail cars.' They
work. They absolutely work," McCaffrey said.

THE HISTORIC KYOTO AGREEMENT:

The Kyoto agreement represents an historic and unprecedented step to reduce the
threat of global warming in an environmentally strong and economically sound
way. It involves 160 nations, and recognizes the crucial importance of specific
steps to address climate change. The leadership offered by the President and
Vice President allowed this agreement to be completed -- and generations from
now, the agreement will be remembered as establishing the core elements of a
strong, realistic, and legally binding framework.
•
Target and Timetable: The United States agreed to a binding target of reducing
greenhouse gas emissions to 7 percent below a baseline based on 1990 levels by
2008-2012. The agreement, however, included a new accounting system -- so that the 7
percent reduction is roughly equivalent to the President's initial proposal.
•
Market-Based: The agreement reflects an historic emphasis on market-based
mechanisms to address an environmental problem. In addition to the Clean
Development Mechanism, the agreement includes a framework for emissions trading
among industrialized countries -- producing the most efficient means of reducing
emISSIOns.
•
Coverage of Agreement: The agreement covers six greenhouse gases, which had been a
priority of the United States but had not been included in the proposals from other major
economies. The inclusion of all six gases represents a major U.S. victory in the
agreement and ensures that the environment will be protected against all greenhouse
gases.
•
Joint Implementation: The agreement includes a Clean Development Mechanism, that
will allow the types of joint implementation projects that will benefit U.S. businesses.
The mechanism gives U.S. companies credit for improving energy efficiency in
developing countries.
•
Developing Country Participation: Global warming is a global problem requiring a
global solution. We have therefore adopted a two-step process to this problem. This
agreement locks in hard commitments by the developed countries, as well as some
commitments by the developing countries (such as on the Clean Development
Mechanism). But the President has made very clear that the United States would not
take on legally binding targets until there is meaningful participation by developing
countries. We will be working hard over the coming months and years to secure that

Enforcing Civil Rights
In developing the Civil Rights Enforcement Initiative , it is important
that we also consider an explicit commitment to enforcing the equal pay
laws --something we know that working women are very concerned with. The
question of fair pay --or,more accurately, discrimination in pay
comes up in every report of womens concerns ,a nd beacuse the bottom line
is family income, is also popular with working men. "Pay equity" is high
on the list in discussion of a common Democratic agenda, with several
bills already introduced by Democratic leaders.
While no one thinks these bills will get very far, being able to show
that we take the concept of fair pay seriously will be very helpful. Some
of the ideas suggested include 'a hot line to report pay discrimination,
and a "Swat Team" to enforce it . I can't see any conflict at all with
the proposals you have suggested

Q. What actions has the Administration done with regard to irradiation of food and why?
A.
Earlier this month the FDA approved irradiation of meat products for controlling
disease-causing micro-organisms. The approval applies to fresh and frozen red meats such as
beef. The USDA will soon publish a proposed implementing rule for companies that want to use
irradiation including requirements for appropriate labeling.
FDA's approval was based on a scientific review of a substantial number of studies
conducted worldwide on the effects of irradiation on a wide variety of meat products. FDA
concluded that irradiation is safe in reducing disease-causing microbes in or on meats, and that it
does not compromise the nutritional quality of treated products. During the irradiation process,
food products are treated by subjecting them to radiation from radioactive or machine sources,
which kills significant numbers of insects, pathogenic bacteria and parasites. FDA's decision
does not require irradiation but simply permits it. The extent to which meat will be irradiated
depends on decisions made by the industry and consumers.
Irradiation has previously been approved for products such as wheat, poultry, pork, fruits
and vegetables and spices. This approval was in response to a petition filed in August 1994 by a
company named Isomedix.

Questions and Answers on the Tobacco

Q:
Do you see any signs that Congress will pass your comprehensive tobacco legislation?
A:
Yes. There are promising signs that Congress will come together in a bipartisan fashion
and pass tobacco legislation in the upcoming year. Shortly after I announced my plan for
the reduction of youth smoking we had a meeting with the leaders of both the House and
the Senate on this issue -- Republicans and Democrats -- and the response was very
positive. Protecting our children is a goal we can all agree on. Several Senators have
introduced legislation, and there is a consensus that we have a unique opportunity if we
act right now to control teen smoking.
The Vice-President has been working hard building up support for the plan, he has held 3
very successful public forums around the country. He is conducting a fourth forum next
week, December 16th, in Seattle.
Of course, this is a complicated issue. It needs to be studied carefully. But we have
great hopes that the Administration and Congress can work together to enact bipartisan
legislation in the near future.
Q:
Can you clarify the Administration's position on the money states have received from
tobacco settlements. Are the states required to share that money with the federal .
government?
A:
The states, particularly the state attorneys general, deserve enormous credit for their role
in the fight against the tobacco companies. Along with some important work by the
FDA and this Administration, they have made alot of progress. But current law is very
clear on this subject, states are required to report to the Health Care Financing
Administration reimbursements for Medicaid that may be part of any state tobacco
settlements. I look forward to working with states and Congress to address this and other
issues through tobacco ·legislation. That legislation will involve a range of allocation
questions we will resolve together. But to change the current requirement Congress must
enact comprehensive tobacco legislation.
Q:
As the tobacco legislation moves through Congress, what are the elements you will not
compromise on?
A:
When I announced my plan in September, I made clear that this was not about money, it

was about children, and keeping teenagers from smoking. I will not compromise on that.
To get the level of smoking reduced, I proposed a plan with five key elements:
•
A comprehensive plan to reduce teen smoking, including tough penalties if targets are not
met, a public education and counter advertising campaign, and expanded efforts to restrict
the access of youth to tobacco products;
•
Full authority for the FDA to regulate tobacco products;
•
Changes in the way industry does business, including broad document disclosure;
•
Progress toward other public health goals, including reduction of second-hand smoke,
expansion of smoking cessation programs, strengthening of international efforts, and
funding for health research and other health objectives; and
•
Protection for tobacco farmers and their communities.
I think we need these elements to have an effective plan.
Q:
What will happen if we fail to seize this opportunity?
A:
If current trends continue and nothing is done to curtail tobacco use in America, we can
expect an additional 25 million painful and premature deaths among currently living
Americans, including five million of our children. On average, smokers who die from
smoking-related diseases will lose an average 12 years oflife, resulting in medical
expenditures of $50 billion per year.

Why has tobacco become such an important issue to this Administration?
A:
We've been working on this for two years now. Each day 3000 young people become
regular smokers, replacing many of the adult smokers who have quit or died. As the
20th century comes to a close, we need to "right our past wrongs" and bring to a close a
century of neglect in dealing with the greatest preventable cause of death in our society.
We need to protect our children from being seduced, and then addicted, and finally
afflicted. We need to enter the 21st century with policies and programs in place which
treat tobacco commensurate with the harm that it causes.

Neighborhood Reinvestment Corporation
Background:
Neighborhood Reinvestment Corporation (NRC) is a Federally funded, non-profit corporation
which provides technical and financial assistance to community-based affiliates which use
homeownership creation as a neighborhood renewal and stabilization strategy. These 177 community
organizations -- NeighborWorks Organizations (NWOs) -- serve large, inner-city communities,
mid-sized cities, and rural communities with programs tailored to serving the revitalization needs of
each individual low-income neighborhood. The NWOs .extend credit and counseling to lower-income
and often minority individuals if they buy or rehabilitate a home in the network's designated area.
In FY96, NRC's budget was $38.7 million. This was increased to $50 million in FY97 and
$60 million in FY98. OMB has recommended a $30 million increase in NRC's FY99 budget.
Support for Increase:
Additional funds in NRC allow us to put in a place a "Play-By-The-Rules" proposal. (We are
still developing it, but see next bullet for some background.) DPC, OMB, HUD, and the NRC
are all very supportive of this proposal.
•
While we are still working on the proposal, here are some basic guidelines. Currently, there
are about 7 million households that 'pay more than 50 percent of their monthly income on rent.
Families that desire homeownership are often trapped in situations where they pay so much for
rental housing that little is left to save for downpayments. These families often pay their rent,
utilities, car payments, and other bills on time, but do not have the savings necessary to become
a homeowner. The goal of this program will be simple. If you "play-by-the-rules," we are
going to help them with their downpayment (up to about $2,000), closing costs (also up to
about $2,000), with an interest-rate buydown, or a rehabilitation loan.
•
An increase in NRC's budget can be seen as a part of the Race Initiative. As you can see from
the numbers, this program -- while not race-based -- disproportionately helps minorities. Over
60% of NRC's new homeowners are minorities (38% are African Americans, 20% are
Hispanics, and 3% are others). These numbers are particularly impressive. For example, only
about 5 percent of all mortgages and about 15 percent of government-backed loans are given to
African Americans, yet 38 percent of NRC's go to African Americans. This could also be part
of the Hispanic Initiative: 6 percent of all mortgages and 12 percent of government-backed
loans go to Hispanics, but 20 percent of NRC's new homeowners are Hispanics.

NRC's total 1996 investment in distressed neighborhoods was $419 million, leveraging 10.8
times the $38.7 million in Federal appropriations for NRC in that year. A $90 million
appropriation would enable 24,000 families to secure or retain homeownership and would yield
over $1 billion in collective lending and other direct investments by NeighborWorks
organizations and financial institutions.
•
NRC has an excellent track record. NRC has a higher risk portfolio than FHA: (1)
loan-to-volume ratios range all the way up to 120 percent, while they are up to 102 percent
under FHA; and (2) average borrower incomes are lower than FHA. But, NRC posts lower
default rates -- 3-4 percent compared to 6-8 percent for FHA.

Mortgage Banking reported on the NeighborWorks program in their September 1997 edition.
They titled their story: "NeighborWorks is Working." They wrote that: "NeighborWorks
organizations and their lender-partners are producing success rates that have lenders grinning
broadly with enthusiasm."

Spending per student in U.S. schools leveled
off in the 1990s, but the share of school budgets going to special
education programs grew, a private report said today.
"People say that we've been throwing money at schools and not
getting results, " said Lawrence Mishel, research director for the
nonpartisan Economic Policy Institute, which released the study.
"Well, we certainly haven't been throwing money at schools in the
1990s.' ,
While total school budgets have grown because of an 8.4 percent
increase in enrollment from 1991 to 1996, inflation adjusted
statistics from the Education Department show that the money spent

on each student has grown just 0.7 percent during those five years,
according to EPI.
That's a significant slowdown from 1.7 percent average annual
growth during the previous 30 years, the institute said.
In 1996, inflation adjusted spending on each student in public
elementary and secondary schools was $6,576, up just $47 from
$6,529 in 1991.
How schools spend their money is changing, however.
Looking at nine representative school districts across the
country, EPI researchers found that the portion of their budgets
going to special education was up to 19 percent in 1996, from 17.8
percent in 1991.
Special education costs included instructors, materiaTs and the
administration of programs to help learning-disabled children and
those with handicaps, as well as structural modifications and
transportation to make schools handicap accessible.
Bilingual education programs also are taking a greater share of
school budgets, accounting for 2.5 percent in 1996, up from 1.9
percent in 1991.
And school lunch and breakfast programs accounted for 4.8
percent of total school spending in 1996, up from 3.3 percent in
1991.
The percentage of school budgets spent on regular education,
meanwhile, was down in 1996 to 56.8 percent from 58.5 percent in
1991.
In three of the nine school districts examined
Anne Arundel
county, Md., East Baton Rouge, La., and Middletown, N.Y.
inflation adjusted dollars spent per student on regular education
actually dropped from 1991 to 1996, while special-ed spending per
pupil went up.
In Los Angeles, regular and special education spending per
student both dropped while spending per pupil on bilingual
education rose.
Per-student spending on regular education was up in Bettendorf,
Iowa, Boulder, ,Colo., Claiborne County, Tenn., Fall River, Mass.,
and Spring Branch, Texas.
One reason for spending shifts may'be the increase in federal
rules requiring schools to accommodate special-needs students,
Mishel said.
"There are kids who are autistic or with other problems that in
earlier times may not have been in the school system,"
Mishel
said. "There's legal obligations to provide special education, but
there's no legal obligation to improve regular education:"
But Mishel said researchers did not ask school districts where
special-ed money would have gone otherwise.
" I think we can't draw strong conclusions that if the money
hadn't gone to special education it would have gone to regular
education, " he said.
The EPI study also found that on average for the nine school
districts examined, per-student spending on after-school athletics
has dropped 7 percent in the '90s, spending on security and
violence prevention dropped 15.2 percent and spending per pupil on
desegregation was down 32.9 percent.
On average,' per-student spending on health and psychological
services was up 87.3 percent, and for vocational education, up 52.7
percent.

<p>Elena Kagan worked as Associate White House Counsel from 1995-1996 and Deputy Assistant to the President for Domestic Policy and Deputy Director of the Domestic Policy Council (DPC) from 1997-1999.</p>
<p>During her work at the White House Justice Kagan worked on many topics including, but not limited to: AIDS, budget appropriations, campaign finance reform, education, health, labor, race, tobacco, Native Americans, and welfare.</p>
<p>In 1999 President Clinton nominated Kagan to the U.S. District Court of Appeals, no hearing was ever scheduled and she was thereby never confirmed.</p>
<p>Note: These records were made available in response to a <a href="http://clinton.presidentiallibraries.us/freedom-of-information-act-requests">Freedom of Information Act (FOIA)</a> request, FOIA 2009-1006-F. This collection contains both records created by Elena Kagan and records concerning Elena Kagan. </p>
