1. Whether They Are All Barred by the Statute of Limitations
As noted above, 500 Line's complaint contains allegations supporting the,
followi ng com mon law cia i ms: strict ,1ii:l bi Iity, b'n~ach of contract,
negligence, trespass, and nuisance. Defendants argue that these claims
are barred by the statute of limitations. According to defendants, each of
these claims is governed by a six-year limitations period. See, e.g., Minn.
Stat. § 541.05, subd. 1(1) (breach of contract); Minn. Stat. § 541.05,
, subd. 1(3) (trespass); Johnson v. Steele-Waseca Coop. Elec.,469 N.W.2d
517,520 (Minn.Ct.App. 1991) (nuisance). The defendants contend that
the limitations period began to run at the latest in 1973, when the
corporation's leasehold expired. Because these common law claims were
brought well after the :six-year period had run, the defendants argue that
these claims are barred by the respective statutes of limitations.
As 500 Line properly notes, however, federal [**42] law essentially
preempts state statutes of limitations if those state law claims are based
upon exposure to hazardous substances released into the environment,
and the applicable limitations period provides for an earlier
commencement date than ,federal law. 42 U.S.C. § 9658 provides in pa'rt:
,In the case of any action brought under State law for personal injury, or
property damages, which are caused or contributed toby exposure to any
, hazardous substance, or pollutant or contaminant, released into the
environment from ci facility, if the applicable limitations period for such
action (as specified in the State statute of limitations or under common
law) provides a commencement date which is earlier than the federally
required commencement date, such period shall commence at the
federally required commencement date in lieu of .the date specified in such·
State statute.
42 U.S.C. § 9658(a)(1). The statute further provides that the term
, "federally required commencement date" refers to the date that the
, plaintiff knew or should have known that his damages were caused or
contributed to by the hazardous substance or pollutantor contaminant
concerned. See 42 U.S.C. § 9658(b)(4). [**43] Thus, the statute '
effectively creates a federally mandated discovery rule for the accrual, of
state law claims involving releases of hazardous substances that cause or
contribute to personal injury or property damage. Bolin v. Cessna Aircraft
Co., 759 'F.Supp. 692, 704 (D.Kan. 1991). Because 500 Line alleges that it
had no notice of its damages until October of 1988, well within the
applicable limitations periods, the Court finds that 500 Line's state law
claims are not barred by the statutes of limitations.

However, we note that CERCLA now pre-empts state statutes of limitation
where they provide that the limitations period for personal-injury or
property-damage suits prompted by exposure to hazardous substances
starts on date earlier than the "federally ,required !=ommencement date.",.
That term is defined as "~he date plaintiff knew (or' [***34] reasonably
should have known) that the personal injury or property damages * ~ *
were caused or contributed to by the hazardous substance * * * [*583]
concerned." Superfund Amendmentsand Authorization Act of 1986, Pub.L.
No. 99-499, 100 Stat. 1613, 1695-96 (codified at 42 U.S.c.A. § 9658
(West Supp.1987):

When a suit on a federally created cause of action is brought in a state
court and there is a federal period of limitations specified, state courts
should apply' the federal period as well as any federal rules on tolling

<p>The Presidential Advisory Commission on Holocaust Assets in the United States, formed in 1998, was charged with investigating what happened to the assets of victims of the Holocaust that ended up in the possession of the United States Federal government. The final report of the Commission, <a href="http://govinfo.library.unt.edu/pcha/PlunderRestitution.html/html/Home_Contents.html"> “Plunder and Restitution: Findings and Recommendations of the Presidential Advisory Commission on Holocaust Assets in the United States and Staff Report"</a> was submitted to President Clinton in December 2000.</p>

<p>The collection consists of 19 series. The first fifteen series of the collection are composed mostly of photocopied federal records. These records were reproduced at the National Archives and Records Administration by commission members for their research. The records relate to Holocaust assets created between the mid 1930’s and early 1950’s by a variety of U. S. Government agencies and foreign sources.</p>
