Ihm wird im Zusammenhang mit den Ennittlun
gen der Staatsanwaltschaft im Landesentschiidi
gungsamt vorgeworfen, einen Betrug und elne
Urkunden:fiilschung begangen zu haben. Es er
scheint notig, im Fall Auerbach Zwischen Tat
sachen und Ressentiments Trennschiirfe'zu be
wahren, urn einen Awdruck aw der Radio
technik zu. gebrauchen. Die Verfehlungen, 'die
Dr. Auerbach begangen haben. solI, sind die eine
Seite der Angelegenbeit. Der Umstan,P, daB
Dr. Auerbach Jude ist, das 1st die andere Seite. .
Diese beiden Seiten des Falles Auerbach dUrfen
nicht durcheinandergebracht werden.
Wenn die Untersuchung bestiitigt, daB
Dr. Auerbach die ibm zur Last .gelegten Ver
fehlungen begangen hat, so ist es klar, daB' thn
die ganze Strenge des Gesetzes treffen mull. Das
hat gar nichts damit zu tun, ob Dr. Auerbach
Jude; Christ od~rMoha.minedaner, ob er Deut
scher, Russe oder Amerikaner ist. Nationa1e
oder konfessionelle Zu.gehOrigkeit eines Be-.
schuldl.gten kann vor dem Gesetz weder stra!
mildemd noch straferschwerend wirkeo.
Dies erscheint gaDz klar. Aber es ist leider
so, daB 1m Falle Auerbach eine Propaganda zu
befi1rchten ist, die genau so wie eine gewisse
. ubllzistik Ressentiments zu nutzen bestrebt

1st, urn politische Geschafte zu machen oder
ganz einfach im TrUben zu fischen. Vor dieser
Gefahr warnte der bayerische Justizminister,
Dr. Josef MUller, als er auf einer Kundgebung
der CSU in Ansbach Uber den Fall Auerbach
sprach. Die Bemerkung des Ministers, der aus)
dem Staatsdienst entlassene bisherige Leiter des
Landesentschadigungsamtes
sei
grolltenteils
seIber am Antisemitismw schuld, ist in Ver
bindung mit dieser Warnung allerdings nicht
ganzverstiindlich. Denn die gerade fUr die Be
urteUung des Falles Auerbach notwendige
Trennschiirfe erfordert,. daB man die Person von
den Verfehlungen' trennt.
'Mit dem Fall Auerbach ist nur eine unter
viclen Korruptionsafiiiren. die', fUr. die Nach
kriegszeit .nicht nur -in Deutschland typisch sind,
in das Licht der'.Oeffentlichkeit gerUckt worden.
Viele werden wahrscheinlich noch foIgen, noch

Tag kommen.' Unter den lautesten Schreiern
gegen Auerbach werden einige sein, die ihm
bestenfallsnichts vorzuwerfen haben, was 'sie
sieb. nlcht selber in potenziertem Malle vor
weden' niUllten. Die' Wirrnis der Nachkrlegszeit,'
die guten Gelegenheiten fUr skrupelloses Zu
packen, begtinstlgtdurch Gesetzlosigkeit und,
mangelIide Autol'itiit,· haben tiberall ent- i
schlossene.. NutznieBer hochkoinmen lassen und
eine 'Vennogell5bildt.mg begUnstigt, deren Her
kunftsnachweise trUbe .sind. Es steht ganz und
gar fest, daB dabeiJuden durchaw keine fUb- .
. rende·Rolle gespielthaben. Das weiB jeder, der;
aieb. nur die Milhe macht, in· seiner niichsten Um
gebung offeneAUgen und ein unbestechliches
urteU zu bewahren. Der Fall ~uerbach 1st nur
einer von vielen, die' fUr diese Zeit typisch' sind,
und einer der wenigen, die ans Licht· kamen.
Er kann nur als ein Fall dieser Zeit betrachte.t
werden.

.German curators, here several times trying to make an appointment
;for /avisi t to the Central Colleo.ting' Point for reasons whioh
were'nevel' olear to the undersigned. At first it was said
that.the1 were ~ust'curious and wanted to see some
ofth.things sinoe so much had reoently been turned over to
• 'the Mi;n:ister President. It developed, however, that they.wanted
to disouss the firstoase o,f a painting to be restituted under

2. There is a former German Jeff. Koppel, who
owned a large and very important painting by Rubens. This he
,has claimed under Law No. 59. In the meantime as H Camldian
citizen he has had in~uiries made by the Canadian Military
Mission attached to OKGUS, he has written'extensive1y himself
and has pressed his German lawyer Dr.Sohuohmann, in an effort
to get the piinting released. In the meantime he has offered to
loan this painting to ,the National Gallery of Art, Washingtqn
,D.C., as another. possible means of getting his painting to
the States. This Rubens is on the list of works of art of
national value which can . not be exported from Germany under.
the lew of 1919. The Legal Division, 014008,. some time ago,
wrote an opinion that )(i1itery Government was oompeten t to
suspend the provisions of this law sinoe its applioation would
not be oonsistent with equity •.

Point 14 September 1948 Dr.Auerbaoh advanced the interesting
. idea that Koppel should pay between 30,000 and' 40,000 DK for
"storage charges" since this painting had ,been stored in the
Central Co11e..ot1ng Pointior ,more than three years. Koppel's '
lawyer replied that his client should ge.t 6~ interest on this
painting for about 10 yeHr8~the length of time his client had
not been able.toen~oy the painting. !here was a lot of
'misce1laneousoollversation aboutoosts, oba rges and expens'es
after whioh the meeting broke up' without any tangible results~
'Later in the .dayBoppell-·s-lawyer returned and oomplained that
'Auerbach's nttitwie seemed to approaoh something like blaokmai1 •

the ·defini tion of meritorio'us claims beyond that as previQusly
.estab1ished in our cable CC-6871 dated 26 November 1948 w~ch
reads as follows:

spiracy on the part of the holder.
B. We will receive claims for cultural objects of con
siderable va1ue'dr importance to the cultural heritage of
a claimant. nation if the location in the U.S. Zone at .

C. We will reconsider a claim for a very valuable work of

Dear Mr. McCloy,
You may remember that I discussed with you
in November la,st year the ql).estion when the Bavarian Govern
ment would be 'permitted to liquidate those values reposing
with the Collecting Point at Munich which are not !3ubject
to restitution, so that the proceeds would be available for
the purpose of,' the Q:eneral Claims Act.
You were kindenough"to refer the matter to your General
Counsel and to the Property Control Division.
I talked to these gentlemen. But, while they were.attemp
ting to be helpful,it appeared that they were unable to take
~ny steps be~ause, apparently, the,state Department hadre
served the matter ,for themselves.
,In the meantime t I have discussed~he matt er in Washing
ton with the Bureau of German Affairs. In the absence of the
Chief, I talked to rtr.r. Lewis, the Deputy Chief, wh~ checked
the entire matter' and determined that there exists an order by
the State Department to hold everything for the time being.
He informed me that the sole reason for this order was the
neeessity to determine first· whether and in how far the ob~
jects collected in Mun~ch would be subject to restitution. He
assured me that the values reposing with the C.ollecting foint
would . .be at the disposal of the Bavarian Government as soon as
it .would be dete.rmined that they are not subject to restitution.
Understandably, the Bavarian Government, particular11 the
Finance Ministry and even more so my client, Dr. Auberbach,in
his capacity as Attorney General for persecutees, are anxious
to qbtain these values, so that they can liquidate them and use
the pr.oceeds for the purposes indicated hereinabove.
The Bavarian Government arid also Dr. Auerbach are equally
as concerned about the possible right s of rest i tution claimant s,
as are the American Government. ,Therefore, they would like to

undertake the task to determine as sp eedily as possible which
of the object~ d'art are subject to restitution. They wish to
classify these objects into 3 classes as follows:

In order to determine whether such obj ects fall under
Classes B or C, the Bavarian authorities should be given an
opportunity to check into the history of the objects in
question. I understand that there is in the hands of the
American authorities both a'list of the objects colle cted
as well\as. a card index indicating in manY instances their
history. ' SOl far, the Bavarian Government has not been given
an opportunity to check into these indices. Although the

Minister president of Bavaria has be'en appointed trustee
ship implies, nevertheless, ',the Bavarian Government has not
even been supplied with a list of the values in regard to
wl+ich the h,ead of, such government is tc;> exercise super
vision as a trustee.

<p>The Presidential Advisory Commission on Holocaust Assets in the United States, formed in 1998, was charged with investigating what happened to the assets of victims of the Holocaust that ended up in the possession of the United States Federal government. The final report of the Commission, <a href="http://govinfo.library.unt.edu/pcha/PlunderRestitution.html/html/Home_Contents.html"> “Plunder and Restitution: Findings and Recommendations of the Presidential Advisory Commission on Holocaust Assets in the United States and Staff Report"</a> was submitted to President Clinton in December 2000.</p>

<p>The collection consists of 19 series. The first fifteen series of the collection are composed mostly of photocopied federal records. These records were reproduced at the National Archives and Records Administration by commission members for their research. The records relate to Holocaust assets created between the mid 1930’s and early 1950’s by a variety of U. S. Government agencies and foreign sources.</p>
