We have received your file from the Holocaust Claims Processing Office in New York.
The goals of the Commission on Holocaust Assets are as follows: 1) to study and develop an
historical record of the gold, financial and cultural assets of Holocaust victims that came into the
possession or control of the Federal Government; 2) to review other research into assets that
came into the possession or control of non-Federal entities within the United States; and 3) to
recommend further actions, based on our discoveries, to the President. We are committed to
finding truth and attaining justice for those affected by the Holocaust, however we have no
authority to settle individual claims.
Our research into the role of the United States with regard to the disposition of the assets of
victims of the Holocaust that came into the possession or control of our government is ongoing.
The Commission will make recommendations to the President regarding policies that should be
adopted to right any wrongs that have been uncovered as a result of that research.
I have passed your information regarding the bank account issues of Mr. Ernst Wester to our
researchers for further investigation. If you have any additional information that you can share,
please forward it immediately.

Reference is made to the above-numbered claim
which you filed on June 12, 1353, for the return of cer
tain securities and cash dep6sits vested by this Office
under the Trading With the Enemy Act, 50 U.S.C. App. 1
et seq., by Vesting Orders Nos. 17976 and 17979, executed
May 31, 1951. The claimed ~roperty was deposited by the
Credit Suisse, Zurich, Switzerland, with Swiss Areerican
Corporation, New York, New York and with Brown Brothers
Harriman & Co., New York, New York, and was vested as
property owned by persons whose names were unknown.
In
a statement dated Hay 8, 1958, the Swiss Credit Bank,
Zurich, said that the claimed property had been carried
in its books in an account designated "No.6540Q" of
which Mr. Emil Albert Hayer, Zurich, was the depositor,
as trustee for Ernst Wester of Solingen, Germariy.
The return provisions of the Trading with the
Enemy Act, prohibit the return of vested property bene
ficially owned by German citizens who were resident in
Germany on or after December 7, 1941, and who did not
suffer substantial deprivation of their rights of Ger
man citizenship by reason of German discriminatory laws.
Since it appears that you are a German citizen who was
resident in Germany durine World War II and since you
have not established that you were substantially de
prived of German citizenship by Nazi discriminatory
laws, you are not eligible for a return of vested prop
erty under Section 32 or 9 of the Trading with the
Enemy Act, 50 U.S.C. App. 32,9.
Furthermore, your claim would not be allowable
on the basis of your alleged rights in the Estate of
Emile Albert Mayer, deceased, by virtue of an assignment,
dated June. 9, 1953, from the Swiss Trustee in Bankruptc:y.

It is the position of the Claims Unit that your ineli
gibility as a title claimant bars a return to you either
in your individual capacity as owner of the vested
property or as successor in interest to Emil Albert .
Mayer, trustee.
Accordingly, after the expiration of fortyfive days from the date of this letter, I intend to recom
mend to the Director that an Order of Dismissal on the
ground of ineligibility of the claimant be entered with
out further n6tice, pursuant to Section 502.25(i) of the
Rules of Procedure for Claims, a copy of which is en
closed. Within the 45-day period the claimant may file
with this Office a statement specifying the objections,
if any, to the dismissal of the claim, together with the
reasons in support of the objections; any evidence in
support of the claim which has not previously been filed
with this Office shall be filed with the statement of
objections. If I feel that the objections are without
merit, I will apply to the Director for an order dismis
Sing the claim, furnishing him the statement of objec
tions. The Director will then consider the objections
and may enter an order either dismissing the claim or
remanding it to the Claims Unit for further proceedings.
The dismissal of the claim will not be prejudi
cial to any rights which may be given the clatmant to
receive a return of vested property under any future
legislation.

Dear Sirs,
I am the grandson of a formerly wellsome german trader, who held some
accounts in Switzerland before and during the second world war.
As for familar and trading reasons my grandfather held connections to the USA
living relatives.
So it happened as I can take from several letters, after the war, the accounts were
transferred (unknown reasons) from Switzerland to the Netherlands and were
confiscated by the QS-Government. Documents or copies thereof with further details can be
made available. For details look for the handwritten appendix of this letter.
Letters dating from 1951/52 with a New-York-Lawyer tell from the fruitless applies for'
returning those acccunts in those years.
Now I have read about some attempts to get back accounts confiscated in a similar
situation.
Can You give me an idea, help or inforrilation about what I can do to react correctly against
the corresponding US-Authorities or institutions (who are they, what is their adress) and,
generally, who can be contacted.
Do You have any information about the progress of decisions concerning this matter?
This is my first att,emptand I am writing on behalf of two other grandchildren.
In case there is a possibility for making any claims, this letter should be the first document.
What is 'to be done for next?

AsI-have recientlyieamed from a letter ofErnst&Young - New York Contact Office, there
should be a deadline for filing a claim in March 31, 1998. Therefore I want to repeat with
this letter my intention to announce an old familiy claim against the US in order to recover

<p>The Presidential Advisory Commission on Holocaust Assets in the United States, formed in 1998, was charged with investigating what happened to the assets of victims of the Holocaust that ended up in the possession of the United States Federal government. The final report of the Commission, <a href="http://govinfo.library.unt.edu/pcha/PlunderRestitution.html/html/Home_Contents.html"> “Plunder and Restitution: Findings and Recommendations of the Presidential Advisory Commission on Holocaust Assets in the United States and Staff Report"</a> was submitted to President Clinton in December 2000.</p>

<p>The collection consists of 19 series. The first fifteen series of the collection are composed mostly of photocopied federal records. These records were reproduced at the National Archives and Records Administration by commission members for their research. The records relate to Holocaust assets created between the mid 1930’s and early 1950’s by a variety of U. S. Government agencies and foreign sources.</p>
