eXhibition at the Ba1 timorc Museum of Art which has been recently
a.Bmaged and now requires repair. The l>lueeure carries a blanket insur-'
&nce coverage but ~e understand instructions must be,r~ceived by it
fronl Mr. Batigne according to correspondence received by him. There
is also a portrait at the Metropolitan Museum of Art, N'!yT York, which,
due to its present condition, reC]uircs special protection and Mr.

Secretary:
As you know, a large number of works of art and other
objects, sent to the United States for exhibition under
auspices of the former French Government, including collec
tions sent for exhibition at the World's Fairs at New York
,and San Francisco ,are presently being .,held in various
museums or in storage warehouses under customs custody.
As the United States Government does not recognize at
this time a Government of. Fr~nce,with authority to safe
guard and protect these exhibition articles by supervising
.the manner of their storage, exhibition, and maintenance,
there is danger that they may deteriorate or be damaged
and that the United States Government may be subjected to
criticisDl for not having provided for their safekeeping.
Accordingly, this Department has suggested to the Trustees
of the ~ational Gallery of Art that they assume the
responsibility of carHfg-TOr-tlfe'se VtOrks of art and other
objects, provided that the Treasury Department issues an
appropriate directive·under section 5(b).of the Trading
with the Enemy Act, which will clothe them with ,suffi
cient ·authority to effect such measures as may be nec
essary. The Trustees of the National Gallery have indi
cated their asreement to such a proposal.
It is therefore requested that you issue a dire~tive
license, under the authority of section 5(b) of the Trading
with the Enemy Act, authorizing and directing the Trustees
of the National Gallery (1) to take possession and assume
custOdianship of the exhibition articles sent to the United
States under the auspices of the former French Government,
(2) to take such measures as they, in their discretion,
deem appropriate to safeguard and protect such articles,
and (3) to expend funds from a: designat,ed account for the
payment

Mr. Secretary ot'State:
It appears that the recognition by the Government of
the United States ot the Provisional Government of the
French Republic must consequently involve the returning
to the disposal of the French Government and ot this Dele
,gation ot all the art objects and all the articles imported
into the United States under the auspice~of the French
Gover'nment for purposes ot exposition aildplaced since
October 19, 1943 under the care of the ,Board ot Trustees
of the l~ational Gallery of ,Art.
The intention of the French Government is to place a
number ot those objeots temporarily at the disposal of the
different American museums which have expressed a desire
to display them to the public and, as soon as circumstances
permit, to return most of them to France, where they will \
be restored to the museums and private collections which
had loaned them.
I understand that the Board ot Trustees of the
National Gallery ot Art has applied to the Department of
Btateto be relieved ot the custody which it had assumed
and to be given authorization to turn over the oollections
and the articles in question to the disposal ot this'
Delegation.
I have no doubt that YoUl' Excellency will be good
enough to give your a,ssent to this proposal, and I am
happy to take this occasion to express my sincere appre
ciation of the spirit of friendly cooperation with Which
the Board ot Trustees of the National Gallery of Art has
performed its mission as guardian of that' important wealth
of P'rench art.

Control) enclosing License No. W-2l44, March 11,
1944, directing the Trustees or'the Natfonal Gallery
'of iU"tv'totake possession and to assume custodian- ,
ship of certain art objects and 'other exhibition
, material 'sent to the United States under the auspices
,of the pre-war French Goverrurient for exhibition in
,this country. It.isrecaUed ,that this license Vias
issued at the request of' the Stat&,,-Department in
order to safeguard adequately the exbi"oition obj ects
covered by the afor.esaid license until such time as
they might be returneQ. ,to the custody of a recog
nized and' friendly French Government.

.\6 you are aware, the United States Government
has recoenized the Provisional Government of the
French Republic headed by General de Gaulle. ' As a.
concrete and friendly gesture toward that Government
I consider it politically expedient, as TJell as
deSirable, "to return promptly to French custody the
French art objects and exhibition material now being
cared for by the National Gallery of Art in compliance
with the provisions of Treasury License no. W'-2l44.
The National Gallery of Art has' signified its willing
ness to be relieved of its responsibilities under the
aforesaid license. Furthermore,the Delegate at
V{aahington of. the French Provisional Government has
formally requested the Department of State·to effect
0. transfer of the French art objects and exhibition
material in, this country to his custody. A transla
tion,of his communioation on this subject, is enclosed,
,for your information.

As I feel cOnfident that you will perceive no
objection to the return to French oustody of the
French art objects and exhibition material, I would
accordingly be grateful if your Department would
take such steps as may be appropriate and necessary'
to relieve the National Gallery of its responsibili
ties under Treasury License no. W-2l44 and at the
same time authorize it to transfer custody of the
'French property in question to the duly authorized
representative of the French Provisional Government
at Washington.

Reearding the' paintings in privete collections, as you remember

should 'be insured in transit while they were 'on exhibition but not
~!ile they wero stored here at the museum.
lnasmnch as we followed
this arrangement for the 'last four years, I do not see any reason
why the paintings should be .insured at this l~te date, as the war
in Europe seems to be coming to an end and. tne transfer of the
paintings to Holland can probably be arranGed in the not too distant
future. Then the painti~s should be insllreq, of course, while they
are in transit from here back to Holland, and this can be arranged,
without doubt, at that time by comreunicating 'with the owners first'
and after pennission for. the return ot these ipaintings has been
secured from Washington.

We have recently received letters from thet lJetterle.nds

these paintin.;s. In fact theJ seom to think that.as a lesal effect
of a Royal [:ecree of May 24, 19ho these pa.intings now belong to the
Dutch Governu,ent. This is difficult for mo to understand as the
pn.1ntings-~with the exception of six belongins to the RijksmusoUtl-
were lE:1ft in our care by private owers and r would think should be
turned o,rer to t.h,em after the Iibera.tion of Holland.

These paintings were sent on my recom.endation to the United
Stater: for exhibition 'in the l'Asterpieces of Art exhibition at the Now
York World's Fair 1939, of Which I was director ~enerul. Since it wa~
not possible to return tho paintin~s, an arrangement was made with the
O";';11ers v..h oreby the tetroit Institute .of Arts would assume their custody
for the nuration, with permiosion frofl the owneT~ to send them on a
circuit of a nUmber of ,American mus.oums. Accord~ng to this arran~e
ment tl;e raintin~s ...-ere to be insured ",-hile travelling but upon their
return to the Detroit Institute of }.rts were to.be stored theroin
...·ithout insurance (aR aro our 0Vt~ art objects). ' The paintin~s ,rere
accordjr.cly exhihite~ in ei5hteen Amorican museu~s and were returned
to Detroit in :ood condition at the end of 1941. ,
After '1!e had r18.nag;ed this affair for some :thrae years, the
Netherla.nds InfonnatioTl Dureau asked me to help ~hem with.a great Dutch
propacanda exhibition at the Duveen Gallerias inNoVi York in Oc.tober
1942. Amon~ the Dutchmen in the United Statos thero Wns none with a
special know-ledGe of Dutch art and I was therefo~o obliged to seloot
the paintings for this e~1ibition, to approach the l~ericancollector~
and to supervioe the catalo~~~~~ 1l11i~cludp.d most of the Dutch paintings

Another Dutch exhibition was arranc;ed in llontreal in 1944 by the
Art Association with the heIr of the Netherlands Information
BUToau. I also devoted a great deal of time to this exhibition, for
which vie wbre asked not only to leud S{IlllO of, the Dutch 'paintings in
our storage but also a collection of ,Dutch pri~itives from museuns
and 'private collections' in this country. I mention this only as
~r. Van Ricmsdiik received a considerable remuneration for hio services
from .the rece,ipts or these charitable exhibitions. Wohad not thoucht
I?f remuneration although we did most of the work.

In June 1943 I was informed by the Netherlands Info::"II'at.ion
Bureau that in, a('.ccrdance with the Royal Decree of 1940 all J.::aintings
which had loft Holland before 1940 were now in the hands of the nutch
Government. I dio 'not answer this letter in the affirmative as 1
believed' this was not in the interest of the own~rs or in accordance
with their ?fishes. l~r. Van Riemsdijk Wrote us that he would
recommend to the Dutch 30vernrnent the advisability of insurinG the
paintings stored in Detroit and ~~ked me, for insurancevaluntions
, for thh purpose. 'I thou:;ht this quite UnneCEl3f.iary as the paintinc;o
had been stored here for four years without i'nsurance in order, to save
the ownors this" expense. If the paintings owned by the RijkSt:luseum
s,re, as I understand, the property, of the Dutch Government .. the
question 6f their 1n~urnnceshQuld be left to the Dutch Government
so far aswo are concerned, and I therefore sent lr~r. Van Riemsdijk
the inRurance valuations on the six Rijksmuse1lm paintings. I did not
give tho insurance valuations'on'the privately OY4lod paintin:;s as such
a step woulc. meant,hat we were in ~rect:lent with the point of view
of the l~ethorlands Infonr.ati'm Bureau.
Apart of the infonll8.ti,on whic,h l.ir. Van, Riemsdijk gath6red
in loolclU;; throut;h our p~ivate correspondenco was notice of the sale
of four of the paintinbs'by their owner Mr. Ten Cnte ,to Mr. Nathan
Katz .. the art dealer in Holland from whOm !fr. TenCate bought most
of 1".is collection. J.~r.Van Riem3d.ijk said that this sale was not
lebal. The sale took place, so ,far as '! know.. 'because Mr. Ten Cnte
waD in most difficult circumstances durinG the occupation, and perhaps
also because he wanted to help Jlr. Katz, who bein6 Je\171sh had only
recently, manabed to escape fram being placed in a concentration camp.
I have a letter from Mr. Ten Cate written in pencil and sent to me
throu(h Switzerland ree;arding the sale'. It seems very unfair that,
arter these people have suffered so much, a necessary step for their
existence should now be called illegal by their own govornrnent. These
paintinGS are still in our custody and have not been sold by JI.r. Katz.
1, am sure the pr1 vate collectors in Holland who l~ft the paintinGS
in our care are good patriots and would be greatly upsot if they
. should find that thei~ pa~rting~ hn~ been delivered to the Dutch

This Department, in respondint; to similar inquiries. with respect
.to the effect of. the Netherlands Royal Decreo :Of}&D.y 24, 1940, has
indicated that it Cannot arlvise. concerninb the effect to be
biven tho Netherlands decree under domestic law in the United
states, except to the extent that the policy of this Department

The Secretary of State has received a note from
the Ambassador of the Netherlands in which he informs
this Government that the Netherlands Government con
templates the organization of an exhibition of paint
ings looted from the Netherlands and recover"ed from"
Germany with the assistance of the American occupation
authorities, which that Government intends to show in
the United States during the year 1947 as a token of
the gratitude of the Dutch people to the American
people for their liberation.
The Netherlands Ambassador points out, however,
that,as the legal status of the present ownership of
the paintings has not yet been fully established, the
Netherlands Government has put them into the trust of
the fO)lndation "Nederlandsch Kunstbezitu. The Nether
lands Government requests that for the period durine
which these paintings are to be exhibited in this
country the United States recognize the jurisdiction
ot the foundation ttNederlandsch Kunstbezittt as the
prOVisional legal trustee of the paintings and guaran
tees that no measures will be taken which might impede
the return of the complete collection to the founda

Government, and the Hungarian C01il.l:l.ission for the Nevt York l:orld' s Fair, an agellCY
of the Hungarian Government, respective17. In addition, the Legation of Switzer
land baG requested that the customary i1Dll1Ullity granted to official eneTl\V property
be accorded to a sizable collection of Italian paintings and objects of art
which were exhibited at the New York World·s Fair andere located either at Pier
73, North River, New York City, or at the Manhattan Storage and Warehouse
Company, New York City. It is understood tbs.t all of this property is either
actuallyotmod by the aforementioned cominiasions or that the title to such pro

This Department is of, the, opinion that unless some paramount national interest
dictates otherwise, the above-mentioned property ,should be deemed official

inely". As you knO"l1, the Legntion of Switzerland has assumed responsibility for
the protection of Italian interests in the United States and the Legation of
Sweden has assumed a similar responsibility with respect to Hungarian interests.

of Switzerland and Swedan that they assume responsibility for the protection and
maintenance of the above-mentioned property and to assure them that such pro

<p>The Presidential Advisory Commission on Holocaust Assets in the United States, formed in 1998, was charged with investigating what happened to the assets of victims of the Holocaust that ended up in the possession of the United States Federal government. The final report of the Commission, <a href="http://govinfo.library.unt.edu/pcha/PlunderRestitution.html/html/Home_Contents.html"> “Plunder and Restitution: Findings and Recommendations of the Presidential Advisory Commission on Holocaust Assets in the United States and Staff Report"</a> was submitted to President Clinton in December 2000.</p>

<p>The collection consists of 19 series. The first fifteen series of the collection are composed mostly of photocopied federal records. These records were reproduced at the National Archives and Records Administration by commission members for their research. The records relate to Holocaust assets created between the mid 1930’s and early 1950’s by a variety of U. S. Government agencies and foreign sources.</p>
