DEPARTMENT OF DEFENSE APPROPRIATIONS BILL, FY 1999

This Statement of Administration Policy provides the
AdministrationD,s views on the Department of Defense Appropriations Bill,
FY 1999, as reported by the House Appropriations Committee.
Your
consideration of the AdministrationD,s views would be appreciated.
The Committee has developed a bill providing requested funding for
many of the AdministrationD,s priorities. We appreciate the CommitteeD,s
decision to fully fund the military pay raise and to fund critical

readiness programs at sufficient levels. Also, we are pleased that most
of the modernization priorities of the Department of Defense (DoD) are
funded at or near requested levels. The Administration, however, is
disappointed that the Committee bill provides ____ million below the
President's request in order to increase funding for lower priority
military construction projects. Also, as discussed below, the
Administration has serious concerns about certain provisions included in
the Committee bill, which must be addressed satisfactorily as the bill mo
ves through the process.
The Administration strongly opposes any provision in the Committee
bill that could be read to require prior congressional authorization of
actions taken by the President pursuant to his authority under the
Constitution. The President must be able to act decisively to protect
U.S. national security and foreign policy interests. This provision would
send the wrong signal to the world, including U.S. resolve regarding Iraqi
compliance with its obligations with respect to weapons of mass
destruction, the SFOR operation in Bosnia, and efforts to deter Serbian
President Milosevic from attacks on the people of Kosovo.
The
PresidentD,s senior national security advisers would recommend veto of a
bill with a provision such as this one that could be interpreted to
restrict the PresidentD,s exercise of constitutional authority.
Funding for Bosnia
The Administration regrets that the Committee has not included
funding for our ongoing operations in Bosnia.
U.S. military presence,
albeit at lower force levels, is critical for continued progress in
implementing the Dayton Peace Accords. Moreover, a secure funding source
for these operations at the start of the fiscal year will allow the
Department to manage its readiness accounts effectively throughout the
year.
Although funding requirements for operations in Bosnia were not
known when the FY 1999 Budget was prepared, the Administration created a
funding reserve in the buaget to cover these costs, and on March 3, 1998,
the President requested funding for this purpose. The Administration
strongly urges the Congress to provide emergency funding in the Defense
appropriations' bill to support the U.S. troops in Bosnia.
Year 2000 Reserve Funds
The Administration appreciates the emphasis that the Committee has
placed on Year 2000 (Y2K) computer conversion activities.
In the FY 1999
Budget, the President requested $364 million for Y2K computer conversion.
We recognize, however, that ensuring DoD compliance may require the
flexibility to respond to unanticipated requirements.
As such, we would
intend to employ the contingent reserve set aside by the Committee only to
the extent necessary, in order to ensure funds are available to address
emerging needs.
The Administration would strongly oppose efforts to strike the
emergency contingency fund from this bill. The value of the emergency
mechanism approved by the House Appropriations Committee is 'the
flexibility it provides in the event that we determine that additional
resources are required.
We have only 557 days until January I, 2000. We
want to solve this problem as soon as possible.
By delaying approval of
emergency funding and reopening the issue of the use of the emergency
spending authority, the House will create controversy and delay. We hope
the House will reconsider.
Operation & Maintenance (O&M) Adjustments

The Administration appreciates the CommitteeD,s emphasis on
preserving military readiness by funding critical O&M programs.
Force
readiness could be threatened, however, by the billD,s undistributed
reductions to other O&M programs, such as civilian personnel pay, travel,
and headquarters activities. The PresidentC,s request is tightly
constructed withfn the discretionary caps agreed to in the Bipartisan
Budget Agreement. Any adjustments must be carefully evaluated to ensure
that DoD has sufficient funding available for its operations and support
programs. The Administration is extremely concerned about reprogramming
restrictions on O&M accounts that would hinder a field level commanderD,s
abilities to meet emerging mission requirements.
Prior to final action
on the bill, the Administration would like to work with. the Congress to
develop reprogramming guidelines that avoid restrictions that would impede
commandersD, actions to maintain force readiness yet satisfy Congressional
oversight responsibilities.
Funding Levels
The Committee bill funds unrequested programs at the expense of
DoD FY 1999 requirements.
Also,' the Committee provides funds for programs
that, due to higher priority military requirements, are not in the Future
Years Defense Program (FYDP). These increases include $86 million for
modifications and upgrades to B-2 bombers, $398 million for seven
additional C-130J airlift aircraft, $60 million for two unrequested F-16
fighter aircraft, and $120 million for National Guard and Reserve
equipment.
Instead of funding these unrequested programs, the
Administration urges the Committee to restore disruptive decreases for key
DoD modernization programs, including the following:
$70 million decrease for the F-22 program, the $220 million decrease for
the F/A-18E/F program, and the elimination of funding for the Aerostat
program ($103 million);
reduction 'for research and development funding of two important Navy
programs:
the next generation aircraft carrier (CVX-78) and the land
attack destroyer (DD-21). The Committee would reduce aircraft carrier
development by $90 million, a 47-percent decrease from the PresidentD,s
request, and research funding for the DD-21 next-generation destroyer by
$69 million, an 81-percent decrease from the President's budget.
Reductions of this magnitude would jeopardize the NavyD,s ability to
design new technologies, to deliver these new technologies on schedule,
and to achieve life-cycle cost reductions -- a major goal of both
programs;
$59 million cut from the PresidentO,s request for Chemical Agents and
Munitions Destruction.
This reduction could delay a program that is on
schedule to meet the obligations of the Chemical Weapons Convention;
$5.5 million cut to the anti-personnel landmine alternative research and
development (R&D) program (the Remote Anti-Armor Mine System) and the $9
million cut to the humanitarian 'de-mining R&D program; and,
$10 ..9 million reduction made to the Global Combat Support System (GCSS).
This system will provide technical systems, common technology, and shared
data standards that are required for the DoD electronic commerce (EC)
initiatives, a key reform objective.
Theater High-Altitude Area Defense (THAAD)
The Administration urges the House to support the Ballistic

Missile Defense OrganizationO,s request for Theater High-Altitude Area
Defense (THAAD).
The THAAD program remains the DoDO,s most mature
upper-tier missile defense program. Recent ,test failures indicate a need
to restructure the program, but a complete review will be necessary before
this can be accomplished. The Administration intends to work with the
Congress on an appropriate funding profile.
Cooperative Threat Reduction (CTR)
The Administration urges full funding of the FY 1999 request for
the Cooperative Threat Reduction Program (CTR). Furthermore, we oppose
restrictions, imposed in the House authorization action (H.R. 3616) and
approved by the Appropriations Committee, that prohibit the use of CTR
funds for construction of a chemical weapons destruction facility in
Russia.
These restrictions would institute a minimum one-year delay in
the current project schedule, thereby slowing the construction of a safe,
secure, and ecologically sound method of destroying these dangerous
munitions.
Commercial Operations and Support Savings Initiative (COSSI)
The Committee has provided $62 million for COSSI, instead of the
$103 million requested. This program inserts commercial technologies in
existing defense systems, thus lowering support costs and increasing
performance while enabling already fielded systems to modernize quickly.
The Administration urges full support of this program.
High Speed Networks
The Committee makes a reduction of $34 million to networking
research in the Defense Advanced Research Projects Agency based on alleged
duplication of effort. However, any overlap was removed in FY 1998 as a
result of an interagency review mandated by Congress.
Accordingly, the
Administration urges restoration of funding to ensure the security and
survivability of future military networks and systems.
Advanced Concept Technology Demonstrations (ACTDs)
The Committee has cut the request for core ACTD funding by $35
million, to $81 million. This program supports work on new and innovative
defense system concepts, and it could provide the basis for systems
yielding a decisive military edge over adversaries in the next century.
The Committee's funding level for this program would not provide
sufficient funds to support ongoing ACTDs and would preclude initiation of
any new ACTDs in FY 1999. The Administration urges the Committee to fund
the program at the requested level.

COMMENTS: To follow is a revised version of the HUD report on Public
Housing Reform, redlined to show the changes that were made in response to
comments received on the first draft.
We understand that significant portions of the public housing legislation
will be attached to the House VA/HUD appropriations bill, which is
scheduled to be marked up by the Appropriations Committee this Thursday.
HUD would like to send its letter before Appropriations Committee action.
The deadline is firm.

All:
Ellen Vargyas had a conversation with David Frank this afternoon.
He told
her that according to Mike Rengler, there has not yet been a committee
report drafted for the subcommittee.
On the $ front, he told her that the
appropriators had not settled on a figure.
One of the big issues is' the
part of the increase ($9 million) that is slated to improve technology at
the agency.
According to Frank, some on the subcommittee indicated that
they were interested in having the EEOC fund its technology improvements
(computers; e-mail; legal data bases) using discretionary dollars in the
Treasury-Postal legislation ($ intended to be used to address the the Y2K
probl,em).
Frank further indicated that the agency should get "a big
chunk'" of the rest
($28 million) .
Ellen told Frank that we want to make sure that we have resolution on the
other five conditions as soon as possible.
Frank told Ellen that he would
try to get Rengler to focus on drafting conference language on this.
Given this delay, he indicated that they could push back the date by which
he would want to know whether we had a deal on testers (they had
originally talked about a July 1st deadline).'

This Statement of Administration Policy provides the
AdministrationD,s views on S. 2132, the Department of Defense
Appropriations Bill, FY 1999, as reported by the Senate Appropriations
Committee,
Your consideration of the AdministrationD,s views would be
appreciated.
The Committee has developed a bill providing requested funding for
many of the AdministrationD,s priorities. We appreciate the CommitteeD,s
decision to fully fund the military pay raise and readiness programs at
requested levels. Also, we are pleased that most of the modernization

priorities of the Department of Defense'are funded at or near requested
levels. However, the Administration is disappointed that the Senate,
based on OMB's preliminary scoring, has provided $436 million below the
President's overall request for this bill due to increases in lower
priority military construction projects. Also, as discussed below, the
Administration has serious concerns about certain provisions included in
the Committee bill, which must be addressed satisfactorily as the bill
moves through the process.
Funding for Bosnia
The Administration regrets that the Committee has not included
funding for our ongoing operations in Bosnia. U.S. military presence,
albeit at lower force levels, is critical for continued progress in
implementing the Dayton Peace Accords. Although funding requirements for
operations in Bosnia were not known when the FY 1999 Budget was prepared,
the Administration created a funding reserve in the budget to cover these
costs, and on March 3, 1998, the President requested funding for this
purpose. A secure funding source at the start of the fiscal year allows
the Department to manage its readiness accounts effectively throughout the
year.
The Administration strongly urges the Congress to provide emergency
funding in the Defense Appropriations bill to support the U.S. troops in
Bosnia.
Unrequested Funding
The Committee bill increases funding for programs that due to
higher priority military requirements are not in the Future Years Defense
Program (FYDP), or, that should not be funded at the expense of DoDD,s FY
1999 requirements. These increases include $50 million for C-130J airlift
aircraft, $287 million for National Guard and Reserve equipment (not
including C-130 aircraft), $94 million for the Space Based Laser program,
and $50 million for advance procurement of the LHD-8 amphibious ship.
Moreover, to complete procurement of the LHD-8, extensive funding will be
required in later years. These increases would be at the expense of
higher priority defense programs.
Reduction in Request for Intelligence Budget
The Administration objects to the Committee's significant
reduction to the FY 1999 funding request for U.S. intelligence. The
CommitteeD,s reduction would slow the Administration'S efforts to
strengthen the Intelligence Community. The Administration urges the
Senate to appropriate the full amount of. the President's request to ensure
that the Intelligence Community can meet the most pressing needs of our
national policy makers and combatant commanders. The Director of Central
Intelligence will provide additional detail on these classified issues
prior to the conference on the Defense appropriations bill.
O&M Adjustments
The Administration appreciates the billD,s emphasis on preserving
military readiness through strong funding of most O&M programs.
However,
force readiness could be threatened by the billD,s reductions to other O&M
efforts, such as civilian personnel pay. The presidentD,s request is very
tightly constructed within the discretionary caps agreed to in the
Bipartisan Budget Agreement.
Any adjustments must be carefully evaluated
to ensure that sufficient funding is available for DoD operations and
support programs. The Administration is also concerned that additional
restrictions may be placed on O&M accounts that would further hinder the

ability of field level commanders to meet mission requirements quickly in
a constantly changing environment. The Administration would like to work
with the Congress to address these issues prior to final congressional
action on the bill.
Reduced Funding for the Next-Generation Aircraft Carrier
The Committee bill would reduce funding for research and
development of CVX-78, the next-generation aircraft carrier, by $116
million, a 61-percent decrease from the President'l,s request.
A reduction
of this magnitude would jeopardize the Navy's ability to design and
deliver new aircraft carrier technologies and would make it difficult to
achieve life-cycle cost reductions, a major goal of the aircraft carrier
development program. The Administration urges the Senate to restore
funding to this important development effort.
Reduced Funding for Dual Use R&D
The Committee has provided $36 million for the Dual Use
Applications Program, $30 million below the President's request, and $73
million for the Commercial Operations and Support Savings Initiative, $30
million below the request.
The Administration urges full support of these
programs, which are needed to ensure that DoD systems employ technologies
used in commercial products to good advantage. These dual-use
technologies will help lower production and support costs and help
modernize many DoD systems more readily than could be done through use of
DoD-unique technologies.
Next Generation Internet
The Committee has provided only $30 million for Next Generation
Internet (NGI) funding, $10 million less than requested.
Funding this
program will support research into high-rate data networking technologies
that will be needed by DoD's information-intensive systems in the near
future.
The Administration urges full funding of the NGI request.

DEPARTURE STATEMENT ON TOBACCO LEGISLATION
THE WHITE HOUSE
June 22, 1998
In a few moments I will be leaving for the Vice PresidentD,s
Family Reunion Conference in Nashville, where I will speak about the
health care concerns American families face.
Before I depart, I want to
make clear: one of the most important health issues our families face is
youth smoking.
3,000 children a day start 'smoking, and 1,000 of them will
die early because of it. That is why, three years ago, through the FDA,
we began to act to end the practice of tobacco companies marketing to our
children. And that is why, for the past year, we have been working to
forge an honorable, bipartisan compromise that protects our children from
the dangers of tobacco.
A majority of the Senate stands ready to join us in making
progress; but last week, the Republican leadership placed partisan
politics --'and tobacco companies -- above AmericalJ,s families.
Their
vote was not just pro-tobacco; it was anti-family. The bipartisan bill
they blocked would not only protect families from tobacco advertising that
targets children; it would protect kids from drugs, and give low- and
middle-income families a tax break by ending the marriage penalty.
It
would also make an important investment. in cancer research.
The congressional leadership seems willing to walk away from its
obligation to AmericaD,s children.
But this issue is too important to
walk away. We will continue to move forward on every regulatory front to
protect the health of our children.
By the end of the year, the FDAD,s
operation to enforce its ban on tobacco sales to minors will be active in
nearly every state in America.
And while we wait for Congress to heed the
call of AmericaD,s families, I am asking the Department of Health and
Human Services to produce the first-ever annual survey on the brands of
cigarette that teenagers smoke, and which companies are most 'responsible
for this problem.
Parents, quite simply, have a right to know.
Public
health officials can also use this new information to reduce youth
smoking.
The tobacco companiesD, automatic and angry dismissal of this new survey

shows their continued disregard for childrenO,s health.
But once this
information becomes public, tobacco companies will no longer be able to
dodge their responsibilities -- and neither will Congress.
From now on,
the new data will help to hold tobacco companies accountable for targeting
our children.
Again, I urge Congress to pass a comprehensive, bipartisan bill -rather than a watered-down bill, written by the tobacco lobby, that aims
not to save the lives of children but to save the political lives of the
congressional leadership. AmericaO,s children deserve better than that,
and I will continue to do everything in my power to ensure that they
receive it.

DEPARTMENT OF DEFENSE APPROPRIATIONS BILL, FY 1999

This Statement of Administration Policy provides the
AdministrationO,s views on the Department of Defense Appropriations Bill,
FY 1999, as reported by the House Appropriations Committee. Your
consideration of the AdministrationO,s views would be appreciated.
The Committee has developed a bili providing requested funding for
many of the AdministrationO,s priorities.
We appreciate the CommitteeO,s
decision to fully fund ,the military pay raise and to fund critical
readiness programs at sufficient levels.
Also, we are pleased that most
�,ARMS Email System
of the modernization priorities of the Department of Defense (DoD) are
funded at or near requested levels.
The Administration, however, is
disappointed that the Committee bill provides $255 million below the
President's request in order to increase funding for lower priority
military construction projects. Also, as discussed below, the
Administration has serious concerns about certain provisions included in
the Committee bill, which must be addressed satisfactorily as the bill mo
ves through the process.
The Administration strongly opposes any provision in the House
version of the bill that could be read to require prior congressional
authorization of actions taken by the President pursuant to his authority
under the Constitution. The President must be able to act decisively to
protect U.S. national security and foreign policy interests. This
provision would send the wrong signal to the world, including U.S. resolve
regarding Iraqi compliance with its obligations with respect to weapons of
mass destruction, the SFOR operation in Bosnia, and efforts to deter
Serbian President Milosevic from attacks on the people of Kosovo.
The
PresidentO,s senior national security advisers would recommend veto of a
bill with a provision such as this one that could be interpreted to
restrict the PresidentO, s e'xercise of constitutional authority.
Funding for Bosnia
The Administration regrets that the Committee has not included
funding for our ongoing operations in Bosnia. U.S. military presence,
albeit at lower force levels, is critical for continued progress in
implementing the Dayton Peace Accords.
Moreover, a secure funding source
for these operations at the start of the fiscal year will allow the
Department to manage its readiness accounts effectively throughout the
year. Although funding requirements for operations in Bosnia were not
known when the FY 1999 Budget was prepared, the Administration created a
funding reserve in the budget to cover these costs, and on March 3, 1998,
the President requested funding for this purpose. The Administration
strongly urges the Congress to provide emergency funding in the Defense
appropriations bill to support the U.S. troops in Bosnia.
Year 2000 Reserve Funds
The Administration appreciates the emphasis that the Committee has
placed on Year 2000 (Y2K) computer conversion activities.
In the FY 1999
Budget, the President requested $364 million for Y2K computer conversion.
We recognize, however, that ensuring DoD compliance may require the
flexibility to respond to unanticipated requirements. As such, we would
intend to employ the contingent reserve set aside by the Committee only to
the extent necessary, in order to ensure funds are available to address
emerging needs.
The Administration would strongly oppose efforts to strike the
emergency contingency fund from this bill. The value of the emergency
mechanism approved by the House Appropriations Committee is the
flexibility it provides in the event that we determine that additional
resources are required. We have only 556 days until January 1, 2000. We
want to solve this problem as soon as possible.
By delaying approval of
emergency funding and reopening the issue of the use of the emergency
spending authority, the House will create controversy and delay. We hope
the House will reconsider.

The Administration appreciates the CommitteeO,s emphasis on
preserving military readiness by funding critical O&M programs.
Force
readiness could be threatened, however, by the bille,s undistributed
reductions to other O&M programs, such as civilian personnel pay, travel,
and headquarters activities. The President~:,s request is tightly
constructed within the discretionary caps agreed to in the Bipartisan
Budget Agreement. Any adjustments must be carefully evaluated to ensure
that DoD has sufficient funding available for its operations and support
programs. The Administration is extremely concerned about reprogramming
restrictions on O&M accounts that would hinder a field level commanderD,s
abilities to meet emerging mission requirements.
Prior to final action
on the bill, the Administration would like to work with the Congress to
develop reprogramming guidelines that avoid restrictions that would impede
commandersD, actions to maintain force readiness yet satisfy Congressional
oversight responsibilities.
Funding Levels
The Committee bill funds unrequested programs at the expense of
DoD FY 1999 requirements.
Also, the Committee provides funds for programs
that, due to higher priority military requirements, are not in the Future
Years Defense Program (FYDP). These increases include $86 million for
modifications and upgrades to B-2 bombers, $398 million for seven
additional C-130J airlift aircraft, $60 million for two unrequested F-16
fighter aircraft, and $120 million for National Guard and Reserve
equipment.
Instead of funding these unrequested programs, the
Administration urges the Committee to restore disruptive decreases for key
DoD modernization programs, including the following:
$70 million decrease for the F-22 program, the $220 million decrease for
the F(A-18E/F program, and the elimination of funding for the Aerostat
program ($103 million);
reduction for research and development funding of two important Navy
programs:
the next generation aircraft carrier (CVX-78) and the land
attack destroyer (DD-21). The Committee would reduce aircraft carrier
development by $90 million, a 47-percent decrease from the presidentD,s
request, and research funding for the DD-21 next-generation destroyer by
$69 million, an 81-percent decrease from the President's budget.
Reductions of this magnitude would jeopardize the NavyD,s ability to
design new technologies, to deliver these new technologies on schedule,
and to achieve life-cycle cost reductions -- a major goal of both
programs;
$59 million cut from the PresidentO,s request for Chemical Agents and
Munitions Destruction. This reduction could delay a program that is on
schedule to meet the obligations of the Chemical Weapons Convention;
$5.5 million cut to the anti-personnel landmine alternative research and
development (R&D) program (the Remote Anti-Armor Mine System) and the $9
million cut to the humanitarian de-mining R&D program; and,
$10.9 million reduction made to the Global Combat Support System (GCSS).
This system will provide technical systems, common technology, and shared
data standards that are required for the DoD electronic commerce (EC)
initiatives, a key reform objective.
$58 million reduction to basic research programs. Defense basic
research provides the foundation f9r tomorrow's military superiority and
supports colleges and universities across the country in training

tomorrow's defense scientists and engineers.
Theater High-Altitude Area Defense (THAAD)
The Administration urges the House to support the Ballistic
Missile Defense Organizationo,s request for Theater High-Altitude Area
Defense (THAAD). The THAAD program remains the DoDO,s most mature
upper-tier missile defense program. Recent test failures indicate a need
to restructure the program, but a complete review will be necessary before
this can be accomplished. The Administration intends to work with the
Congress on an appropriate funding profile.
Cooperative Threat Reduction (CTR)
The Administration urges full funding of the FY 1999 request for
the Cooperative Threat Reduction Program (CTR).
Furthermore, we oppose
restrictions, imposed in the House authorization action (H.R. 3616) and
approved by the Appropriations Committee, that prohibit the use of CTR
funds for construction of a chemical weapons destruction facility in
Russia.
These restrictions would institute a minimum one-year delay in
the current project scnedule, thereby slowing the construction of a safe,
secure, and ecologically sound method of destroying these dangerous
munitions.
Commercial Operations and Support Savings Initiative (COSSI)
The Committee has provided $62 million for COSSI, instead of the
$103 million requested. This program inserts commercial technologies in
existing defense systems, thus lowering support costs and increasing
performance while enabling already fielded systems to modernize quickly.
The Administration urges full support of this program.
High Speed Networks
The Committee makes a reduction of $34 million to networking
research in the Defense Advanced Research Projects Agency based on alleged
duplication of effort. However, any overlap was removed in FY 1998 as a
result of an interagency review mandated by Congress.
Accordingly, the
Administration urges restoration of funding to ensure the security and
survivability of future military networks and systems.
Advanced Concept Technology Demonstrations (ACTDs)
The Committee has cut the request for core ACTD funding by $35
million, to $81 million. This program supports work on new and innovative
defense system concepts, and it could provide the basis for systems
yielding a decisive military edge over adversaries in the next century.
The Committee's funding level for this program would not provide
sufficient funds to support ongoing ACTDs and would preclude initiation of
any new ACTDs in .FY 1999. The Administration urges the Committee to fund
the program at the requested level.

Declare End to Reading Wars -- Announce Summit. The National Academy of
Sciences Report on "Preventing Reading Difficulties in Young Children" has been
well-received across the political spectrum, but it is not well-known. One possible event
would be for you to respond to the report by declaring an end to the reading wars -- the
long-running fight between "phonics" and "whole language" advocates. At one of the
tutor training sessions being held across the country over the summer, you could call for a
September "Reading Summit" (already being planned by Education). You could also put
some flesh on the $3 billion Early Learning Fund in the budget, perhaps calling it the
Marshall Plan for the end of the Reading Wars.

Bilingual Education and Pre-School. We could seize on the bilingual education
backlash to advance the goal of working towards universal pre-school. Our goal
would be to have pre-school programs to help non-English speaking 3-4 year olds
learn to speak English (the younger they are, the easier it is to learn; we should be
teaching them before they get to kindergarten and then they'll be ready to learn to
read and add like other kids). We could try to re-program funds, use existing
funds will flexible authority, or try to carve out pilot in an appropriations bill.
DC Training Alliance. You could announce a Labor Department pilot program that
would give a $1.2 million planning grant (the "metro-tech grant") to the DC, MD, and
VA job-training systems to train workers to meet the demand in the high-tech industry in
the DC, MD, and VA area. The pilot program will fund 100 workers. There is an
expectation that this pilot will lead to a demonstration project serving 3,000 people at a
cost of $17 million. This is ready to be announced anytime in the near future.
•
School Construction and Smaller Class Size Day. We could begin preparing now for
a back-to-school week day that would focus on school construction and smaller class
sizes. We could ask parents, volunteers, Members of Congress, and community leaders
to join together to help rebuild/renovate/modernize their local public school. You, the
Vice President, Mrs. Clinton, and Mrs. Gore could all participant in this construction
effort. This would be a terrific visual and would allow Members of Congress a chance to
highlight this important issue for the fall.
•
Report on Success of School-to-Work Program. A major study is expected to be
released soon on one of your signature programs of his first year in office,
School-to-Work. Ifit is as positive as hoped, and if the right-wing's opposition
continues to be an issue, this might be an appropriate time to take on the right-wing and
further energize the business community in support of Democrats' efforts. We are not
sure of the timing of this report. Moreover, our budget scales back the school-to-work
program (from $400 million to $250 million) as it sunsets according to law.
Individual Development Accounts:

recipients, and push this as part of our welfare-to-work efforts ..
Pensions:
•
Pensions Proposals_ Your advisors have reached consensus on two pension proposals
(in addition to the proposals announced in January). The joint and
two-thirds/three-quarters survivor annuity proposal would increase benefits for some
surviving spouses of pension plan participants, while the other proposal, initially
advanced by Rep. Price (D-NC), would· allow workers to count FMLA time toward
pension vesting requirements. This would ensure that those (relatively few) workers
close to the 1,OOO-hour minimum requirement for vesting do not lose a year of vesting
because of time taken off under FMLA. This can be billed as a women's pension item.
Rural Agenda:
•
Rural Economic Development. There are several potential rural economic initiatives
that the Administration could roll out over the summer or fall. These focus in particular
on education, agriculture, housing, trade, and health care. We would work together on
some of these and other potential initiatives.
Rural Press ConferencelRegional Press Opportunities. We may want to consider
announcing different elements of a rural economic development initiative through a radio
press conference which you, the Vice President, and Sec. Glickman could jointly hold.
We have done this successfully in the past, particularly with respect to budget initiatives.
In addition, we might want to devote a weekly radio address to rural issues as well. Both
of these hits could be part of a broader rural economic rollout in which we have Cabinet
heads and subcabinet officials conduct media in targeted rural markets across the country.
Housing:
•

HUD-NAR "One America" Agreement. HUD and the National Association of
Realtors (NAR) have reached a final agreement on the "One America Broker" program.
Under the program, NAR will sponsor training for real estate professionals on how to
better serve minority and immigrant home buyers. The training will address adherence
to Fair Housing Act principles, as well as ways to expand the housing choices available to
minorities and other underserved groups. Realtors who complete the course and commit
to serving these groups would be able to use the "One America" logo in advertising and
promotional materials, which could help them to attract additional clients. To be
certified, realtors must be free of any Fair Housing Act violations. The agreement could
be announcedlhighlighted by you or the Vice President at an event with,e.g., a minority
or immigrant new home buyer who previously experience discrimination and (possibly) a
realtor with an outstanding record serving underserved groups.

Initiative on Technology for Americans with Disabilities. New infonnation technologies
can substantially increase the quality oflife for the 55 million Americans with disabilities.
For example -- speech recognition, text-to-speech, computers that can be manipulated with
eye movements as opposed to a mouse -- can all allow Americans with disabilities to lead
more independent lives and increase their ability to get a job. The backdrop for this event
could be demonstrations of the technology. Deliverables could be:
o Announcement of Technology Task Force of President's Committee on
Employment of People with Disabilities.
o FY2000 budget initiative (R&D to develop better technologies, programs to
educate engineers to design accessible technology).
o Government commitment to purchase "accessible" technology [This is part of the
"GI" bill.]
International Economics:
•
Trade Adjustment Assistance. We could do an event on helping everyone benefit from
a global economy. This event could have four different components, focused on both
worker and community adjustment:
o You could announce the consolidation and refonn of the Trade Adjustment
Assistance (T AA) program and the NAFTA-T AA program. This would more
than fulfill the President's promise to strengthen the TAAINAFTA-TAA
programs during the fast track debate.
o
A possible Executive Order establishing a coordinating committee on community
adjustment issues. This could be modeled after the Executive Order on defense
adjustment programs.
o You would call on Congress to pass his EDA budget and NADBank budget, so
that we can effectively deal with communities that have severe and sudden
economic distress.
o Memorandum of Understanding between NADBank and EDA so that they work
better together. This is important to Rep. Torres and the Hispanic Caucus.
NADBankiCAIP and EDA have done a lot of work together, but it could be an
important symbolic message to the Hispanic Caucus for the relationship between
the two to be fonnalized.
•
Sanctions Policy. You could announce the release of a Presidential Decision Directive
on Sanctions which would establish a joint NEC/NSC interagency sanctions review group
to monitor and coordinate broad United States government sanctions policy. The group
would ensure that prior to sanctions being implemented the Administration would
conduct a costlbenefit analysis. The group could also review existing sanctions in place
to detennine whether they are still serving an important purpose in fulfilling our policy
objectives. The time could be ripe for such an announcement because of the keen
awareness on the Hill and elsewhere about the proliferation of new sanctions regimes and
their cost to the U.S. economy. An interagency process has been working on such a

directive; work could be finalized in time for an announcement. Because the Glenn
Amendment has crystallized opinion about the problems with unilateral sanctions, this
can and should be done sooner rather than later (e.g., over the next couple of weeks).

Major International Trade Speech. You could articulate U.S. trade objectives for the
year leading up to the 1999 WTO Mi!listerial Conference, which we are hosting. You
could also announce the selection of the city for such an announcement. Over 20 cities
have expressed interest; the conference will bring international attention and over 10,000
attendees from foreign government, business, press and NGOs. The policy initiative
would be a refinement of the goals outlined at the May 1998 WTO Anniversary in Geneva.

We are trying to prepare a POTUS statement to be released in response to a
Supreme Court decision expected this Thursday.
The case, Bragdon v.
Abbott, will determine whether persons with asymptomatic HIV are protected
by the ADA. The proposed POTUS statement assumes a negative decision,
although we obviously do not know the outcome.
I have worked on this draft with Richard Sorian of HHS and Rob Weiner of
WH Counsel.
I have also sent it to Eleanor Acheson's office at Justice
for their review.
Diana Fortuna suggested Bill Lann Lee's shop as well,
so I'll have it forwarded to them.
I got the following reply from Robert Damus (OMB): "Since this is not·an
order, it does not need to go through the OMB EO process.
I would think
you want to send it to the affected agencies, like Justice and.HHS, and
have some kind of circulation within the EOP, like White House Counsel,
and then give it to the Staff Secretary's Office. Either that or simply

I sincerely hope that today's decision by the Supreme Court in Bragdon v.
Abbott, will not weaken the protections offered by the landmark Americans
with Disabilities Act. The ADA was enacted with strong bi-partisan
support to protect disabled Americans from discrimination. The
Administration filed a brief in this case arguing that people with HIV
are disabled whether or not they are symptomatic, and that the protections
offered by the ADA therefore apply.
I want to assure all disabled Americans, including those living with HIV
disease and AIDS, that this Administration is firmly committed to
protecting them from discrimination.
I have asked the Secretary of Health
and Human Services, the Attorney General, and the Director of the Office
of National AIDS Policy to: (1) assess the implications of today's
decision; (2) review other Federal anti-discrimination protections -- in
such programs as Medicare, Medicaid, the Ryan White CARE Act, veteran's
health care, and publicly assisted housing -- potentially available to
people living with HIV; and (3) recommend ways to strengthen existing
protections.
I call again on Congress to join us in the effort to afford all
Americans, including the disabled, equal access to health care, housing,
and other essential services.

This Friday, in conjunction with his trip to Texas, the VP will host a
town-hall meeting in San Antonio with local affiliates of his welfare to
work coalition.
The meeting is scheduled from 11:30-12:30 at the YMCA in
San Antonio.
Apparently "the decision to do this was made Friday, but VP's
office forgot to let us know--I only found out this morning.
This evolved
from the VP simply doing a tarmac announcement of Texas' Welfare-to-Work
formula grant, to doing something wi"th John Sharp/Pathfinders (not avai
lable), to doing a coalition meeting. The VP will announce that DOL is
releasing Texas's grant ($76 million, the largest grant released to
date).
Secretary Herman may be attending (not confirmed).
The plan is
for her to notify the Governor and congressional delegation just before
the event--so we don't get scooped.
The VP will be joined by the director
of the local YMCA and a former welfare recipient (probably someone whose
child is in after-school program at the Boys and Girls Club). Audience of
150-200 will primarily be people from the local community-based
organizations (YMCA, YWCA, Goodwill, United Way, Salvation Army,
Pathfinders, etc). VP will calion selected audience members to talk
about what theY're doing to promote retention for welfare recipients, i.e.
mentoring, child care, etc.
Since San Antonio is one of the cities in the Partnership's eight-city
campaign with the Enterprise Foundation, I've hooked Partnership into the"
event.
They'll round up a few businesses to attend, one of whom the VP
can calion. The local Enterprise Foundation contact, and Partnership
staff will also attend.
I've also made sure HHS and SBA are in the loop.

I spoke with Nancy Zirkin last night who was on the phone call with the
civil rights groups in the afternoon--1) they don't understand why EEOC
went down the path it did other than the abused child syndrome (sort of
like INS--they are always being kicked, so they move very cautiously
hoping to avoid getting kicked again); 2) they (LCCR) are planning to send
a letter to the committee outlining their concerns with Gingrich's
objections (not all of them--testers is the most impt, but they are also
worried about the directive that more resources be dedicated to charging
processes and less to litigation); 3) they know we are not settled on the
other issues 4) she indicated that it certainly was a good strategy to try
to avoid a rider but they are still really upset with EEOC and want to
know who at the White House was minding the store and what does the white
house do when an agency takes steps that perhaps (they hope in this case)
the White House is not in favor of -- she thought doing a small meeting.

Ellen Vargyas had a conversation with David Frank this afternoon.
He told
her that according to Mike Rengler, there has not yet been a committee
report drafted for the subcommittee. On the $ front, he told her that the
appropriators had not settled on a figure.
One of the big issues is the
part of the increase ($9 million) that is slated to improve technology at
the agency.
According to Frank, some on the subcommittee indicated that
they were interested in having the EEOC fund its technology improvements
(computers; e-mail; legal data bases) using discretionary dollars in the
Treasury-Postal legislation ($ intended to be used to address the the Y2K
problem).
Frank further indicated that the agency should get "a big
chunk" of the rest
($28 million) .
Ellen told Frank that we want to make sure that we have resolution on the
other five conditions as soon as possible.
Frank told Ellen that he would
try to get Rengler to focus on drafting conference language on this.
Given this delay, he indicated that they could push back the date by which
he would want to know whether we had a deal on testers (they had
originally talked about a July 1st deadline).

1) Early warning guide release:
In his June 15th radio address, the
President directed the Attorney General and Secretary of Education to
develop an early warning guide for schools to use in dealing with troubled
youth.
This guide should be ready for release by the end of August and
could be combined with a meeting a White House meeting with officials from
Springfield, Jonesboro, and other cities recently affected by school
shootings. The guide will contain research-based information for
principals and teachers on how to identify and refer deeply troubled
youths.
2) Release of First Annual Report on School Safety.
In late
September/early October, the President could release the annual report on
school safety that he ordered to be developed in the wake of the Paducah,
KY shooting.
This report will be a comprehensive document that will
contain all data on school crime, discuss successful strategies to reduce
school violence, and include a checklist for parents on school
safety/security. The release of this report could also be an opportunity
for the President, by satellite, to address hundreds of schools across the
country on school violence -- and for teachers at these schools to conduct
follow-up discussions.
And while we still may want to keep the DUF/ADAM drug numbers and drug
court grants as part of the media campaign announcement on 7/9, we could
promote their release as a separate event ...
3)
Release of Drug Court Grants.
In mid-July, DOJ's National Institute
of Justice (NIJ) will be ready to release its DUF/ADAM (Drug Use
Forecasting/Arrestee Drug Abuse Monitoring) data. While we do not yet
know the details of the final data, they will certainly continue to show
that a majority of arrestees in our major cities continue to test positive
for a variety of drugs -- and that more resources are needed to test,
treat and sanction these offenders. Against this backdrop, the President
could release $27 million in drug court grants for 150 localities to
implement or enhance specialized drug courts.

FOOD AND DRUG ADMINISTRATION, AND RELATED AGENCIES
APPROPRIATIONS BILL, FY
1999

This Statement of Administration Policy provides the
AdministrationD,s views on the Agriculture, Rural Development, Food and
Drug Administration, and· Related Agencies Appropriations Bill, FY 1999, as
reported by the House Appropriations Committee. Your consideration of the
AdministrationO,s views would be appreciated.
The Administration appreciates efforts by the Committee to
accommodate the PresidentD,s priorities within the 302(b) allocation.
The
PresidentD,s FY 1999 Budget proposes levels of discretionary spending for
FY 1999 that conform to the Bipartisan Budget Agreement by providing
savings through user fees and certain mandatory programs to help finance

discretionary spending.
In the recently enacted Transportation Equity
Act, Congress -- on a broad, bipartisan basis -- took similar ~ction in
approving funding for surface transportation programs paid for with
mandatory offsets. We want to work with the Congress on
mutually-agreeable mandatory and other offsets that could be used to
increase high-priority discretionary programs, including those funded by
this bill.
In addition, we urge the Congress to adopt the user fee
proposals included in the presidentO,s budget, which would enable over
$600 million to be directed to important initiatives such as those
proposed for food safety, nutrition programs, rural development, and
conservation.
Below is a discussion of our specific concerns with the
Committee-reported bill. We look forward to working with you to resolve
these concerns as the bill moves forward.
Civil Rights
The Administration strongly supports the provision made in order in the
rule that waives the statute of limitations for individuals who have
previously filed a discrimination claim against USDA. The President is
personally committed to righting any wrongs committed by USDA employees in
years past, and a great many individuals who were discriminated against
will have no recourse unless the statute of limitations is waived for them.
In a number of areas, the Committee has reduced funds to assist
the most needy farmers and members of the rural community. The Committee
has not provided the requested increase for the Outreach for Socially
Disadvantaged Farmers program, which was a key recommendation of the Civil
Rights Action Team (CRAT) report last year. With the additional $7
million requested, USDA could support 35 projects to assist 10,000 small
family farms and stem the continuing reduction in the number of minority
farmers and ranchers.
Another recommendation in the CRAT report is to increase the
amount of farm ownership loans, a portion of which are targeted to
minority and beginning farmers.
The Administration urges the House to
shift the $1 million in unrequested subsidy increase provided in the bill
for boll weevil eradication loans to the farm ownership program, which
would permit another 140 limitOed-resource farmers to finance real estate
purchases.
Food Safety Initiative
The Administration is deeply concerned that the Committee has not
fully funded the PresidentO,s request for Food and Drug Administration
(FDA) and USDA activities to enhance food safety, providing only $16.8
million out of the $101 million the President has requested for these
activities, $96 million of which is requested in this bill.
American
consumers enjoy the worldO,s safest food supply, but too many Americans
get sick, and in some cases die, from preventable food-borne diseases.
The PresidentO,s budget increase would expand food safety research, risk
assessment capabilities, education, surveillance activities, and food
import inspections. The Administration wants to work with the Congress to
explore user fee options within FDA and USDA that can be used to offset
the cost of the needed increases in these programs as well as provide
funds to further modernize the meat and poultry inspection system.
Women, Infants, and Children

The Committee bill would freeze funding for the Special
Supplemental Nutrition Program for Women, Infants, and Children (WIC) at
the FY 1998 level of $3.9 billion, $157 million below the PresidentD,s
request. This would only support a participation level of between 7.3 and
7.4 million women, infants, and children, and, based on FY 1998 year-end
projections, would mean cutting off over 100,000 needy participants from
the program. The PresidentD,s request would maintain participation at 7.5
million, fulfilling the bipartisan commitment to fully fund WIC. The
Administration strongly encourages the House to fund WIC at the
PresidentD,s requested level.
Arms Export Control Act Modification
The Administration supports section 737, which will ensure that
American farmers can continue to export wheat and other commodities to
India and Pakistan through USDA export assistance programs. As the
President recently announced, in the sanctions the U.S. is applying toward
those countries, we are attempting to minimize the humanitarian impact on
their people.
Cutting off the supply of U.S. wheat would only hurt the
citizens of Pakistan and India, as well as American farmers, without
furthering the goal of nuclear nonproliferation. The Administration urges
adoption of this provision.
Rural Development Funding
While the Administration supports the funds provided for the Rural
Community Advancement Program (RCAP), the Administration strongly objects
to the CommitteeD,s blocking the mandatory Fund for Rural America from
being used in FY 1999. The Fund provides additional resources for rural
development and innovative agricultural research that are vitally needed
to improve the quality of life in rural America and increase the
productivity of U.S. farmers.
The intent of Congress in creating the Fund
in 1996 was to boost the overall Federal investment in these activities,
not to offset discretionary spending in them.
Furthermore, Congress
recently extended the authority for the Fund while increasing its
resources.
The Administration urges the House to strike this provision.
In addition, for the RCAP program to be adaptable to unique local economic
development needs, as envisioned in its 1996 Farm Bill authorization, the
House should strike the CommitteeD,s limitation on the flexibility to
transfer funds among programs and allow the program to be implemented as
authorized.
Food and Drug Administration
The Administration strongly urges the Congress to provide the full
$1,251 million in resources to fund the program level proposed for FDA in
the PresidentD,s budget. The Administration is deeply disappointed and
concerned that the Committee has not funded the PresidentD,s request for
FDAD,s tobacco enforcement activities. This funding is vital to the
AdministrationD,s plan to reduce youth smoking. CongressD, failure thus
far to pass comprehensive tobacco legislation should not prevent the
Committee from providing adequate resources for these critical public
health activities. We will work with the Congress to develop the
appropriate means of funding.
Climate Change and Clean Water Initiatives
The Committee has not provided any of the $7 million increase
requested for additional research as part of the Administration's Climate
Change Technology Initiative .. These funds would support high-priority

research to reduce emissions of greenhouse gases caused by agricultural
practices, develop improved feedstocks that can be used to generate
energy, and improve techniques to convert agricultural products to
biofuels.
The Administration urges the House to provide the necessary
funding.
The Committee also has not included the Administration:.l, s
requested increase of $23 million for the Natural Resources Conservation
Service (NRCS) to implement the PresidentO,s Clean Water Action plan to
help State and local organizations hire watershed coordinators, document
baseline conditions, and target resources to farmers requesting
assistance.
The Plan, developed by USDA and EPA, outlines a strategy on
how to address water quality problems, including polluted runoff, in
watershed areas across the Nation.
The Administra~ion urges the House to
provide these necessary funds to the NRCS.
Agricultural Research
The Administration strongly objects to the CommitteeD,s
elimination of the $120 million in competitively-awarded research funds
authorized in the Agricultural Research, Extension, and Education Reform
Act of 1998. These funds will finance vital investments in food and
agriculture genome research, food safety and technology, human nutrition,
and agricultural biotechnology. At the same time, the Committee bill
includes over $50 million in unrequested earmarks for lower-priority
research while funding competitive grants through the National Research
Initiative (NRI) at $30 million below the PresidentD,s request. This
systematic rejection of additional funds for competitive research grants
for. national and regional priorities, in favor of earmarked grants for
more local or industry-specific requests, would slow progress toward
addressing the most pressing needs of American agriculture and food
consumers, and we urge the House to reverse this .course of action.
The
House can do so not only by reducing earmarked grants in the bill, but by.
reducing the $25 million in unrequested increases for the Agricultural
Research ServiceD,s buildings and facilities program.
A task force'
created by the 1996 Farm Bill to review the NationD,s agricultural
research facilities comprehensively is due to report to Congress next
year, and further construction should be minimized until the
Administration and Congress have had the opportunity to review the report.
Other Issues
The Administration strongly opposes an amendment that may be offered
mandating peer review of "scientific data" supporting final regulations.
The Administration supports the peer review process for rule-making.
However, this amendment is not needed -- peer review is currently
incorporated in the Government-wide rule-making process through public
comment and scientific advisory boards.
This amendment as drafted would
impose an additional step in the review process and would cover a large
number of rules, as diverse as meat and poultry inspection rules, country
and product-specific quarantine rules, and the Animal and Plant Health
Inspection Services annual fee regulations. This would impose an undue
burden on numerous final rules by requiring substantial personnel and
other resources and could result in significant delays on important public
health and safety rules.
Additional' funds are needed for the farm labor housing program to
improve the living conditions many farm labor families endure. The
CommitteeD,s $20 million in direct loans is more than 35 percent below the
AdministrationD,s request and would mean that 230 fewer housing units

would be built compared with the request.
In addition, the Committee
provides $69 million, or seven percent, less than requested for
single-family housing direct loans, which would keep 1,300 fewer
low-income rural families from achieving the dream of homeownership and
the ability to live in safe, decent, affordable housing.
The
Administration urges the House to increase funding to assist these needy
members of our society.
The Committee bill includes a $10 million reduction to the
PresidentO,s request for the mandatory Emergency Food Assistance Program
(TEFAP), which purchases commodities for individuals greatly in need of
assistance.
Given reported increases in need for food assistance through
food banks and soup kitchens, the Administration is concerned that this
reduction from the authorized level would mean less food will reach the
most vulnerable Americans.
The Administration objects to section 722 of the Committee bill,
which would limit Executive Branch review of USDA responses to
congressional inquiries.
Congress expects the Administration to be
responsible for agency activities. This provision erodes that
responsibility and is contrary to the widespread congressional view that
more, not less, accountability is needed for improved management results.
The Administration urges the House to delete the provision.
The Administration strongly objects to the Committee billO,s
provision that provides funding for research on nutrition programs only
within the Economic Research Service.
It is important that research on
nutrition programs also occur in the context of the prograffiO,s
administration, and the Administration urges the Committee to provide
funding for these activities within the Food and Nutrition Service, as
requested and as included in the Senate version of the bill.
The Committee has provided only $2 million of the requested $22
million increase for the Inspector General as part of the
AdministrationO,s law enforcement initiative. This USDA initiative would
save taxpayers millions of dollars lost through fraud in the food and
nutrition programs, in,USDA disaster, multi-family housing, and other
programs, as well as improve the integrity of USDA programs. The
Administration urges the House to increase funds for this important
ini tiati ve.
