REMARKS ON TOBACCO [AND HIGHWAY] LEGISLATION
THE WHITE HOUSE
May 19, 1998
Good afternoon.
I have recently returned, as you know, from
Europe, where I worked to forge new economic ties with the other leading
industrial nations of the world.
It was a very productive trip.
It made
clear once again that America is indeed the indispensable nation.
In
Europe, as in the rest of the world, we are working to open markets while
maintaining the highest standards on labor and the environment.
I have just met with my advisers to discuss ways to make this week
every bit as productive as the last one.
Congress goes on recess this
Friday. There is a lot of work to be done between now and then. We
should not let a day pass without moving closer to accomplishing
it--without passing [a highway bill that safeguards our balanced budget
and our values, and] comprehensive tobacco legislation that protects
AmericaD,s children.
This is what Americans want from us: they want both branches of
their government to put politics aside and come together on our most
pressing national concerns. They want us to maintain fiscal discipline
while investing in our people.
For five and a half years, this economic
strategy has been working--building the most competitive economy in the
world and the strongest in a generation. We are living in an American
economic renaissance.
This is a moment of great opportunity in America, and great
bipartisan potential on Capitol Hill.
In the Senate, it is a week of
decision.
We stand on the verge of one of the greatest public health
achievements in history--a historic triumph in our fight to protect
~erica[],s children from the deadly threat of tobacco.
I have said I
would support any comprehensive, bipartisan bill that meets five
principles, and this legislation does so emphatically: it raises the price
of cigarettes and penalizes companies that sell to kids; it reaffirms the
FDAD,s authority to regulate tobacco products; it stops tobacco companies
from marketing to children; it further our other public health goals; and,
as I pledged in Kentucky, .it protects tobacco farmers and their co
mmunities.

The Senate Commerce Committee has passed, by an overwhelming
margin, a measure proposed by Senator McCain. My administration has
worked closely with them in recent weeks to address 'some concerns I had
about the legislation. Those concerns have been fully addressed.
Senator McCainC,s bill represents American,s best chance to
protect our children from the scourge of teen smoking. The legislation is
It is fair.
I strongly support it, and Congress should pass it
tough.
I would be proud to sign it.
without delay.
I want to comment on one other aspect of this bill--the provision
for liability.
I have always said that fair liability protection could be
part of an effective bill; and legislation like this stands a far better
chance of compensating victims of smoking-related diseases than years of
protracted--and possibly fruitless--litigation.
The liability provision
in the McCain bill is limited, it is fair, and it is essentially the same
as the provision in the Chafee-Graham-Harkin bill, which I had pledged to
support. Most important, .it contains the incentives necessary to ensure
that tobacco companies stop marketing cigarettes to children.

This is a pivotal moment.
By weekD,s ~nd, this Congress can build
a lasting legacy, a monumental achievement. The stakes, too, are
monumental--the stakes are AmericaD,s children.
Our efforts have never
been about the size of the prize we can extract from the tobacco
industry.
They are about fulfilling our responsibility to our
children--as parents, as a government, and as a nation.

adjourns, must take the next, crucial step--toward a healthier, stronger
America in the 21st century.

The Senate just voted in favor of the Abraham bill 78-20.
Both Kennedy
amendments (recruitment and no-layoff attestations) were defeated. A
manager's amendment that included a training provision that authorized
demonstration programs that sound like Regional Skills Alliances, funded
through Title IV of JTPA, was also accepted.
The House Judiciary Committee is marking up the Smith bill Wednesday
morning.
Our letter is in circulation and includes a recommended veto
from the Secretary of Labor if the bill's reforms are weakened or if the
bill is not modified to include a training provision.

I know that tomorrow's suspension calendar for the House is hardly the
most pressing thing around here right now, but I suggest we don't "take
the bait" being offered to us by the R's -- and oppose two bills that will
pass overwhelmingly. They are:
(1) H.R. 3718 -- We should send no SAP on this bill to prevent federal
judges from releasing prisoners early.. While this is a bad piece of
legislation, we have a strong record in this area and shouldn't send up a
SAP in simple opposition that might undermine our record.
Besides,
according to Peter, this is not likely to move in the Senate anytime soon,
so we'll have some time to think about our position.
(2) H.R. 3809 -- Can't we find a way to be more supportive for Custom's

role in fighting Drugs at the Southwest Border? Opposing this bill
because it undermines collective bargaining and calls for more overtime,
while a legitimate concern, only feeds the R's argument that we're not
serious about fighting drugs at the Border.
Besides, you may want to
double-check w/Rahm, but last I heard the President was very eager for us
to focus more on the border, drugs, technology, and I'm not sure he'll
want to oppose the R's Drug-Free Borders Bill.

President Clinton Has Restored Fiscal Discipline to Washington. In 1993, President Clinton
inherited a budget deficit of $290 billion; thanks to the landmark budget packages of 1993 and
1997, this year President Clinton will deliver a budget in surplus for the first time since 1969.
That fiscal progress has helped spur an investment-led expansion, creating more than 15 million
new jobs and bringing unemployment to its lowest level in a generation. The President's 1999
budget builds on that legacy by facing up to our next fiscal challenge -- the retirement of the baby
President Clinton's budget
boom generation -- and by preparing us for the new century.
reserves the entire surplus until Social Security is strengthened, provides targeted tax cuts -- that
are fully paid for in his balanced budget -- to help families afford child care, to spur school
construction and expand pension coverage, and makes major investments in education and health
research.
The House Republican Budget is a Return to the Irresponsible Budgets of the 1980s. The
latest House GOP budget is as deeply flawed as the budgets of 1980's that were built on rosy
scenarios and unrealistic savings. It assumes billions of dollars in savings, but doesn't explain
what initiatives will be hit. It is time for the Republican leadership to tell the American people
where they'll cut and how much. Will Medicare be first or Head Start? Student loans or tax
cuts for the working poor? Cancer research or environmental clean-up? When the details are
on the table, we believe the American people, and Members of both parties in Congress will
roundly reject this budget, because it does not square with their values.
The House Republican Budget Takes Us in the Wrong Direction. While the President's
budget moves the country forward, the new House Republican budget represents a step
backwards to the divisive budgets of 1995. That budget no longer spells out the details of the
dramatic cuts it relies on, but the initial GOP proposal made its targets perfectly clear. We are
hopeful that even most Republicans will choose not to support a budget that could end up cutting
education and Medicaid, raising taxes on working Americans, and sending 50,000 young people
doing service in their communities home for the year.
The House Republican Budget Breaks Last Year's Promises. Exactly one year ago
Democrats and Republicans reached the historic Balanced Budget Agreement. Both parties made

concessions to reach a deal setting a schedule to bring the budget to balance, with Democrats
extracting' guarantees that many key domestic programs be protected. Just one year later the
House Republican Budget would break these promises, including a pledge to protect funding for
the earned income tax credit which helps the working poor, for food stamps, for the Head Start
program, for bilingual education, and for the clean-up of Superfund sites.
The House Republican Budget Could Lead to Across-the-Board Cuts. This House
Republican Budget is the second version issued, after the first budget plan was quickly
withdrawn due to harsh objections over its intention to abolish key domestic programs. In
the second version, House Republicans deliberately have chosen to avoid revealing the
details that show which programs they will undermine or eliminate in order to pay for
their budget. However, there's no escaping that this plan requires them to violate the
bipartisan spending cap agreement and threatens virtually all key domestic investments. If
the House Republican budget were ever agreed to and the Appropriations Committee
implemented it across the board, it would:
•
Undermine food safety by eliminating an estimated more than 1000 meatand
poultry inspectors. This budget would also create major delays in the drive to
modernize the federal inspection system, including upgraded lab testing for
harmful pathogens in the food supply.
•
Threaten public health by reducing funding for the Centers for Disease
Control by more than $800 million in five years, cutting childhood
immunization funding and breast and cervical cancer screening.
•
Deny training initiatives for 1.3 million dislocated workers over 5 years.
•
Hamper efforts to protect the environment, by slashing funds for initiatives
to combat climate change, designed to reduce greenhouse gas emissions, cut
energy usage, and save consumers' money. Jeopardizes the safety of
drinking water and food supply by cutting funds meant to clean up factory
farm pollution.
Delay environmental cleanup, by freezing funding for the clean up of
•
Superfund sites, seriously delaying the completion of work and jeopardizing
the public health of those living nearby.
The House Budget Fails to Fund the Highway Bill. The House highway bill, which includes
billions of dollars in excessive levels of funding, is ignored in this budget so it ends up not
accounting for what's actually happening in Congress. When it's actually accounted for, the
high cost of the House highway bill could put even more pressure on critical priorities, such as
education, law enforcement, and the environment.

The earlier House Republican budget, also authored by Chairman Kasich, has threatened to
reopen the old wounds that were part of the battle leading to the government shutdown in 1995.
Again, the Republicans said they wanted to terminate or significantly reduce funds to run the
Americorps volunteer program, for community banking and economic development, for legal
services to the poor, and for bloc grants to public schools which fund safety and anti-drug
programs. These cuts were unacceptable in 1995, as the government shutdown showed, and
they are unacceptable today. For now, Republicans have pulled back this budget with its
detailed cuts, but they haven't explained where they'll find the money instead.
A list of the specific cuts the Republicans outlined is instructive. It shows how far the
Republicans would go, in order to pay for the budget they want.
•
Cutting Health Care Coverage for Poor Americans. The House Republican budget
relies on major entitlement savings that are now unspecified. But the first draft of the
GOP budget actually eliminated a major portion of the federal Medicaid guarantee for
those savings. Eliminating the guarantee of acute care is a major step backwards -- an
old idea that was resoundingly rejected in 1995. Our bipartisan goal should be to expand
health coverage and make it more secure, not to reduce insurance coverage.
•
Backtracking on Welfare Reform. The first House GOP budget backed away from a
fundamental bipartisan tenet of~elfare reform: encouraging work. The budget would
undermine our efforts to encourage and reward work:
•

Raises taxes on 3.5 million low income working Americans -- President
Clinton believes that Americans who work hard, pay payroll taxes, and play by
the rules should not have to live in poverty. The first House GOP budget
eliminated the Earned Income Tax Credit for single adults over 24 years old with
no children earning less than $10,000, hitting them with an average tax increase of
$192. These are people who work hard and pay payroll taxes, and the President
believes that they should not be taxed into poverty.
Weakens Welfare-to-Work. The Republican budget eliminated $1.5 billion of
Welfare-to-Work grants that were part of the Balanced Budget Agreement. Last
year, we reached bipartisan agreement to provide resources to communities to
help. provide job opportunities for the hardest-to-employ welfare recipients.
Zeroing out next year's funding would result in eliminating job training and
job finding assistance intended to lead to self sufficiency for some 300,000
welfare recipients.
Punishes Those Trying to Move Off Welfare. Undoes the Balanced Budget
Agreement by cutting food stamps for those willing to work but unable, through no
fault of their own, to find employment. This cut could also represent a cost shift to

States and localities, who would be left with the burden of providing emergency food.
assistance for these people.
•
Cuts or Eliminates Important Investments in Education. The first House GOP
budget cut education, training, and social service programs by billions of dollars. Some
of the targets include:
•
Denies aid to one million college students who want to work for their
education. This GOP budget eliminates the Work-Study and other
campus-based aid programs.
•
Cuts off the promised investment in technology literacy. This five-year, $2
billion investment is now in its third year. The GOP budget would end this
effort.
•
Eliminates help for children who need to learn English, by eliminating the
primary program for innovative local efforts for training teachers and aiding
children who are not proficient in English. This budget would deny that
opportunity to 1.4 million students, and would prevent more than 4,000 teachers
from being trained.
•
Pulls the rug out from state and local School-to-Work efforts. The GOP
budget eliminates the School-to-Work program before it has finished its job
helping States and localities improve education through strong partnerships with
business.
•
Turns Title I into a voucher program. Since the reforms Congress enacted in
1994, Title I has begun to tum around low-achieving schools and raise academic
standards in high poverty communities. Turning Title I into a voucher program
will reverse efforts already underway to improve public education in these
communities.
•
Discourages Service. The House Republican budget undermines our effort to encourage
community service, by eliminating the successful Americorps program. Some 50,000
Americans would not have not have the opportunity to provide service to their
communities and earn funds for college. These participants would have leveraged
hundreds ofthousands of volunteer tutors for the America Reads program.
•
Dismantles the Commerce and Energy Departments -- The first House budget plan
proposed eliminating the Departments of Commerce and Energy. These cuts would
undermine our weather prediction capability, reduce civilian hi-tech research, and
eliminate economic assistance to needy communities.
Reduces the credit and investment capital available in distressed communities. The
first GOP House budget eliminates the Community Development Financial
Institutions Fund (CDFI). The Fund supports a network of CDFIs, including
community development banks, credit unions and venture capital funds, which
promote entrepreneurship and help restore neighborhoods.

FDA Proposed Rule on "Off-Label" Uses
We will be concluding review by COB Tuesday of a proposed FDA rule allowing the
dissemination of information on unapproved uses (commonly referred to as "off-label" uses) for
marketed drugs, biologics and medical devices. The proposal implements the off-label
provision of the Food and'Drug Modernization Act of 1997 (FDAMA) which permits
manufacturers to disseminate certain written information on the safety, effectiveness, or benefits
of a product's use that has not yet been approved by FDA. For example, an antibiotic may be
approved by FDA for
use in treating sinus infections but also may be widely used by doctors in treating ear infections -a use not yet approved for that particular drug. The proposal would require that sixty days
before disseminating the information, manufacturers must first submit to FDA for approval a
complete copy of the information and an application seeking approval for the new use.
The proposed rule also sets limits on the types of information that manufacturers can
disseminate: it must be in the form of an unabridged medical journal article and must disclose
that the use has not been cleared by FDA. And, the proposal limits who may receive the
information
doctors and insurance companies, for example, but not individual patients.
This provision was a key Administration concern during FDA reform that was resolved
during the legislative process. The rule adheres closely to that compromise. While it may gain
some attention in the press, we do not expect it to be highly controversial. FDA is anxious to
publish the proposed rule as soon as possible in order to meet a statutory deadline for publication
of a final rule by November 21 st of this year.

I just heard from Eve Maldonado of the California League of Cities. They
are hopeful of Administration support for a compromise they are working on
in the House and Senate today that would protect the right of five local
juristictions to continue their Tobacco litigation: San Francisco, Los
Angeles, NYC, Cook County, and Erie County. While they would like to
retain the ability for all local jurisdictions to sue, they seem inclined
to settle for protection of these suits to procede. Eve says Mayor Willie
Brown is looking to talk with someone today. I asked that he start with
Lynn.

Dear Senator Ford,
Last September, when I announced my plan for comprehensive tobacco legislation,
made protecting tobacco fanners and their communities one of the five key elements that must be
at the heart of any national tobacco legislation. Tobacco legislation must reduce youth smoking,
it must not devastate our tobacco fanners and their communities.
The tobacco program has made it possible for fanners, their families, and communities to
enjoy a measure of economic stability. If the program is abolished, many fanners, particularly
small and minority fanners, will be left in jeopardy and many will be put out of business.
Senator Ford, your proposal, which is included in Senator McCain's comprehensive tobacco
legislation, includes vital protections for fanners and their communities including continuing a
tobacco control and price program. Your proposal satisfies the principle I laid out in September
1997, demanding that any legislation meet the test of protecting tobacco fanners and their
communities.
It is possible to protect tobacco fanners and their communities, at the same time that we
dramatically reduce youth smoking. Indeed, maintenance of the tobacco program makes it
possible to control the amount of tobacco grown in the United States. I am confident that with the
inclusion of your provision in comprehensive tobacco legislation, we will meet the goals of
advancing public health interests and protecting fanners and their communities.

Elena,
We had a meeting last week with Peter and folks from INS to discuss
legislative strategy. Here is where we stand:
1.
Alan Erenbaum (INS) gave us a draft of the legislation.
Peter,
Leanne, Steve and I are looking it over.
It looks pretty general;
codifying the outline of our plan.
I will forward you a copy of the draft.
There is one issue remaining: whether the legislation should
include a provision for inspectors to become equivalent (pay and benefits)
to other federal law enforcement officers. As you recall, OMB stated last
March that this would be very expensive and not possible to do in the
first wave of our reform efforts.
INS is insistent that this is a
necessary building block for the reform. Alan is going to let us know by
mid-week what their final position is on this (if they have come up with
off-sets; whether they need "law enforcement" parity or could begin with
parity with Customs, etc.) We may need to pull a meeting together with
you, Doris and Michael to finalize how we will move forward.
2.
According to Abraham's staff, he wants to hold hearings starting
in mid to late June, with a second before the August recess and possibly a
third in September. They would like to schedule one hearing each to
discuss services and enforcement. Abraham might introduce his legislation
sometime in September.
Our plan is to have our legislation introduced (they are talking
to Watt and Kennedy) as soon as Congress returns from the Memorial Day
break -- prior to when Abraham will hold his first hearing.
3.
Doris is testifying at the House Judiciary Subcommittee on
Immigration on Thursday on INS reform.

Federation -- she will be supportive); Richard Gallo (from a Federal Law

Jeff Goldberg is working on ·a cover story on the tobacco companies for the
magazine that might run on June 14 or June 21.
He's looking to complete
work on it by the beginning of June. The piece is on how the industry
faces the legislative process and the entire political process -- public
hostility, etc.
He'll have interviews with most or all of the CEO's.
He wants to interview folks around here, and I gave him a few names, but
what he wants most is to talk to the VP.
Seems like a good piece for him to be in.

Dear Mr. Chairman:
I am writing to express my strong objections to H.R. 3248, the
"Dollars to the Classroom Act," which would convert a wide array
of Federal education programs to block grants. The President
stated last fall that such a step is unacceptable, and that he
would use his veto power to prevent this approach from becoming
law.
If H.R. 3248 were presented to the President, I would
recommend that he veto it.
Block grants would halt many of our most successful efforts to
improve education, including our efforts to raise educational
standards, make computers available in every classroom, and keep
our schools safe and free of drugs.
H.R. 3248 could also
seriously harm the ESEA, Title I program, which provides extra
help to low
o
-income students ·so that they can master the basic
skills of reading and math, paving the way for them to reach high
academic standards.
The American people rightly look to the Federal Government to
focus its efforts not on general aid to school districts, but on
national priorities, such as improving educational opportunities
for poor children and other children with special needs,
combating youth drug abuse and school violence, and researching
and disseminating information on what works. This Administration
has worked diligently to eliminate unnecessary regulations and
take other steps to promote State and local flexibility in
carrying out these targeted efforts, while supporting strong
accountability mechanisms, such as the Government Performance and
Results Act of 1993, that ensure program effectiveness and
results and that justify continued support by the taxpayers.
Block grants would replace these worthy efforts with general aid,
providing no focus, no accountability for results, and no
rationale for ongoing support.
The issue here is not about who controls public education -- we
all agree that that responsibility rests at the local and State
levels. The question, rather, is whether the Federal Government
will maintain its long
[J
-standing, bipartisan commitment to helping
local communities strengthen accountability, raise standards, and
improve student achievement, by providing assistance that focuses
on our neediest children and schools and on activities in which
national leadership can playa critical role.
The Office of Management and Budget advises that there is no
objection to the submission of this report from the standpoint of
the Administration's program and that enactment of H.R. 3248
would not be in accord with the President's program.

The S. 1415, the Tobacco bill is pending.
The Majority Leader, on behalf of the Commerce Committee Chairman,
modified the committee substitute, to include the so called manager's
amendment and incorporate the Finance committee reported amendments.
He then, further modified the committee substitute to delete several
Finance committee amendments.
He then further modified the committee substitute to incorporate the
Lugar amendment regarding tobacco farmers.
The pending committee substitute as further modified contains the
following:
* Manager's amendment
* All of the Finance Committee reported amendment except:
- the $1.50 increase;
- Title 14 w/respect to declaring the price·increase a tax
increase;
- three deletions w/respect to the Leaf Act;
- the Look Back Compliance Fund; and
- the Tobacco Trust Fund
* the Lugar amendment regarding tobacco farmers.

The House is expected this week to consider a measure (HR37l8),
introduced by Majority Whip Tom DeLay, R-Texas, that aims to stem early
releases of felons from federal prisons.
The bill has already been offered on the House floor, and was
adopted 367-52 as an amendment to broader judicial overhaul legislation
(HR1252) in April. It is scheduled to be considered tomorrow under
suspension of the rules, an expedited floor procedure usually reserved
for non-contentious legislation.
The measure would essentially eliminate the power of federal judges
to release convicted felons because of the facility's conditions. On the
House floor, DeLay blamed activist judges for allowing the average
violent offender to serve only 40 percent of his or her sentence.
Some Democrats objected to the DeLay language, saying it was too
broad and would not allow non-violent felons to be released and that the
measure would eliminate judicial discretion on a prisoner's early
release because of abuse by officials.
Democrats also objected on the floor that the measure would abrogate
consent decrees reached between courts and prisons. Such agreements
usually occur to correct civil rights violations in federal prisons due
to poor conditions and overcrowding. Democrats say the bill would
restrict already agreed-upon remedies.
Despite the Democratic criticism, a GOP leadership aide said he was
not worried about any waning of minority support because to oppose the
bill would be "an indefensible vote back home."

The states and counties do well in the current Senate tobacco bill. NGA
and individual Governors will be writing letters of support, and of
course, the Attorneys General are very engaged in the Hill effort.
I think we should more to engage them.
I believe we should consider
inviting the NGA Exec Committee to the White House for a meeting on the
bill with the President and Vice President. We might include additional
elected leadership such as the Attorneys General and the national
leadership of the Counties (NACO).

OPM has previously
advised of their view that as a prohibited personnel practice, sexual
orientation discrimination claims have some remedies through the Merit
System Protection Board and the Office of Special Counsel as it now
stands, so they certainly wound not have any less after the EO. That's the
answer I think we needed to proceed.
Bruce, you told me you thought we should do this the last week of May,
after Congress goes out.
I'd iike to raise with John P. the timing of
this for next week.
You will recall that when we last visited this, the
agreement was that we would do it in April or May.

Nearly 35 years ago -- some two decades before most of the children here were even
born -- the Surgeon General of the United States sounded an alarm that has only grown louder,
clearer and more difficult to ignore with every passing year. The warning: Smoking kills.
And for more than a generation, Americans of all ages and all walks of life have
answered that alarm -- fighting tirelessly to conquer this deadly threat and protect the health of
our people. In the face of some very powerful opposition, our nation has won victories both
large and small -- requiring all cigarette packages to carry warning labels ... prohibiting cigarette
advertising on the airwaves ... banning smoking on domestic flights ... making all
federally-funded facilities that serve children smoke-free.
Today, we stand on the verge of our greatest triumph yet against the scourge of tobacco -a triumph that could save millions of our children's lives and become the one of the greatest
public health achievements in the history of our nation.
This week, the Senate is considering historic comprehensive, bipartisan tobacco
legislation, proposed by Senator McCain and passed overwhelmingly by the Senate Commerce
Committee. I believe this bill is America's best chance to protect the health of our children, to
keep them from ever getting hooked on cigarettes in the first place. I have said I would
support any comprehensive, bipartisan bill that meets five principles, and this legislation
does so: It raises the price of cigarettes and penalizes companies that sell to kids; it
reaffirms the FDA's authority to regulate tobacco products; it stops tobacco companies
from marketing to children; itfurthers our other public health goals; and it protects
tobacco farmers and their communities.
Over the past few weeks, my administration has worked with Congress to strengthen this
bill even further -- toughening penalties against tobacco companies who fail to reduce teen
smoking, raising the liability cap on legal damages, protecting Americans from dangerous
second-hand smoke in public buildings.
I congratulate every child here for taking responsibility for your own health, for saying
"no" to tobacco and "yes" to brighter futures. I wish you well as you make your voices heard on
Capitol Hill. Now it is time for America's elected leaders to do our part.
The McCain bill is tough, fair, and most of all, it protects our children. It would stop the
Marlboro man from roping in any more of our children -- and keep Joe Camel from tricking them
into lighting up. It ends the unscrupulous marketing campaigns that have targeted our children

-- and robbed them of their futures. So I call upon Congress to stay in session for as long as it
takes to pass this bill. Don't go home until you have given our children bipartisan,
comprehensive tobacco law. They have waited long enough.
Today, here on the South Lawn, stand America's future. For years, the 'tobacco
companies have looked upon these children and seen the "replacement smokers" of the 21 st
Century. But I see 1,400 unique, irreplaceable children with unlimited potential. I see the
scientists and artists; the teachers and Olympic champions; the engineers and leaders of the 21 st
Century. Everyone of us has the responsibility to make sure these and all children across
America have the opportunity to live out their dreams and fulfill their greatest, God-given
potential. That is why we must pass this bill.
Let the children standing here be the final, triumphant generation of young leaders who
fought to protect future generations from tobacco. And let this Congress be the Congress that
saved their lives.

<p>Elena Kagan worked as Associate White House Counsel from 1995-1996 and Deputy Assistant to the President for Domestic Policy and Deputy Director of the Domestic Policy Council (DPC) from 1997-1999.</p>
<p>During her work at the White House Justice Kagan worked on many topics including, but not limited to: AIDS, budget appropriations, campaign finance reform, education, health, labor, race, tobacco, Native Americans, and welfare.</p>
<p>In 1999 President Clinton nominated Kagan to the U.S. District Court of Appeals, no hearing was ever scheduled and she was thereby never confirmed.</p>
<p>Note: These records were made available in response to a <a href="http://clinton.presidentiallibraries.us/freedom-of-information-act-requests">Freedom of Information Act (FOIA)</a> request, FOIA 2009-1006-F. This collection contains both records created by Elena Kagan and records concerning Elena Kagan. </p>
