President Clinton's Petition To The Federal Election CommissionTo
Ban "Soft Money"
June 5, 1997
Today, the President petitioned the Federal Election Commission (FEC) to revisit its rules
on "soft money" and act to ban the use of "soft money" in federal elections, as proposed in
bipartisan campaign finance reform legislation now before Congress. The petition proposes to
end the current "soft money" system by requiring that candidates for federal office and national
parties be permitted to raise and spend only "hard money" -- funds subject to the restrictions,
contribution limits, and reporting requirements of the 1974 Federal Election Campaign Act
(FECA). This ban would apply to all political party committees, as anticipated by the bipartisan
campaign fi'nance reform legislation.
"Soft money" and federal elections
"Soft money" plays an increasingly large role in funding political parties and campaigns.
So-called "hard money" contributions are those that are given to candidates or parties subject to
the limits and disclosure of federal law. "Soft money,"on the other hand, goes to national or state
political parties, and can be raised in large amounts and from sources (such as corporations and
unions).
The role of "soft money" has grown dramatically in the past several elections. In 1996,
the Democratic Party raised $123 million, and the Republican Party raised $138 million in "soft
money" -- more than triple the total of four years before.
"Soft money" is today lawful under a series of Federal Election Commission (FEC)
regulations. The FEC first issued advisory opinions on this in 1978. It did not take further action
during the 1980's, as the role of "soft money"grew. In 1990, ordered to take some action on "soft
money" by a federal court, the FEC promulgated regulations that govern how parties can allocate
funds between federal and non-federal activities. (The court deferred to the agency as to may to
address the issue, but noted that the agency could go as far as to ban the use of soft money for
mixed federal- and state-political activity.)
In addition, the 1979 statutory amendments to the Federal Election Campaign Act
(FECA) authorized allocation of national and state "hard money" for joint activities.
President Clinton's support for a "soft money" ban
President Clinton has consistently called for legislation that would ban the use of "soft
money" in federal elections. He called for this legislation during the 1992 campaign, and

�supported the campaign finance refonn legislation, vetoed that year by President Bush, that
would have banned "soft money." The campaign finance refonn plan he proposed in May 1993
included a "soft money" ban; this proposal was passed by both chambers but was killed by a
Senate filibuster in 1994.
The bipartisan campaign finance refonn legislation introduced by Senators McCain and
Feingold and Representatives Shays and Meehan would prohibit the use of "soft money" in
federal elections.
In January, 1993, the Democratic National Committee voluntarily announced that it
would restrict contributions it can currently accept under the law. It would not accept "soft
money" contributions in excess of $100,000 per year, and it would not accept contributions from
individuals who are not citizens or from domestic subsidiaries offoreign corporations.
Contents of the request to the FEC
The President continues to call on Congress to enact the bipartisan legislation to refonn
campaign financing and ban "soft money." In the meantime, he is fonnally requesting the FEC
to act now, under existing law, to write new regulations banning the use of "soft money" to
influence federal elections, as envisioned in the legislation. Specifically, the President is
requesting that the Commission consider new rulemaking to accomplish the following:
•
Prohibit national political parties (and their congressional campaign committees or agents)
from soliciting or receiving any funds not subject to the limitations or prohibitions of
FECA. (This action would preclude, for example, contributions directly from corporate
or union treasuries, or contributions from individuals in excess of the amount an
individual can give to a national party's federal account.)
•
Prohibit any federal officeholder or candidate (and his or her agents) from soliciting or
receiving any funds not subject to the limitations or prohibitions of FECA. (This action
would preclude the same kind of contributions.)
•
Provide that any expenditure by any national, state, or local political party during a federal
election year for any activity that influences a federal election (including any voter
registration or get-out-the-vote drive, generic advertising, or any communication that
refers to a federal candidate) must be paid for from funds subject to FECA. (This would
end the allocation system, currently authorized by the FEC, under which "hard" and
"soft" money are mixed for campaign activities that affect both state and federal elections.)

I am writing to you, pursuant to 11 CFR Part 200, to request that you take action, under
your existing statutory authority, to ban "soft money" and end the system under which both
political parties compete to raise unlimited sums from individuals, labor unions, and corporations.
The rules governing our system of financing federal election campaigns are sorely out of
date. Enacted more than two decades ago when election campaigns were much less expensive,
they have been overtaken by events, by dramatic changes in the nature and cost of campaigns
and the flood of money that has followed them. Today, money is raised and spent in ways that
simply were not contemplated when Congress last overhauled our campaign finance laws. We
must bring the rules up to date to reflect the changes in elections and campaigning that have
overtaken our political system.
An important step in this process would be to change the rules governing the use and
solicitation of funds not subject to the contribution limitations and prohibitions of the 1971
Federal Election Campaign Act, as amended ("soft money"). Currently FEC regulations (11
CFR 106.5) allow political parties to raise and spend "soft money" in elections involving state
and federal candidates by providing an allocation formula between federal and non-federal
expenses incurred by party committees. These regulations, and limited additional guidance
provided through advisory opinions, are the basis upon which party committees make
expenditures and raise funds with respect to federal and state elections today. The use of socalled "soft money" by party committees today is largely based on the direction provided in these
regulations.
Whatever the merit of those regulations at the time they were adopted, it has become
abundantly clear today that they are no longer adequate to the task of regulating current
campaigns. The role of "soft money" has grown dramatically in the past several elections so that
by the 1996 elections the two parties raised more than $250 million; $138 million by the

�Republican Party and $123 million by the Democratic Party, more than triple the total of four

The current allocation system, in short, is simply outmoded. Accordingly, I propose that
the FEC adopt new rules requiring that candidates for federal office and national parties be
permitted to raise and spend only "hard money" -- funds subject to the restrictions, contribution
limits, and reporting requirements of the Federal Election Campaign Act (FECA) of 1971, as
amended.
The "soft money"ban I seek achieves similar goals as provisions of the "Bipartisan
Campaign Reform Act of 1997", introduced by Senators John McCain and Russell Feingold, and
Representatives Christopher Shays and Martin Meehan. Specifically, I am requesting that the
Commission consider new rulemaking to accomplish the following:

election laws to catch up with the reality of the way elections are financed today, and along with
new camapign finance reform legislation, will take significant strides toward restoring public

The current allocation system, in short, is simply outmoded. Accordingly, I propose that
the FEC adopt new rules requiring that candidates for federal office and national parties be
permitted to raise and spend only "hard money" -- funds subject to the restrictions, contribution
limits, and reporting requirements of the Federal Election Campaign Act (FECA) of 1971, as
amended.
The "soft money"ban I seek achieves similar goals as provisions of the "Bipartisan
Campaign Reform Act of 1997", introduced by Senators John McCain and Russell Feingold, and
Representatives Christopher Shays and Martin Meehan. Specifically, I am requesting that the
Commission consider new rulemaking to accomplish the following:
1.
Prohibit national political parties (and their congressional campaign committees or agents)
from soliciting or receiving any funds not subject to the limitations or prohibitions of
FECA. (This action would preclude, for example, contributions directly from corporate
or union treasuries, or contributions from individuals in excess of the amount an
individual can give to a national party's federal account.)
2.
Prohibit any federal officeholder or candidate (and his or her agents) from soliciting or
receiving any funds not subject to the limitations or prohibitions of FECA. (This action
would preclude the same kind of contributions.)
3.
Provide that any expenditure by any national, state, or local political party during a federal
election year for any activity that influences a federal election (including any voter
registration or get-out-the-vote drive, generic advertising, or any communication that
refers to a federal candidate) must be paid for from funds subject to FECA. (This would
end the allocation system, currently authorized by the FEC, under which "hard" and
"soft" money are mixed for campaign activities that affect both state and federal elections.)
These steps, available to you under your existing statutory authority, will enable our
election laws to catch up with the reality of the way elections are financed today, and along with
new camapign finance reform legislation, will take significant strides toward restoring public
confidence in the campaign finance process.

I much prefer creating just the advisory board -- not the whole initiative
-- by eo. Only two other questions: (1) can we take out the word crime in
Sec. 2(4)?--I thought that was included in "the administration of
justice."
(2) I'm not keen on the phrase "increasing understanding of the
myriad perceptions of race" --.1 guess I know what this means, but
improving perceptions about perceptions seems a long way from doing real
things, and so could play into criticisms of this initaitive.

Josh will run a reconciliation conference call with the agencies tomorrow
(Wednesday) at 8:30 am.
PAD offices are responsible for letting their
agencies know about the call and giving t·hem the conference number
(757-2104, code 6162) .
There are only 30 lines open for the call (and 45 people or so calling
in)-- so please do not make individual calls (e.g., DADs should call in
with their PADs, other 2nd floor folks should come to Josh's office,
etc.)
We need to reserve lines for people calling· in from the agencies
(otherwise we're just talking to ourselves).

same schedule as last week -- a conference call Wednesday at 8:30 am
(we'll send out the number later) and a meeting in 248 at 3 pm on Friday,
the 20th.
PAD offices are responsible for informing their agencies about both
conversations.
For the conference call -- we are still confined to too few phone lines,
so please consolidate incoming calls (2nd floor folks should meet in
Jack;s office, DADs in PADs offices, etc.).

�Less than one year ago, my Administration announced an historic rule to protect children
from the hann caused by tobacco products. Two months ago, a court in North Carolina issued a
landmark ruling confinning my decision that the Food and Drug Administration has authority to
regulate tobacco products to protect our children's health. These victories for the public health
drove the tobacco companies to the bargaining table and extracted concessions from them that
would have seemed unimaginable just a short time ago.
I want to commend the attorneys general and other people working with them, including
children's health leaders, for their hard work in negotiating this proposed agreement. They have
devoted great time and energy to continuing our struggle to protect the health of children, and
they deserve our thanks for doing so.
We must now carefully consider whether approving this proposed settlement will protect
the public health -- and particularly our children's health -- to the greatest extent possible. Until
now, we have not had the opportunity to review the actual terms ofthe agreement, and we have
not concluded whether it is in the best interests of the public health. Over the next several weeks,
we will undertake a thorough public health review. I am asking Bruce Reed, my Domestic Policy
Advisor -- along with Donna Shalala, Secretary of the Department of Health and Human Services
-- to engage in extensive consultations with the public health community and to subject this
agreement to the strictest scrutiny. They will report to me on whether this agreement represents
the best means of protecting the nation's public health interests.
In the meantime, we will fight as hard as ever to ensure that the FDA rule stands. Each
day, 3,000 young people become regular smokers; 1,000 ofthern will have their lives cut short as
a result. Protecting the health of the public and these children will be our measure of this
proposed agreement.

Did the Administration help close the deal?
A.
No. My staff monitored the talks closely so that we would be in a position to evaluate and
respond to any possible settlement. We consistently told the parties that they would have to
close an agreement on their own, and they were able to do so without any help from the
Administration.
Q.
How will you proceed?
A.
I have asked my Domestic Policy Advisor, along with the Secretary of Health and Human
Services, to undertake a thorough public health review of this agreement. They will consult
with all interested agencies, members of Congress, and the public health community.
Q.
How long will the review take?
A.
The review will take as long as necessary to conduct a careful analysis, but we will seek to
work promptly and expeditiously. We expect this to be a matter of weeks, not months.
Q.
Dr. Kessler and Dr. Koop have asked in a letter to you that you give them 30 days to
complete their own review before signing off on anything. Are you going to wait?
A.
I intend to consider closely the views of the public health community, including Drs. Koop
and Kessler, before rendering any judgment on the settlement. But it is premature to commit
to any firm timetable for reaching my conclusion.
Q.
What will you look at in evaluating this agreement?
A.
We will evaluate whether this agreement protects the public health -- and particularly the
health of our children. We will pay special attention to the part of the agreement dealing with
FDA jurisdiction. The actions the FDA has taken under this Administration forced the
industry to the bargaining table, and we will insist that the FDA has all necessary authority to
regulate nicotine and tobacco products. We also will carefully review the financial terms of
the settlement, including whether the money will go toward protecting the health of our
children and the general public.
Q.
The final deal limits punitive damages -- a key concession to the tobacco industry.
Won't you oppose that given your previous opposition to caps on punitive awards?
A.
The limitation on punitive damages for past misconduct is not a deal-breaker for us. We
understand that the attorneys general extracted substantial concessions from the tobacco
companies for this limitation, and we will evaluate whether the agreement as a whole
advances the nation's public health interests.
Q.
Are you taking a political risk in considering approval of this settlement?
A.
This isn't about politics; it's about protecting the public health. We didn't think about politics
when we took on the tobacco companies last year with our announcement of the FDA rule.

�Less than one year ago, my Administration announced an historic rule to protect children
from the harm caused by tobacco products. Two months ago, a court in North Carolina issued a
landmark ruling confirming my decision that the Food and Drug Administration has authority to
regulate tobacco products to protect our children's health. These victories for the public health
drove the tobacco companies to the bargaining table and extracted concessions from them that
would have seemed unimaginable just a short time ago.
I want to commend the attorneys general and other people working with them, including
children's health leaders, for their hard work in negotiating this proposed agreement. They have
devoted great time and energy to continuing our struggle to protect the health of children, and
they deserve our thanks for doing so.
We must now carefully consider whether approving this proposed settlement will protect
the public health -- and particularly our children's health -- to the greatest extent possible. Until
now, we have not had the opportunity to review the actual terms of the agreement, and we have
not concluded whether it is in the best interests of the public health. Over the next several weeks,
we will undertake a thorough public health review. I am asking Bruce Reed, my Domestic Policy
Advisor -- along with Donna Shalala, Secretary of the Department of Health and Human Services
-- to engage in extensive consultations with the public health community and to subject this
agreement to the strictest scrutiny. They will report to me on whether this agreement represents
the best means of protecting the nation's public health interests.
In the meantime, we will fight as hard as ever to ensure that the FDA rule stands. Each
day, 3,000 young people become regular smokers; 1,000 of them will have their lives cut short as
a result. Protecting these children will be our measure of this proposed agreement.

�The Freddie Mac Section 8 Homeownership
Empowerment Voucher Pilot Program
Announcement
Today, Freddie Mac has agreed to help make Homeownership available for up to 2,000
low income people through an innovative program proposed by the Clinton Administration. To
help guarantee the success of the Administration's proposal to permit the use of Section 8 rental
subsidies as Homeownership Empowerment Vouchers, Freddie Mac, in partnership with he
Department of Housing and Urban Development, will participate in a demonstration program to
help provide financing for 1,000 to 2,000 lower-income families to purchase their own homes.
This project will help make mortgage funds available to working, lower-income families across
the country who have demonstrated the ability to manage their finances but have not had the
means to purchase a home.
Background
Under an administration proposal currently awaiting action by Congress, working lowerincome families that qualify for HUD's Section 8 rental housing assistance could instead request
Empowerment Vouchers to help reduce the gap between the amount the family can afford and
the monthly payment on a mortgage.
Under the Freddie Mac pilot program, first-time homebuyers will obtain mortgages for up
to 97 percent of the value of their home, with the Mortgage Guaranty Insurance Corporation
providing private mortgage insurance on the loans. It is anticipated that a reasonable amount of
funds for the down payment will be contributed by the family. The remainder of the down
payment, and other funds necessary to close, may come from state or federal programs, gifts, or
grants. The borrower will contribute a reasonable percentage of his or her income towards
housing costs; the balance ofthe monthly mortgage payment will be provided through the
Empowerment Vouchers. The borrower will receive comprehensive homeownership counseling
before and after the purchase.
Participation by Freddie Mac, a leading secondary market agency, and MGIC, a leading
mortgage insurer, is important because the underlying mortgages to be used with the
Empowerment Vouchers will be originated by private mortgage lenders. These lenders require
mortgage insurance and secondary market investors in order to originate the loans.
President Clinton and HUD Secretary Andrew Cuomo propose to provide responsible
working families with the option of using Empowerment Vouchers because homeownership is an
important component of an urban revitalization strategy. Homeownership encourages selfsufficiency, allows families to develop community ties and support networks, encourages the
formation of household assets, assures continuity of schooling for children, stabilizes distressed
neighborhoods, and equalizes housing opportunities for minorities, whose homeownership rates
are far lower than those of the nation as a whole.

President Continues to Fight to Expand Health Care Coverage for Our Nation's Children
Today the President joined Kaiser Pennanente in announcing that the health plan will give $100 million to
provide health care coverage to up to 50,000 uninsured children in California. Kaiser is responding to the
President's challenge at the Summit on Service, and their initiative complements the President's commitment to
a national effort to extend health insurance.
This President will continue to fight hard to make sure that extending health care coverage to millions of
uninsured children is a top priority in any balanced budget deal. The President fought hard to ensure that
the balanced budget agreement included $16 billion to provide meaningful health care coverage to uninsured
children. The President also supports the action by the Senate Finance Committee to raise a 20 cent tobacco tax
to allocate additional Federal support for children's health.
The President outlined the principles he will use in evaluating children's health initiatives emerging from
the Budget Agreernent. The President is committed to making sure that any investment in children's health
care meets three principles: (1) that coverage is meaningful: from checkups to surgery -- children should get
the care they need to grow up strong and healthy; (2) that coverage is targeted: through grant programs and
Medicaid, this investment should cover as many uninsured children as possible; and (3) that this investment
supplements not supplants coverage: this investment should cover children who do not currently have
insurance -- rather than replace public or private money that already covers children.
The Balanced Budget and the Kaiser announcement build on the President's previous successes in
strengthening health care coverage for children.

Children and the Kassebaum-Kennedy Law. By signing this bill into law, the President helped
millions of Americans -- and their children -- keep their health care coverage when they change jobs.'
•
Children and Medicaid. Throughout his Administration, the President has fought to preserve and
strengthen the Medicaid program; its coverage of about 20 million children, makes it the largest single
insurer of children. The Administration has partnered with states through Medicaid waivers to expand
coverage to hundreds of thousands of children.
•
Children and the Environment. The President signed an Executive Order to reduce environmental
health and safety risks to children by requiring agencies to strengthen policies and improve research to
protect children and ensure that new regulations consider special risks to children.
•
Children and Tobacco. The President has also taken action to limit children's access to tobacco. Each
day about three million children become regular smokers and 1,000 of them will die from a tobaccorelated illness. To reduce this trend, the President issued guidelines to eliminate easy access to tobacco
products and to prohibit companies from advertising tobacco to kids. According to fonner FDA
Commissioner David Kessler, the possibility of a comprehensive, public health oriented settlement with
the tobacco industry could not have come about without the President's leadership in this area.

Children and Immunization. During the Clinton Administration, childhood immunizations have
reached a historic high. The President's childhood immunization initiative expands community-based
educational efforts and makes vaccines more affordable. In 1995, fully 75 percent of two-year olds were
immunized -- an historic high.

We shouldn't do airbags.
Here's the situation.
In about a month, DOT
will issue a rule allowing people to deactivate their airbags.
The
rationale for the rule is that airbages can endanger kids and small adults
in the front seat of automobiles.
But we don't want to convey the message
that these deactivators are a great thing.
Instead, we want to convey the
message clearly that people should install and use these only in rare
circumstances; for many people, they are positively dangerous.
Because
this is a complicated message -- and because the government action here is
not a clean fix (this is a real risk-risk tradeoff) -- and finally,
because the government track record on airbag regulation is not very good
-- we shouldn't try to hype this into a big message event.
I would argue
for a written statement on the day the rule is issued.
