votes would fall.
Community The AIDS advocacy community is pushing vigorously to have the federal ban on
needle exchange funding lifted. The community has .recognized that a lot of political work
needs to be done in Congress prior to removing the funding restrictions, so that a worse outcome
is not realized with a flat ban on funding in lieu of the Secretary's waiver authority. Now that
there's a clear sign that the House Subco:rrllnittee will consider an amendment for a flat ban, there
is heightened interest in having HHS remove the funding restrictions and aggressively defend the
science behind its action on the Hill .
. To that end, some groups are trying to place press questions on needle exchange to you in
conjunction with the USCM resolution on needle exchange....... .

Indicate support for local flexibility in these matters (in keeping with the NGA,
ASTHO, AMA positions)

HHS is in the process of meeting with AIDS advocates, members of Congress,
scientists and others to analyze the data and determine a course of action.Ask the

Just a few comments.
1.
The President is authorized to enter is probably the better
formulation.
If we said nothing, there would be the constitutional issue and the
Executive
branch would view the language as not binding. ~This would bring us,
essentially, back to the "is authorized to enter into negotiations"
position.
2.
In section 101(2) I was surprised that there's no mention of USAID.
We're the largest bilateral donor so you'd expect some explicit
reference to
USAID here.
3.
Under .Governance, in subparagraph (A), I would say "UNAIDS, or" vice
"UNAIDS, and".
4.
Governance, in subparagraph (B), you probably need to put a line ·
through
"be".

Funding.
If you authorize appropriations but do not specify a
fiscal
year (e.g., your option 3), then it's considered a permanent
authorization
against which the appropriators can appropriate funds at any time.
In
other
words, you can authorize appropriations in year one, but if the TF is
not
established until year 3, presumably there would be no appropriation for
it
until then, at which time the appropriations committees could
appropriate
funds in satisfaction of this authorization.
You, then, really don't
need
an effective date for the appropriation of funds.
Just don't include
the
fiscal year language that you've included, for example, in opt.ion 2.
In
option 3, at the very end, probably should be 101(5) rather than 101(4).

I thought I would give you a quick summary of the just-completed
conference call of the PACHA. They have decided, based upon a call
earlier this morning from the COS to Dr. Hitt, to forestall any decision
on a resolution calling for the Secretary's resignation. However, they
have scheduled another conference call of the whole on April 15 to discuss
any progress between now and then, and an executive committee call on
April 20th to determine if the resolution should be reconsidered or
modified.
Concern was expressed about the timing of any decision by the
Administration in relation·to the Congressional recess. We also suggested
to them that they should not publicly discuss any of the specifics of the
message from the cos to Dr. Hitt for fear of giving opponents a head start.
I very much appreciated the call from the COS and think it was very
effective in delaying any unfortunate action by the Council.

Rumor has it that General McCaffrey is going to issue a press release
fairly soon that expresses his opposition to federal funding for needle
exchange programs pending additional research to prove that the programs
do not encourage drug use ( we already have enough data to choke Miss
Astor's pet horse! ) .
At any rate, this would not be helpful in our attempts to find some sort
of solution to this needle exchange problem of ours. The General's
throwing down the gauntlet and starting a public, cabinet level hissing
match would be rather nonproductive ( not to mention in bad taste ) .
Any chance that you can put the kibosh on this?
In the mean time, if you have any comments on the memo we prepared for
Erskine please let me know ...... and I am sending you a little note
regarding my ongoing concerns about including a law enforsement component
in whatever needle exchange proposal we come up with ( realizing that I am
clearly in the minority on this issue ) .

As you know, Scott Hitt and I met with Erskin~ ( and supporting cast
last week to discuss the-Advisory Council's report. The conversation
focused on Medicaid expansion, needle exchange, and support for our
office. I think it was a productive meeting. Scott certainly felt better
after having an opportunity to vent.

Erskine committed to requesting a meeting with the President for the
Council (but did not commit to a'time frame) and to having us work on a
strategy on needle exchange. No big surprises. However, in ·our
conversations after Scott departed, the notion of including some sort of
law enforcement piece in a compromise was brought up again, and once again
I voiced my strong opposition. I ran the idea past. McCaffrey last week and
he. whole heartedly agrees that it would won't work for his constituents
or mine. I was delighted that we agreed on something!
As an alternative, we might want to consider a compromise that includes
some combination of certifying the existing science ( to give existing
programs the imprimatur they need ) , call for additional research on the
link between needle exchange and drug treatment ( to make the General
happy ) , and extend the moratorium on the use of funds until the research
is complete ( to pacify the Congress and buy us time to get through
whatever elections, confirmations,etc. are imminent ) . I mentioned this to
Elena following the meeting and told her I would chat with her about it
but I wanted to run it past you first.
As you probably know, Donna and McCaffrey are having lunch this. week to
discuss needle exchange ( and take my name in vain! ) . Donna is now back
on_the program of telling people that we can't do anything until Satcher
is confirmed ... which is fine. That should allay the General's concerns in
the short run. But that isn't going to keep us from getting pounded in the
interim if it doesn't appear that we have a plan while we are on hold.
Not much new on the Medicaid expansion front.·Nothing a little money and
conversation won't fix in the short run.
The Council is particularly focused on beefing up our office and expressed
as much to Erskine. I know there is very little you can do to fix the
problem. I have made some progress with detailees and will continue to
work on this after the holiday. The Council and the community are
concerned that we are taxed to the max. That may well be true but so is
everybody else in the WH. I think I must appear to be a little frayed
around the edges. Nothing a couple of days off won't cure. I am, after
all, considerably older that the rest of· ya'll!
I am sorry that I missed the party. I had made plans when I thought we
were convening on the 13th.Todd said it was lovely.

While I understand that OMB has particular concerns regarding the bang for
the buck we are getting from the CDC, and that these concerns have been
directly expressed by OMB to the AIDS advocacy community, I am concerned
that giving CDC no new AIDS prevention dollars
{not even a few pennies
) , or giving more money to STDs to " teach the AIDS people a lesson"
might not be helpful to us in the long run either politically or
programatically.
We are working very closely with CDC to impress upon them the need to ·
provide information
{ and product ) in a format that is acceptable
to OMB. ·~···. and the rest of the community for that matter. Our failure
to acknowledge the importance of prevention at the same time we are so
dramatically increasing treatment dollars sends a bit of a contradictory
message.
The malaria epidemic is long over. I vote that we pack up CDC and move

I only got the first line of the memo a minute ago. Now I have the whole
thing.
There have been no activities in Congress specific to needle exchange.
However, during the Satcher confirmation hearings Senator Ashcroft niade
some brief negative comments about needle exchange that were not respon~ed
to.
During the AIDS prevention hearing in the Health Subcommittee of the House
Commerce Committee,
DR Coburn asked a panel of four of his witnesses ( WHO, a city, state and
local health director, all of whom were selected because they were not
perceived as carrying the water of the AIDS community) if they thought
needle exchange was an effective public health strategy. Although none of
the witnesses had been told that needle exchange would be part of the
discussion, when pushed by Coburn to answer they all said" yes". HHS
reports·that he was visibly stunned and quickly moved on to another topic.
We are monitoring both the Commerce Committee and the Government Oversight
Committee and there is nothing on the radar screen between now and the end
of March.
It is rumored that the General has sent a letter to the President
indicating his opposition to needle exchange. Given the Congressional
waters are generally calm, the Administration might not want to muddy the
water at this critical time. I fear that leaking the General's letter
would do just that.

This memorandum is designed to provide background information on the issues surrounding the
Secretary of HHS's authority to waive the current restrictions on the use of federal funding for needle
exchange programs to reduce the transmission of HIV. A brief overview of the changing epidemic, the
public health response, the science, the public opinion, the politics, and other considerations are included.
I thought that some of this information might be helpful if_ shared with Bruce or others but I wanted to get
your input first. Please let me know what you think.
The Evolving AIDS Epidemic
IV drug use now plays a central role in fueling the spread of HIV, particularly among women,
children, and people of color.
HIV/AIDS continues to be considered by some as predominantly a gay white male disease. However,
AIDS is increasingly a disease seriously affecting people of color, women, adolescents, and IV drug users.
A recent report by CDC estimates that more than 50% of all newly reported cases of AIDS are associated
with IV drug use, including drug users, their partners and their children. In fact, IV drug use is now the
predominate cause of pediatric AIDS. In the last five years there has been a 32% increase in AIDS cases
in people of color (representing 63% of new cases), an increase of 64% in women (representing 20% of
new cases), and an increase of 22% among injecting drug users (representing 29% of new cases). The
gay community continues to be heavily impacted, but the disease is clearly moving rapidly into poorer and
more disenfranchised populations. While death rates and new cases of AIDS have both declined in
-recent months as a result of better therapies, the rate of new infections has not gone down, and there is
great disparity among affected communities. For example: while the death rate from AIDS declined 25%
for men, it declined only 10% for women. For white men and women the decline in AIDS deaths was
32%, for Latinos it w~s 20%, and for Blacks· it was only 13%. If we look at primary risk factors for
infection, the greatest drop was in gay men, for whom AIDS deaths dropped 30%. For injection drug
users the reduction was only 15%, and for heterosexuals (including partners of IV drug users) the decline
was only8%.
It is this burgeoning epidemic among IV drug users, their partners and children that have propelled the
issue of needle exchange to the forefront of AIDS policy. As those on the front lines fight to keep these
families alive long enough to get them into treatment and off drugs, they seek effective strategies for what
often seems an overwhelming task.
Scientific Overview
Credible evidence demonstrates that needle exchange programs reduce the spread of HIV without
increasing drug use, thereby saving countless lives.
In February, the Secretary of HHS reported to Congress on the results of several major studies of needle
exchange programs, including those conducted by the National Institutes of Healt lr-'Qe.""'-'i\QIIeQi-"~
Disease Control and Prevention, and the National Academy of Sciences. More than 1 ~~
reviewed. These studies provided strong and credible evidence that needle exchange p ra s

a positive impact on reducing the transmission of HIV among users. This translates in o

, programs increase drug use by program participants or in the communities in which the programs were
conducted.
Public Health Overview
The Administration seeks to retain the Secretary's authority to gather scientific data not to create
a national needle exchange program.
Several years ago, the Congress banned the use of federal funding for needle exchange programs
unless the Secretary determines that such programs have been found: {1) to reduce the rate of HIV
transmission, and {2) not to increase the use of illegal drugs. If the Secretary was to make such a
determination, based on credible scientific evidence, this would not create a national needle exchange
program, as the opposition likes to claim. Such action would simply give state and local public health
officials the flexibility to include this strategy as part of a comprehensive HIV prevention program -- if, and
only if, they chose to do so.

Although some may frame this debate as solely about federal support for needle e'xchange programs, it is
actually about much more basic. public health· policy. At the core of this debate are two essential
principles of public health: (1) that sound science and not politics should drive policy development, and {2)
that state and local public health officials should be given the flexibility to design programs that meet the
needs of their citizens. Since the beginning of the AIDS epidemic, these principles have guided the
federal role in HIV prevention.

HIV prevention has always been a difficult political challenge-- raising issues that people would rather not
talk about. In the early days of AIDS, the controversy was over homosexuality; in 1997, it is over IV drug
use. In 1980s, the right wing said that AIDS education targeted at the gay community promoted
homosexuality. In 1997, they say that needle exchange programs promote illegal drug use. In each
case, public health officials employ these strategies because they have been proven to reduce the
transmission of a deadly virus. Consistently throughout the epid~mic, HHS has sought to make scientific
evidence available, report on the effectiveness of various HIV prevention strategies, and let programmatic
decisions be made locally, where the needs can be better assessed and the politics can be better
managed. In fighting to retain the Secretary's authority to "let the science drive" and "let local
communities decide," the Administration simply seeks to defend longstanding public health principles.
Political Landscape
Although this issue needs to be politically "managed," it is not gays in the military.
Unlike gays in the military, this is not a policy being pushed on those who will be forced to implement it-- it
is being pushed by them. The current restrictions on federal funding for needle exchange programs tie
the hands of city, county, and state health officials who are struggling to save the lives of their citizens.
More than 100 needle exchange programs in 27 states have already been developed with state and local
funds. Now, the National Association of City and County Health Officials and the Association of State and
Territorial Health Officers are seeking the flexibilityto use federal HIV prevention funding for this purpose.
These officials
are joined by a host of mainstream health, public health, and governmental
organizations including: the American Medical Association, the Academy of Pediatrics, the American
Nurses Association, the American Public Health Association, the National Academy of Sciences, the US
Conference of Mayors, the National Black Caucus of State Legislators, and the American Bar Association.
Given this line up, it is difficult for the opposition to pass this off as fringe policy put forward by those who
do not understand how the system works.
The policy of local control is tremendously popular with the vast majority of Americans. Further nee.dle
exchange programs are supported by a majority of Americans. A 1996 poll done by the Kaiser Family
Foundation found that two-thirds of Americans favor providing clean needles to IV dru ~eo

�poll done by the Republican Tarrance Group found that 55% of voters supported needle exchange
programs as a way to curb. the spread of· AIDS. This poll found 64% of Democrats and 58% of
Independents supported needle exchange, with ari 11% spread in the South and a 33% spread in the
West. In addition, the editorial boards in all major media markets have solidly supported needle
exchange, many challenging the Administration to take a more active leadership role.
Finally, there are bipartisan leaders on Capitol Hill who want to join with the Administration in standing up
for sound public health policy. Although the House of Representatives stripped the Secretary of her
authority during consideration of the Labor-HHS Appropriations bill, the Democrats supported her by more
than a two-to-one margin (141-59). This was true despite the fact that the Democratic Leadership and
the Administration devoted little energy to working this vote. In addition, 16 Moderate House Republicans
joined with Democrats in the face of serious Leadership pressure to fall in line. On the Senate side,
despite right wing efforts to find a champion willing to bring this issue to Senate floor and ensure it was a
non-conferencable item, they found no takers. Therefore, the Secretary's authority, originally offered
several years ago by Senators Kennedy and Hatch, was affirmed by the Senate as part of the Labor-HHS
bill by a vote of 86-14.
In summary, unlike gays in the military, this issue may be sticky, but it is winnable.
Considerations
It is important to consider the potential negative political ramifications of seeking to maintain the
Secretary's waiver authority, and at some point, to exercise it.
A few such political
considerations follow.
The Right Wing: Certainly the Family Research Council will try to use this opportunity to say that the
Administration is soft on drugs. However, the Administration's record proves otherwise. On the issue of
needle exchange itself, again the Administration is not pushing a national needle exchange program; in
fact, the Administration would not support such an effort. We believe that HIV prevention decisions are
best made locally. It is the conservatives who often claim that the long arm of federal government has
reached too far into state and local decision making. Removing federal restrictions on how local
communities spend their HIV prevention dollars is an effort to be less intrusive, not more.
ONDCP: Dialogue with the General has been improving and the two of us are having breakfast this
Friday. His willingness to waive comment on the Statement of Administration Policy that went to the
Congress .supporting the Secretary's authority was a hopeful sign of cooperation.· While I certainly
understand his concern about sending the wrong message to young people, the vast majority of people
who use needle exchange programs are addicts that have been using for more than 10 years. In
addition, the research on needle exchange programs demonstrates that such efforts help to bring
hard-to-reach users into treatment. If and when the Secretary exercises her authority, conditions should
be placed on the use of federal funding to make sure that referrals to drug treatment are an integral part of
any program.
The Satcher Nomination: The Satcher nomination could be used by the right wing as a referendum on
needle exchange. However, conversations with those on Capitol Hill makes this . seem highly
unlikely.There seems to be the feeling that the hearing will proceed without a hitch. However, gun control
and the AZT trials for pregnant women in the developing world are still hot topics. It is true that Dr.
Satcher called for the removal of the restrictions on the use of federal funding for needle exchange
programs as CDC Director in 1993. This is widely known and a reality that will simply need to be
managed. He can certainly talk about the longstanding public health principles of "let science drive" and
"let local communities decide" as policies he will embrace as Surgeon General. In addition, his views on
needle exchange can be wrapped in mainstream public health support by our friends " th.:. ,..,..,....,....;tt.,..,.
Finally, unlike Dr. Elders, Dr. Satcher would certainly say he opposes legalization of dr ~~Clj\~
like to claim that needle exchange is a slippery slope to legalization.

�It is also important to consider the potential negative political ramifications of not maintaining the
Secretary's waiver authority, and at some appropriate time (i.e., after Dr. Satcher is confirmed and
the Congress has adjourned), exercising it. A few such political considerations follow.
The AIDS Community: This issue has become central to the AIDS community and, rightly or wrongly, it
has become symbolic of the Administration's leadership on AIDS. ·The Administration can and should be
proud of the major increases in AIDS funding in the early years. However, with the Balanced Budget
Agreement, such major increases in the future are highly unlikely. In addition, each year since the
Republicans took the Congress, they have increased AIDS funding above the President's Budget
Request. In these times of limited resources, the AIDS community is looking for a new form .of
leadership, leadership on the difficult policy questions that lie ahead. As pressure on funding intensifies,
maximizing the effectiveness of each dollar becomes increasingly important. Generic prevention
pamphlets will simply not save the lives of IV drug users and their families.
There is no doubt that the AIDS community would feel abandoned by the Administration if the Secretary's
authority is not maintained; I have heard a protest would be scheduled for the President's visit to the
Human Rights Campaign Dinner, and several members of the Presidential Advisory Council would resign
at the December meeting.
The Public Health Community: Many in the public health community have been concerned that the
reinventing government reforms at HHS have dismantled the Public Health Service -- traditionally charged
with seeing to it that as administrations come and go, politics do not ride rough-shod over public health.
Public health officials are concerned that the new HHS structure politicizes public health policy. Walking
away from the longstanding public health principles at play in this debate would reinforce this perception.
In addition, mayors and their health officials, who have watched significant authority and flexibility turned
over to the states, are looking for some help here in dealing with the twin epidemics of AIDS and drugs in
our major urban areas.
Communities of Color: Some certainly perceive that the reason that the Administration is not fighting
for this important policy is because it does not affect the gay community, known for it's financial support of
the campaign. Some have already called it racism, claiming that if the President really wanted to have a
national dialogue on race, he would deal with the reality that AIDS is the leading cause of death in the
African-American community and a leading cause in many communities of color. The gay community
was able to go out and raise private funding to pay for effective, targeted HIV education programs when
the government got squeamish. Unfortunately, disenfranchised communities cannot. While it may be
true that the issue of needle exchange is difficult, it is also true that it saves lives. For those who are
continuing to watch their friends and families die, the politically sensitive nature of the debate offers little
consolation.
Recommendations: Let us discuss.

We seem to be getting mixed messages regarding our World AIDS Day events.
According to Chris and Sarah we have now decided that we don't have to
come up with an initiative to announce on World AIDS Day. In addition, I
understand that we are considering sending the President to the Pediatric
AIDS Foundation event with Mrs. Clinton. This will be politically very
problematic if we don't also do something of substance with him on that
day.
If we are going to trash the MTV idea, that's fine as long as we have the
President do Something with a little ballast. The Pediatric AIDS
Foundation event is simply too quaint to be appropriate at a time when we
have dozens of teenagers getting infected at a pop because our nation's
apparent inability to support the youth we profess to be so dedicated to.
We will be criticized for it, and deservedly so.
Let us not forget that over SO% of all new infections in this country
occur in people under 25, and 1 in 4 are in teenagers. It would be helpful
to have a little focus on education from the " education" President. This
initiative, and our visible leadership is an opportunity to respond to an
urgent need, with no new money.
Apparently I am missing something here. As usual, I need you to help me
understand what the deal is here .... and I need your advice on how to
proceed.

Draft language on AIDS funding for Conference SAP
Thanks for sending me the draft language for that portion of the
Conference SAP dealing with ADAP funding. I have several comments.
First, I recommend strongly that the Administration take a more supportive
stance on ADAP funding by clearly supporting the $132 million in the House
budget. This is a fundamental marker of the AdministrationO,s commitment
to AIDS funding, a subject made all the more sensitive because of the lack
of protected status for· any AIDS program in the recent budget agreement.
The difference between the House and Senate numbers is small relative to
the entire LHH appropriations, yet it will make a big difference to states
that are trying to meet growing demand for drug assistance.
There is also some susceptibility to a charge of hypocrisy if you state in
the SAP, 0& ... the Administration wants to take advantage of recerit
advances in AIDS treatment as quickly as possible08 without then actively
supporting the higher number for ADAP.
Second, I am having a great deal of trouble with the last sentence of the
draft language (O&these Titles spend larger proportions of their grants on
primary care and drugs. than any other AIDS treatment programs ... 08).
Definitions of health care services and primary care have differed widely
across the Titles. Also, my understanding is that Title I pays for more
·primary care than Titles II, III 1and IV combined (excluding ADAP funds).
I am also concerned that we donO,t gratuitously editorialize in ways that
are bound to anger large constituency groups, including big-city mayors
and large AIDS service organizations. This issue needs further discussion
and analysis before we continue with this line of argument.

operator. I am in Miami at the U.S. Conference on AIDS, busily trying to
explain to the 2,500 attendees, along with the wire services and TV
reporters, why the Republican Congress is. better on AIDS funding than our
Administration (that was a real question posed to me more than once this

I think we might want to consider another meeting that would include a
broader and more diverse base to provide us with political cover. The
dynamics around singling out the two largest Washington based
,
·organizations that are perceived by others as largely representing the gay
community at the time when the new wave of the epidemic is predominately
people of color, women ( particularly women of color) and adolescents are
·significantly problematic. This, coupled with the growing concern in the
AIDS community that the Administration has abandoned AIDS at the verY
moment it is raging in minority communities, makes it even more important
that we make every attempt be inclusive.
Having said that, I have spent the last several months trying to assure
these people that AIDS remains a high priority for the Administration but
they are now at a point where they are looking for something tangible.
There are two important issues on the table in the Labor/HHS conference
( needle exchange, and Ryan White funding ) and the AIDS community is
looking desperately for signs that the Administration is going to do the
right thing by them. Perhaps the most important thing is to see if we can
get together internally and figure out how to advance this and then decide
how, and when, it is best to engage the community in the dialogue.
As you know, Daniel Zingale of AIDS Action Council and Winnie Stachelberg
of the Human Rights Campaign met yesterday with Rahm to discuss the needle
exchange issue." They felt that it was a productive meeting. I have all the
polling data and talking points they shared with him and would be happy to
provide them to you or brief you on them if that is helpful.

Hey There!
I am sorry I missed our meeting this morning.I was stuck in horrible
traffic coming in from Virginia, which affirms my decision to move to the
Hill { even though all my friends think I have lost my mind ) .
At any rate, I desperately need to steel a few minutes of your time,
sooner rather than later.
I am particularly concerned about followup to the Vaccine Initiative. I
have met with all the major AIDS and vaccine advocacy groups and they all
insist that we need to do something in Denver, not neccesarily as part of
the Summit per se, but as a parallel event.{ I am sending you a memo on
this) . If indeed we decide to do this we need to get ourselves in gear
pretty quickly.
Other issues I want to chat with you about include:
1. Our rapidly declining and extrordinarily counterproductive
relationship with our
collegues at HHS( Eric has been grounded and
can't play with me anymore, so we are sneaking around
after hours to get our
work done ..... isn't that cute?).
2. The fact that the AIDS community feels that we have
"de-prioritized" AIDS as a result of a combination'of events including
the
budget agreement, the failure to get additional money
in the supplemental for
ADAP, and the misconception that
our focus on vaccine development indicates
a waning
interest in treatment. { We are handling this pretty well, but I want to
bring you up to date and bounce a couple of ideas off of
you).
.3. The need for press support for this office has been clearly evident
in
the aftermath of the vaccine announcement. It is the
consensus of all the AIDS
groups, and I happen to agree,
that we seriously underserved our boss on this
issue. I
think we can salvage this over time, but I want to make certain it never
happens again.
4. I am dying of exhaustion! In .the past this office has operated, ·for
all
intents and purposes, as on outpost of HHS. Now that
we are attempting to be
a little more proactive on these
issues, we seem to be generating an inordinate
amount of
work for ourselves.This hasn't appeared to as much of an issue in the
past, and consquently I was not prepared for such an
onslaught of activity.
So ... I need you kind assistance in leaning on some folks
to get us a little help
over here ..... I'm too old for this!!!!!!!

Thanks for getting back to me so quickly!
The problem with not going with recommendation 1 (moving from "if" to
"when and how") is that Secretary Shalala said in a large community
meeting ( with representatives of a strong Ryan White advocacy
organization) that she was working on the "when and how." To have gone on
this long without having moved is seen not as the Administration moving
slowly,but as moving backwards. Affirmation that this is our inten:t.is
what the community is coming to hear.
The community does not have any reason to believe the Administration is
actively moving toward removing the restriction on Federal dollars. In
fact, we have been openly accusec;i of deliberately "waiting" to allow the
Republicans to take the authority away from HHS. From what the community
can discern from the appropriations staffers, the ability to stop this
action in subcommittee may be good, but not in committee and certainly not
in the House.
If the Administration wants to stay on the "high ground" by arguing the
SCIENCE (which shows needle exchange programs are effective in reducing
seroconversions), we need to act before the House acts to remove HHS
authority. Waiting until the Republicans have played their hand by
attempting to remove this authority will likely result in the
Administration being accused of reacting to the politics, and not the
science, in moving forward with removing the restriction.
Regardless of whether the Secretary exercises her authority, House
Republicans are likely to rescind her authority. If we preempt that move,
we will be in a much better postur·e for a debate in the Sena~e and we will
have much <better cover.
We can wrap the Secretary's action in public
health (including a roll out with AMA, state and local health directors,
APHA, etc.) an~ accuse the Congress of playing politics with a life and
death issue. Because Congress is in my opinion likely to act (they

It has come to my attention that the signing of the Ryan White Care Act
has been tentatively scheduled for Monday, October 23 in Queens, New York.
This is a bit problematic since the First Lady cannot attend and

consequently her staff is very opposed to our doing any kind of event in
New York. As you know, both Mrs. Clinton's and Congressman Lazio's offices
were recently taken over by ACT-Up in protest of their lack of attention
to AIDS in the campaign.
Given this dynamic our preference would be to have a signing at the White
House, something that the Congress and community have weighed in strongly
about. However, if a White House event is a non starter, the President is
scheduled to be in Boston on Friday .. Since Senator Kennedy is the lead
sponsor of the bill might we consider doing the signing there? Some of the
best AIDS programs in the country are in Boston. At any rate, the bill
must be signed by COB Monday.

Thanks for the note. I am sorry that I could not be there but I have met
with the CAEAR Coalition several times over the past few months as well as
the groups that represent the other three titles of the Ryan White Care
Act.
We were able to get a more inclusive process in the Senate because it was
a process driven by Jeffords and Kennedy who assembled a bill based on
recommendations from the Administration and the AIDS community. On the
Hc:mse side the process has been more problematic because it was an attempt
to harmonize the divergent views of Coburn and Waxman. We have taken much
of our lead from both Waxman and Gephart who recommended that the White
House not take a visible role in the negotiations. Given where we are in
the legislative calendar they believed, and. we agreed, that the only way
to get the bill passed was to insure that it did not get politicized and
included in the traditional hissing match between the President and the
House leadership. Now that they are getting close to introduction itr"~~----....,
our hope that the process will come out from behind closed doors pr
more opportunity for dialogue with both the Administration and the
community. In the end we would like to work closely with the Senate
the community on a conference strategy that gets us as close to the~------------~
Senate bill as possible. As part of that process we will continue to be in

close communication with the Ryan White reauthorization working group of
the National Organizations Responding to AIDS ( a coalition of 150
national organizations) and which includes the CAEAR Coalition on the
executive committee.
Regarding the recommendations:
1.) ONAP requested a POTUS statement calling for the House to take action
after the Senate bill passed. The idea is still a good one but the timing
is a bit awkward.
2.) The call for bipartisan support should be included in Administration
statements on budget and legislation and. I have discussed this with Sylvia
but we ought to have a follow up conversation.
3.) Either a radio address. or message event would be good

the event is not in California because San Francisco and LA are engaged in
a nasty fight regarding formulas) .
4.) NGA, NAACP, or DLC are all good opportunities to highlight
reauthorization. However, I think that NAACP might be our best bet. We

Senate and we are done with that process ( thank God! ) .

Yesterday a group of administration folks met with the CAEAR Coalition.
As you know, this group represents 51 metropolitan areas serving 500,000-1
Million persons living with HIV and AIDS.
They are extremely concerned about the passage of Ryan White, the Senate
version passed unanimously, but the House version is stalled in
negotiations between Coburn and Waxman and includes issues concerning
mandatory reporting.
Additionally, they are requesting that we provide better coordination of
legislative efforts between the WH, HHS and the community. They felt the
communities voice was not heard during negotiations with the Senate.
The following list sums up their recommendations:
1.) POTUS should call on the House to pass strong bi-partisan
legislation-~- similar to the Senate version.
2.) We should include this "call to action" in administration statements
regarding the budget and legislation.
3.) Have an upcoming radio address focus on Ryan White---

As you requested, here are a few reasons why I believe that we should not
release the Africa report next week at the NIH vaccine center event:
1) . Real deliverables are the key to maximizing our politics on this
issue, and I am not sure that we will have all agreed on real deliverables
by next week. We cannot afford to release a report that simply outlines
the horror of AIDS in Africa, without demonstrating leadership to help
turn the tide.
2).
If we are prepared to propose real action, we should get appropriate
credit.
If we try to do the NIH vaccine center and the Africa report on
the same day -- we will be stepping on our own message.
The NIH vaccine
center is about more than AIDS. In fact, the Bumpers ( for whom the center
is named and who will be present ) have been involved in childhood
immunizations but have. never been involved in AIDS. If done together, one
of these two issues is likely to get short shrift. Both are important.
Each stands on its own.
3). Given that the South African inauguration is scheduled for June 16th
and the G-8 for June 18th, OVP, NSC, and I all agree that this is a great
time to demonstrate US global leadership. Africa will be in the news
because of Mandela's swansong and the G-8 is scheduled to talk about debt
relief for sub-Saharan Africa.
All things considered, releasing the report sometime during the week of
June 14th seems like the better timing. Don't worry, we would not be
expecting another POTUS event, we can simply talk about a press rollout
strategy.

Here is the excerpt from the President's meeting with the Advisory Council
on HIV/AIDS relative to international AIDS funding.
I have included the
specific response of the President, and then the complete question and

THE P~ESIDENT: Well, in general, let me say I think the budget
should reflect better attention both to prevention at home and to the
communities of color. And I've been trying to·get more money for the
USAID mission and we'll put some more money in there;
======================
MR. ISBELL: Mr. President, six million people become infected
with HIV each year around the world, half of them under the age of 25.
More than 90 percent of the infections in the world happen in the
developing world where there is little or no access to the drugs that
have made such a big difference to people in this country.
We were extremely impressed and heartened by your use of World
AIDS Day to highlight the need for American leadership in the global
fight against HIV. We strongly support the $10 million program that you
announced to address the needs of women and orphans of AIDS. And we
would strongly support you making this one-time funding a permanent part
of USAID.
Despite this initiative, Mr. President, U.S. funding for global
AIDS activities has declined in real dollar terms since 1993. Just last
year the administration proposed a 10 percent cut in federal support for
funding for intectious disease programs throughout the world. We
believe that we cannot turn the tide against HIV throughout the world
without the aggressive, bold, energetic leadership of the United States.
And we would strongly encourage .in your next budget, Mr. President, that
you're about to send to the Hill, that you include substantial increases
for international AIDS programs at USAID and the CDC.
Just also to close, we'd also strongly support an improved
coordination of the many federal programs that happen all across the
government that have a .role to play in the international AIDS effor~~w-~------------,
Secretary Albright has announced, as you know, a plan to draft a U . .
international AIDS strategy, and we would hope that you would look
this as a first step toward making sure that all the federal agenci ~
are reading off the same page and that they're part qf the same tea,~~~--------~
because it's an urgent problem and it requires an urgency of the entire
U.S. government.

THE PRESIDENT: Well, in general, let me say I think the budget
should reflect better attention both to prevention at home and to the
communities of color. And I've been trying to get more money for the
USAID mission and we'll put some more money in there.
I think I'd like
to make two points.
One is that this budget year will be more difficult than the last
one because we got such big increases in everything last time and
because of the global economy kind of slowing down, we don't expect the
same amount of revenues to come in this time. And we have to fund all
the big increases we got last time again. But we'll do the best we can.
The second thing I would like to say is I think that it would be
very helpful to have all of you using your, whatever influence.you have,
with members of Congress in both parties to support more global efforts,
because eventually all this is going to a menace to the United States.
So it's not only a moral imperative, it's also very practical over the
long run.
One of the things that has kind of bothered me is that in the
aftermath.of the Cold War we were able for several years to reduce our
defense budget, and that was a good thing and everyone --and even the
Pentagon wanted to do it. There reduced like by about 300,000 the
number of civilian employees. And they plan for further reductions
there.
But during that time, we actually needed to make a larger
commitment on the diploma~ic front or in the non-defense security areas,
if you will. And with the exception of the special efforts we made in
the former Soviet Union to dismantle and destroy nuclear weapons,
basically there's been a wholesale effort to cut back on our-diplomatic
budget, even though, contrary. to popular wisdom, the United States
spends a smaller percentage of our income on international affairs than
any other major country.
And one of the things that I have seen -- almost no one knows
this, but it's true -- one of the things that I have -- now, to be fair,
we also spend more on defense and a lot of our defense goes to protect
other _countries, as you see in the last couple of days.
But, still, for
the numbers -- are so much more modest, not only for -- if you just look
at the USAID program, the health programs, the empowerment of women and
children, especially young girls, initiative, the small scale
microeconomic development -- all that stuff that doesn't cost much money
and it has a huge impact. And especially a lot of the things we can do
in public heath.
And, interestingly enough, a lot of the preventive activities that
we would engage .in with regard to AIDS, for example, would go quite well
with other things we need to be doing out there with these large
populations anyway in a lot of countries t):lat have severe public health
problems.
So we've been sitting here meeting in our-- I've been having~e~~-rt~tr.~~lhw---------~
of the last three or four days rather long, detailed budget session~,
trying to figure out how to get more blood out of that turnip. ··And ~opy
of the things that I'm trying to do is to figure out how to make the \....,
case to the Congress in an effective way that the United States has.._____________..
enormous interest, as well as obligations, in making these kinds of
investments beyond our borders.

And I think anything you can do to help that, I would appreciate
it.
I mean, there is this sort of g~neral awareness in Congress that
the world is becoming more interdependent. There's a much more
sophisticated understanding of the economics, for example. But it's not
just economics.
It's the environment, it's the public health, it's all
these other things where we are becoming more and more caught up with
each other.
Our major military mission in the last six months, before the
operation in Iran, has been to send several thousand of our uniformed
personnel to Central America to help them rebuild after Hurricane Mitch.
It's not only the right thing to do from a humanitarian point of view,
it is in our national interest.
Because if those countries don't
rebuild they will become highly vulnerable to all the drug traffickers.
And if they don't rebuild then all their people will have to come here.
Arld if they can't get here legally will try to come illegally.
So
there's all these things that we need to begin to see our relationships
beyond our borders, as more of an extension of our relationships with
one another, rather than as something totally different and apart from
our relations with one another.
And, anyway, I don't mean to.give you a speech on that; I know you
believe that.
But the point I want to make is, most people who run for
Congress never have to think about these things unless they have a large
immigrant population within their district from a particular place.
So
it doesn't -- this kind of discussion we're having, because you
understand the HIV/AIDS issue -- I'm preaching to the choir here. But
anything you can do to sort of just sit down and walk through this with
congressional delegations, or their chiefs· cif staff, or whoever· the
appropriate people are from around the country, I would really
appreciate.
Because I think there is a lot of support.
For example, you can
always get good support in Congress, bipartisan, for a big increase in
the Ryan White Act. And now, we've finally got pretty good support in
Congress, this whopping increase we had to help people purchase the
drugs, the medicines.
But it drops off markedly when you try to talk
about the connection between what we're doing here at horne and beyond
our borders. And I really think you could help, ·because this is one
example of a more general challenge the country will have to face -more every year for the next 20 years. Maybe forever, but certainly for
the next 20 years.

Greetings from Washington! I have been meaning to send you a note to thank
you for all of your incredible support during our visit to South Africa.
It was, as always, a perfect delight to work with you! I hope we have an
opportunity to work together again in the near future.
The whole AZT issue and intellectual property rights/compulsory licensing
issue continue to heat up. The demonstration occurred today and received a
good deal of press coverage.
I spoke with Steve Sternberg today and actually think it would be. a good
idea to talk to him" on the record"· He is trying to give us the
opportunity.to make our case in the face of mounting criticism from of
variety of sources.
I think that the opening paragraph of the text is great. However, I would
caution us in our talking points not to appear combative or defensive,
particularly of the pharmaceutical companies. Remember, the advocacy
community thinks they ( the drug companies ) have us in their proverbial
pockets so our defense of them only reinforces that notion. Besides, they
are more than capable of defending themselves! While everyone recognizes
that investment in research and development is an essential component in
the development of new drugs, let's face it ... these guys are hardly going
broke in the face of this epidemic!
I think it is essential that we continue to be positive and upbeat and
focus on the United States' commitment to work with both the South African
Government and industry to find a balance between the need to increase
access to drugs while, at the same .time, protecting the incentives that
lead to the discovery of new and better treatments.
I am attaching the talking points that we prepared for internal use and
the statements we prepared for the press office.

organizations (NGOs) and community-based care. There are ~lso funds
being spent on tuberculosis, multi sectoral work, and reproductive health.

The CDC has worked with government and NGOs on prevention,
surveillance, and .training. The Nlli has conducted collaborative research
in the area of prevention and have established sites for vaccine trials.

As a result of the $10 million that the President set-aside for children
orphaned by AIDS, and as a follow-up to Sandy Thurman's recent trip to
SA, it looks likely that SA will receive $1.5 million for community-based
projects in Soweto, Capetown, and KwaZuluNatal.
D.
The cooperation between the US and SA around AIDS has generally
been positive. · However, Dr. Zuma, the Minister of Health, has become
embroiled in a series of high profile controversies (on AIDS and other
issues) that have consumed considerable time, attention, and resources.
Therefore, Zuma has been seen by many as an obstacle to the formation
and implementation of a clear and cohesive national response. However,
she does remain close to Mbeki.
E.
SA has gone through an extensive process of planning and consensus
building on AIDS. It is now time to move from paper to practice --by
translating good policies into effective action. In addition, the recent
stoning to death of a woman who was open about her HIV status to help
educate the public, highlights the need for high level and ongoing
leadership in reducing stigma.
IV.
SA PERSPECTIVE
The SA ministry of health does not support the delivery of AZT to
pregnant women. They believe that, given limitedresources, investments
in broad-based prevention programs are more cost effective. In addition,
they believe that, after years of the benefits of government going only to ar---~--.....,
select few, that interventions provided by the government ofthe new SA
should be universal.

The President and I have asked Sandy Thurman, our AIDS advisor, to ·
recommend ways to improve our response to the growing number of
young people orphaned by AIDS. She just concluded a trip here and will
return later in the spring with some members of Congress to try to increase
their awareness of the needs. US AID has told us that there will be over
40 million AIDS orphans by 2010 and we'd like your advice on how we
can improve our response.

Regarding the proposed trip to Africa that resulted from the President's
remarks on World AIDS Day; I wanted take the opportunity to convey my
concerns about the suggestion that .the mission be led by the Congress and
to reiterate a brief history of this project.
First, while a congressionally driven delegation may save money, this
approach could be serious trouble for us if the Republican Congress
decided to get deeply involved in the politics, the policy, or the invitee
list. For example, what if they decided that since they were paying for
the codel to Africa -- a look at the family planning programs, abortion,
or other issues were also in order? Further, as you know, Dr. Coburn has
taken a keen interest in HIV/AIDS, particularly with respect to women and
children.
Should he or any of his highly conservative colleagues seek to
be part of the delegation, our inability to restrict the invite list would
be problematic.
Finally, those who are looking to us for leadership on
this issue (i.e. the CBC and the African American and AIDS communities)
would be extremely disappointed if we gave control of this process to the
Republican Congress, and the trip ended up being a failure.
In the end, the idea of this trip is to advance the politics and the
policy of this issue.
I strongly believe that we can do just that, but
our control of the process would dramatically enhance our control of the
outcome. With this in mind, I continue to believe that a Presidential
mission is in the best interest of the President.·
In addition, I thought I would be useful to reiterate the history of how
we got where we are.
On December 1, the press release issued by the -White House press of
specifically stated that we would "lead a fact-finding delegation"
that the "delegation would include representatives from key Congres ional
offices".
This release created an expectation of a White_ House

communities;
(3)
members of Congress themselves, particularly CBC members;
NGOs, advocates in the African-American, AIDS, and religious
and
a range of government officials and NGOs in Southern Africa.
Based on this directive, we began to receive numerous telephone calls from
congressional staff and members about their desire to participate in such
an effort. At that point, we drafted a proposed congressional invite list
and vetted it with NSC, leg affairs, State, and USAID.
As we discussed, it was our hope to move expeditiously on the delegation,
and we sought to schedule it for the period between New Year's and the
beginning of 106th Congress.
However, the impeachment trial, and the
Iraq situation and its safety implications for African embassies,
ultimately complicated taking a delegation to Africa which included
members of Congress during that period.
Once we realized that it would be impossible to move forward in January,
we began to tell interested congressional members (who continued to call)
that due t~ circumstances beyond our control, the trip would have to be
postponed -- perhaps until. the Easter recess.
At this juncture, there is certainly an expectation on the hill that we
will be leading a delegation including members of Congress to Africa some
time soon.
This expectation also applies to the USAID teams and US Ambassadors in a
host of African nations. Shortly after the President's World AIDS Day
speech, the countries were notified -- by the State Department -- that a
codel was coming to Africa
While I was there on the advance trip, all of
the US Ambassadors expressed serious excitement about an upcoming
delegation including members of Congress. The State staffer who
accompanied us on the entire trip, engaged in these conversations, and
remained genuinely supportive of the codel.
After many years of ignoring the international situation, the US AIDS
community is now very focused on the pandemic in Africa.
The President's
AIDS Council talked with him specifically about the need for increased
Administration leadership on the international AIDS front.
They are
returning to Washington March 15th and will be seeking updates. Given
that the FY2000 budget does not provide the USAID funding increases they
were looking for, being able to demonstrate our lea~ership in other ways
would be helpful.
As Ben said at our meeting, the CBC and the African American community is
actively engaged in this issue and is monitoring this project closely. We
are certainly receiving many calls, letters, and emails -- and Ben says
that he is as well. While they feel good about my recent trip -- they are
looking to us to help build a partnership with Congress for an enhanced
response.
I am scheduled to give remarks on Friday at the conference of African
Americans on AIDS.
This is a large gathering and will be carried on
CSPAN. They are expecting me to talk about international issues anc~~wh~aL~t--------~

frequently about our upcoming trip and how to coordinate visits to their
programs in Africa.
In terms of the strategic objectives we discussed: to elevate the
importance and the responsiveness to this issue in host countries; and to
build a partnership for progress with the Congress; it certainly seems to
me that we have not yet accomplished our goals.
All'in all, I believe that this project is well worth pursuing.
If we
work together, I am confident that we can achieve a substantive and
political win for the President.
I have attached a revised Congressional invite list as you requested.
I
have been hesitant to schedule the briefings we discussed until we are
clearer about how we plan to proceed.
I hate to state the obvious, but we need to make a decsion about this
fairly quickly so that the members can make appropriate plans. We are
currently looking at their departing on March 27 and retuning on April 5.

Dr. Mathilde Krim of the American Foundation For AIDS Research and
longtime supporter of the President recently issued an invitation to Mrs.
Clinton to speak at their annual luncheon at the United Nations on World
AIDS Day, December 1, 1998. She received a letter indicating that the
First Lady's schedule would not permit her to accept the invitation.
Last week the President announced an new $158 million initiative to
address the raging AIDS epidemic in the African American and other
communities of color. More than 50% of all new HIV infections in this
country are in people under 25 years old and the vast majority are African
American or Hispanic. The hardest hit, by far, are women.and children.The
focus of World AIDS Day this year is on adolescents and Mrs. Clinton's
commitment to young people is legendary ( I knew of her work long before I
knew anything about her husband other than the fact that he was Governor
of Arkansas! ) .
If we can't revisit the decision regarding the AmFAR luncheon could we
possibly schedule a site visit to an HIV/AIDS program for at risk youth or
women and children? There are a range of options in New York City that
could be considered.

I am scheduled to make a speech in Dallas tomorrow night to the largest
gay and lesbian black tie event in the ·country (4,000 people ) which
benefits 20 gay/lesbian and AIDS organizations including the Human Rights
Campaign. The HRC chapter in Dallas issued the invitation on behalf of the
dinner committee several months ago presumably because of the
Administration's long-standing relationship with them. I have also planned
to meet informally with several gay and lesbian and AIDS activists.
Ginny Apuzzo has denied my travel request.
We cannot afford to loose the support of the gay and lesbian in
developing sound a~d effective AIDS policies. Our slight of both the gay
and lesbian communities in Texas is not good for us either substantively
or politically.
I hate to drag you into the middle of this but I·think, as does Richard
Socarides, that this is a huge mistake.
Any advice or help you could offer would be greatly appreciated.

The frustration in the AIDS and public health communities over our failure
to act on needle exchange continues to mount with the expiration yesterday
of the moratorium on funding.
The President's Council on HIV/AIDS is now circulating a resolution
calling for Secretary Shalala's resignation ( I will forward a copy ) .They
will vote·next Thursday. The resolution is expected to pass and be
endorsed by several of the national AIDS organizations.
AIDS Action Council ( the organization that represents the largest number
of AIDS service providers) is having it's board of directors meeting in
Washington on Monday. They will be discussing what actions to take in
response to.our inaction. Monday night is their awards dinner where, last
year, the Vice President announced the ill fated demonstration program on
Medicaid expansion for people with HIV disease. As you all know, we are
still working to recover from that little snafu.
In the interim our friends at HHS made overtu~es ·to the AIDS community
that they were going to meet with them this week to discuss the status of
needle exchange and now, once again, have failed to do so. The AIDS groups
are not amused.
The Human Rights Campaign, AMA, NAACP and a couple of other groups have
requested a joint meeting with Erskine to discuss this and Scott Hitt has
requested· to speak to him by phone. Neither request has been acted on and
these folks are calling me on a daily basis to see what the holdup is.
I understand that Donna met with Erskine and Elena last week to discuss
needle exchange. While it may be entirely appropriate, given the state of
affairs with Barry, not to include me in the meeting, some little clue
regarding what transpired might have been helpful in responding to HHS's
spin.
I appreciate that we are overwhelmed with tobacco and that several key
players are out of the country at the moment. However, it is becoming
increasingly difficult for me to manage the community politics aroi.md
this effectively in the absence of a little clearer communication and
good information. The fact that my best information regarding internal
meetings on-this issue is coming to me from the street rather than some
sort of internal channel is problematic and is putting me in an_awkward
and somewhat embarrassing position.
Again, I know you are swamped, but any guidance you or Elena could give me
as how best to respond to all of this would be greatly appreciated·.
You warned me that these decision making processes might prove to be a
trying .... however, this is downright tedious.! ! ! !
