Authority to use Force in Haiti

The attached paper explains the basis for your constitutional
authdrity to use force in Haiti.
It has the concurrence of the
Just~ce Department, Secretary of State Christopher, the State
Depa~tment Legal Adviser, and the NSC Legal Adviser.
It is possible a law suit will be brought challenging your
auth9rity.
Such a law suit might be brought either by a Member
of Congress, a member of the military, or a group of law
profe~sors. Such law suits were ·brought in the past concerning
El Sa~vador, our support to the Contras, Grenada, and the Persian
Gulf.j They consistently have been dismissed on procedural
grounds (lack of standing, political question, and most pertinent
here,jlack of "ripeness" until a congressional majority has
challrnged the President's authority).
In addition to your constitutiona1 powers, the DOD Appropriations
Act p~ovides additional legal support for action in Haiti
provibed we are willing to act consistently with it. A provision
in it\ calls for prior congressional authorization except in ~hree
situa~ions.
The third exception is the provision of an a,P,v,a,nce
repor~ to Congress addressing six specific issues (U.s_: interests
in Ha~ti; safety of U.S. forces; sufficiency of the military
force deployed; objectives for the deployment; exit st'rategy; and
cost). While providing additional legal support for action
without a further vote by Congress, the report is unlikely to
satisfy those in Congress pressing for such a vote. We are
prepa~ing the report on a contingency basi~ and will provide you
separhtely a recommendation on whether and when it should be

submitted, while reserving your constitutional right to act
withoht following the statutory procedures.

<p>The <a href="http://www.archives.gov/presidential-libraries/laws/1978-act.html" target="_blank">Presidential Records Act (PRA)</a> includes provisions that these types of documents be withheld for twelve years after the end of a president's administration. These documents are now being made available to the public. The documents will be released in batches and will be uploaded here as they become available. The documents will also be available in the Clinton Library’s research room.</p>
