PFLP DEPORTATION CASE

Last year you asked Lloyd Cutler about a deportation case
involving eight members of the PFLP, a Palestinian terrorist
organization. Your question was prompted by an article in which
Anthony Lewis charged that the government's position was
inconsistent with the First Amendment.
Lloyd, however, advised
you that he agreed with the Justice Department position. (Tab A)
DOJ informed me on Friday that the Court of Appeals ruled
against the government in this case.
Specifically, it adopted a
broader view of the First Amendment rights of aliens than the
go~~rnment argued, and it held that Due Process principles do not
allow the secret use of classified information in legalization
determinations.
The Justice Department is considering whether to. appeal the
ruling.
The Washington Post editorialized against an appeal
today. (Tab B). Nevertheless, as far as DOJ is concerned, an
appeal is necessary and a virtual certainty. The Department is
also reviewing how the decision affects the constitutionality of
the counterterrorism legislation before the Congress,
particularly those provisions permitting deportation of alien
terrorists on the basis of classified information not shared with
the alien. in certain situations.

In rcaponse to your quettion about the PPLP case. we asked the Department of
Justice to prepare tbe attached brief memorandum summarizing the case and its current
status.
